Terms of Service and End User License Agreement

1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using Sparqit ("the App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms"). If you do not agree to these Terms, do not use the App.
2. DESCRIPTION OF SERVICE
Sparqit is a video sharing platform that allows users to upload, share, and view video content. The App enables users to create profiles, upload videos, interact with other users' content, and engage with the community.
3. USER ACCOUNTS AND REGISTRATION
3.1 Account Creation
You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You must be at least 13 years old to use this App (or older if required by local law)
One person may not maintain multiple accounts
3.2 Account Security
You are solely responsible for all activities under your account

We reserve the right to terminate accounts that violate these Terms
4. CONTENT POLICIES AND PROHIBITED CONDUCT
4.1 ZERO TOLERANCE POLICY
We maintain a ZERO TOLERANCE policy for the following content and behavior:
Prohibited Video Content:
Nudity, Sexual Content, or Pornography: Any sexually explicit material, partial nudity, or sexually suggestive content
Violence and Graphic Content: Content depicting violence, gore, cruelty to animals, or disturbing imagery
Hate Speech: Content promoting hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Harassment and Bullying: Content intended to intimidate, threaten, or harass other users
Dangerous Activities: Content promoting dangerous challenges, self-harm, suicide, or illegal activities
Illegal Content: Content that violates any local, state, national, or international law
Copyright Infringement: Unauthorized use of copyrighted music, videos, images, or other intellectual property
Spam and Misleading Content: Repetitive, deceptive, or fraudulent content
Private Information: Content containing personal information of others without consent
Impersonation: Content that impersonates others or misrepresents your identity
Prohibited User Behavior:
Creating fake accounts or impersonating others
Attempting to hack, spam, or disrupt the App
Selling or transferring your account
Using automated systems to interact with the App
Encouraging others to violate these Terms
4.2 Content Monitoring
All uploaded content is subject to review and moderation
We reserve the right to remove any content that violates these Terms
Repeated violations will result in account suspension or permanent termination
5. USER-GENERATED CONTENT
5.1 Your Responsibilities
You retain ownership of videos you upload
You grant us a non-exclusive license to display, distribute, and moderate your content
You represent that you have all necessary rights to upload your content
You are solely responsible for your content and its compliance with these Terms
5.2 Content Standards
Videos must be appropriate for a general audience
Content must not violate any third-party rights
Videos must comply with all applicable laws
Content must be original or properly licensed
5.3 Content Removal
We may remove content without notice if it violates these Terms
Users may report inappropriate content through our reporting system
We will respond to valid content reports within 24 hours
6. COMMUNITY GUIDELINES
6.1 Respectful Interaction
Treat all users with respect and dignity
Engage in constructive and positive interactions
Respect cultural and individual differences
6.2 Reporting and Blocking
Use the reporting feature to flag inappropriate content or behavior
Users can block other users to prevent unwanted interactions
False reporting may result in account penalties
7. ENFORCEMENT AND PENALTIES
7.1 Violation Response
Upon violation of these Terms, we will take immediate action including:
Content removal
Account warnings
Temporary account suspension
Permanent account termination
Reporting to law enforcement when applicable
7.2 Repeat Offenders
Second violation: 7-day account suspension
Third violation: 30-day account suspension
Fourth violation: Permanent account termination
7.3 Severe Violations
The following violations result in immediate permanent account termination:
Posting illegal content
Harassment or threats
Sharing private information of others
Attempting to harm minors
Copyright infringement
8. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)
8.1 Copyright Policy
We respect intellectual property rights
Unauthorized copyrighted content will be removed
Repeat copyright infringers will be terminated

8.2 Counter-Notification Process

Terminated users lose access to all App features
Previously uploaded content may remain on the platform
Termination does not relieve users of prior obligations under these Terms
11. DISCLAIMERS AND LIMITATION OF LIABILITY
11.1 Service Disclaimer
The App is provided "AS IS" without warranties
We do not guarantee continuous, error-free operation
Users assume all risks associated with using the App
11.2 Limitation of Liability
Our liability is limited to the maximum extent permitted by law
We are not liable for user-generated content
We are not responsible for interactions between users
12. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.
13. GOVERNING LAW AND DISPUTE RESOLUTION
13.1 Governing Law
These Terms are governed by the laws of India.
13.2 Dispute Resolution
Disputes will be resolved through binding arbitration, except for intellectual property claims which may be brought in court.
14. CHANGES TO TERMS

Continued use constitutes acceptance of modified Terms
14.2 Notification
Changes will be posted in the App and via email
Users have 30 days to object to changes
Objecting users may terminate their account

These Terms are binding on successors and assigns.
By clicking "I Agree" or using Sparqit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and End User License Agreement.
This agreement is effective as of the date you first use the App and remains in effect until terminated in accordance with these Terms.
