StampCam Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the StampCam iOS application operated by Hui Quan Zhong, an individual developer ("StampCam", "we", "our", or "the app").

By downloading, installing, accessing, or using StampCam, you agree to these Terms. If you do not agree, do not use the app.

2. Description of the Service

StampCam is a watermark camera app for iPhone and iPad. Depending on the release, it may provide features such as:

• photo capture

• video capture

• watermark rendering

• customizable watermark styles

• optional location and weather overlays

• saving generated content to your device photo library

Some features depend on device permissions and platform availability.

StampCam is licensed, not sold, to you. If you obtain StampCam through Apple's App Store, your use of the app is also subject to Apple's applicable App Store terms, Usage Rules, and standard end-user license agreement where applicable.

3. Eligibility and Acceptable Use

You may use StampCam only if you have the legal capacity to agree to these Terms and only in compliance with applicable laws and regulations.

You agree that you will not:

• use the app for unlawful, fraudulent, or abusive purposes

• attempt to interfere with the app's normal operation

• misuse exported images, videos, or watermark content in a way that violates law or the rights of others

• use the app to infringe intellectual property, privacy, publicity, or other legal rights

• reverse engineer, decompile, disassemble, attempt to derive source code from, modify, or create derivative works of the app, except where applicable law expressly permits such activity

• use third-party services accessed through the app in violation of applicable third-party terms

4. Permissions and Device Access

Certain features require access to device capabilities, including:

• camera

• microphone

• photo library

• location

If you deny or revoke these permissions, some features may be unavailable or may not function properly.

5. User Content

You remain responsible for content you create, capture, import, edit, save, or share using StampCam, including:

• photos

• videos

• custom text

• selected images used in watermark customization

You represent that you have the necessary rights to any content you use with the app.

StampCam primarily processes user content locally on your device. These Terms do not grant us ownership of your user content.

6. Intellectual Property

The app software, app name, interface elements, and original app materials provided by us are protected by applicable intellectual property laws.

These Terms do not transfer ownership of the app or its underlying software to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose on Apple-branded products that you own or control, subject to applicable App Store Usage Rules.

7. Third-Party Services

Some optional features may rely on third-party or platform services.

For example:

• weather-related features may rely on a third-party weather provider

• Firebase Analytics and Firebase Crashlytics, provided by Google LLC, may be used for limited app analytics, diagnostics, and crash reporting

• Apple platform services may be involved in app distribution, permissions, photo library access, and related device functionality

Third-party services may be unavailable, delayed, restricted, or changed depending on your location, network environment, or the third-party provider's policies. We do not control and are not responsible for third-party services, third-party content, or third-party policies.

8. Privacy

Your use of StampCam is also subject to our Privacy Policy, which describes how permissions, local settings, location data, optional weather-related network usage, Firebase Analytics, and Firebase Crashlytics are handled.

9. Disclaimer

StampCam is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

We do not guarantee that:

• the app will always be uninterrupted or error-free

• every generated watermark, export, timestamp, coordinate, weather value, or saved file will always be accurate in every circumstance

• third-party services, analytics, diagnostics, or weather-related network requests will always be available or successfully delivered

• the app will meet every legal, evidentiary, business, or professional recordkeeping requirement you may have

StampCam is not a certified timekeeping, attendance, evidence preservation, or professional recordkeeping system. You are responsible for reviewing generated output and retaining any additional records you may need before relying on it.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for:

• lost data

• lost profits

• business interruption

• inaccurate output

• export failures

• disputes arising from user-created or user-shared content

If applicable law does not allow certain limitations, some of the above limitations may not apply to you.

11. Termination

We may modify, suspend, or discontinue all or part of the app at any time, subject to applicable law.

You may stop using the app at any time by uninstalling it.

Your right to use the app may terminate if you materially violate these Terms.

12. Changes to the App or Terms

We may update the app and may revise these Terms from time to time to reflect product, legal, or operational changes. When we update these Terms, we will change the "Last Updated" date above.

Your continued use of the app after updated Terms take effect constitutes acceptance of the revised Terms.

13. Apple App Store Terms

If you obtained StampCam through Apple's App Store, you acknowledge that:

• these Terms are between you and Hui Quan Zhong, not Apple

• Apple is not responsible for providing maintenance or support services for StampCam

• Apple is not responsible for claims relating to StampCam except as required by applicable law

• Apple and its subsidiaries are third-party beneficiaries of the terms applicable to your App Store license and may enforce those terms

Nothing in these Terms limits rights you may have under Apple's applicable terms or mandatory consumer protection laws.

14. Governing Law

These Terms are governed by the laws applicable to the operator distributing StampCam, subject to any mandatory consumer protection laws that apply in your jurisdiction.
