Welcome to Sphere Strike! These Terms of Use ("Terms") govern your access to and use of the Sphere Strike mobile application ("App"), developed and provided by Strike Innovate Labs ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.
By accessing or using Sphere Strike, you confirm that you are at least 13 years old and have the legal capacity to enter into this agreement. If you are using the App on behalf of an organization or entity, you represent that you have the authority to bind that organization or entity to these Terms.
We may update these Terms from time to time to reflect changes in the App, legal requirements, or our business practices. When we make significant changes, we will notify you through the App or via email (if provided). Your continued use of the App after such updates constitutes your acceptance of the revised Terms.
2.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. This license allows you to:
Track your bowling scores and performance.
Explore rankings of bowling balls and alleys.
Use features like filtering, sorting, and personalized recommendations.
2.2 Restrictions
You agree not to:
Modify, reverse-engineer, decompile, or disassemble the App or any part of it.
Use the App for any illegal, fraudulent, or unauthorized purpose.
Distribute, sell, sublicense, or otherwise transfer the App or its content to third parties.
Use the App to harm, harass, or infringe on the rights of others.
Attempt to gain unauthorized access to the App, its servers, or any related systems.
2.3 Account Responsibility
To use certain features of Sphere Strike, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials (e.g., username and password) and for all activities that occur under your account. 3.1 Submission
You may submit content through the App, such as feedback, reviews, or bowling scores ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and improving the App.
3.2 Responsibility
You are solely responsible for your User Content. You represent and warrant that your User Content does not:
Infringe on the intellectual property, privacy, or other rights of any third party.
Contain any unlawful, defamatory, obscene, or otherwise objectionable material.
Include viruses, malware, or any harmful code that could damage the App or other users' devices.
We reserve the right to remove or modify any User Content that violates these Terms or is otherwise deemed inappropriate, at our sole discretion.
The App and all its content, including but not limited to text, graphics, logos, images, designs, software, and underlying code, are the property of Strike Innovate Labs or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of the App or its content without our prior written permission.
The Sphere Strike name and logo are trademarks of Strike Innovate Labs. You may not use these trademarks without our express written consent.
Sphere Strike may include links to third-party websites, services, or content (e.g., bowling alley websites or external reviews). We do not control or endorse these third-party services and are not responsible for their availability, accuracy, or content. Your interactions with third-party services are at your own risk and subject to their respective terms and policies.
The App is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Strike Innovate Labs disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:
The App will be uninterrupted, error-free, or free from viruses or harmful components.
The information provided through the App (e.g., bowling ball rankings, alley details) will be accurate, complete, or up-to-date.
The App will meet your expectations or requirements.
To the maximum extent permitted by law, Strike Innovate Labs, its affiliates, officers, directors, employees, or agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the App, including but not limited to:
Loss of data, profits, or opportunities.
Inaccuracy of information provided through the App.
Any injury, loss, or damage resulting from your reliance on the App’s features or recommendations.
Our total liability to you for any claim arising from these Terms or your use of the App will not exceed $50.
We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, if we believe you have violated these Terms or engaged in conduct that we deem harmful to the App, other users, or our business interests. Upon termination:
Your license to use the App will immediately cease.
You must stop using the App and delete it from your device.
We may delete your account and associated data, subject to applicable laws and our Privacy Policy.
You agree to indemnify, defend, and hold harmless Strike Innovate Labs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to:
Your violation of these Terms.
Your use or misuse of the App.
Your User Content or any actions taken through your account.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time to reflect changes in the App, legal requirements, or our business practices. When we make significant changes, we will notify you through the App or via email (if provided). Your continued use of the App after such updates constitutes your acceptance of the revised Terms. The updated Terms will be effective as of the "Last Updated" date at the top of this page.

No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
