Introduction

Welcome to the mobile application "Steps and Rewards" (the "App"). The App is operated by Steps and Rewards. These terms of use ("Terms") govern your use of the App. By downloading, accessing or using the App, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use the App.

Registration and account

In order to use the App, you will need to register and create an account ("Account"). You must provide accurate and complete information when registering for an Account and keep your Account information up-to-date at all times. You are responsible for maintaining the confidentiality of your login details and for any activity that occurs under your Account.

Use of the App

The App is intended for personal, non-commercial use only. You may not use the App for any illegal or unauthorized purpose. You must not, in the use of the App, violate any laws in your jurisdiction (including but not limited to copyright laws).

Rewards and discounts

For every 1000 steps recorded, you will earn a point that will be added to your account balance. These points can later be used to redeem offers and discounts provided by our partners through the App by using a discount code. To redeem the offer, you must go to the partner's establishment and present the code. We will be adding more partners to the App in the future.

Intellectual property rights

The App and all the material published on it (including without limitation text, images, logos, photographs, graphics, audio material, video material, software and podcasts) are protected by copyright, trade marks, database rights and other intellectual property rights. The App and the material published on it must not be used for any commercial purpose without obtaining a license to do so from us or our licensors.

Limitations of liability

Nothing in these terms of use will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations of liability set out in this Section and elsewhere in these terms of use: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under these terms of use or in relation to the subject matter of these terms of use, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided in these terms of use.

To the extent that the App and the information and services on the App are provided free-of-charge, we will not be liable for any loss or damage of any nature.

Breaches of these terms of use

Without prejudice to our other rights under these terms of use, if you breach these terms of use in any way, or we reasonably suspect that you have breached these terms of use in any way, we may:

• • send you one or more formal warnings;

  • temporarily suspend your access to the App;

  • permanently prohibit you from accessing the App;

  • block computers using your IP address from accessing the App;

  • contact any or all of your internet service providers and request that they block your access to the App;

  • commence legal action against you, whether for breach of contract or otherwise;
