By downloading, installing, or using the SparkShift mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. App Features and Services

 2.1 Core Features

SparkShift provides the following core features:

- Jobsite management and tracking

- Hours logging and verification

- Apprentice evaluation system

- Journeyman review capabilities

- Digital signature functionality

- PDF generation and management

- AI-powered task interpretation

- Location-based services

- Email verification system

2.2 Role-Based Access

The App provides two distinct user roles:

- Apprentice: Access to apprentice-specific features and evaluations

- Journeyman: Enhanced capabilities including apprentice reviews and advanced management features

3. Subscription Services

3.1 Subscription Tiers

SparkShift offers two subscription tiers:

- Apprentice Subscription: Designed for apprentice users

- Journeyman Subscription: Enhanced features for journeyman users

Each tier is available as either a monthly or yearly subscription:

- Monthly Apprentice: [Price]/month

- Yearly Apprentice: [Price]/year (Save [X]%)

- Monthly Journeyman: [Price]/month

- Yearly Journeyman: [Price]/year (Save [X]%)

 3.2 Auto-Renewable Subscriptions

- Subscriptions automatically renew unless canceled at least 24 hours before the current period ends

- Payment will be charged to your Apple ID account at confirmation of purchase

- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period

- Account will be charged for renewal within 24 hours prior to the end of the current period

- You can manage and cancel your subscriptions by going to your account settings on the App Store

3.3 Subscription Features

Each subscription tier includes:

- Apprentice Tier:

  - Basic jobsite tracking

  - Hours logging

  - Basic evaluation tools

  - PDF report generation

- Journeyman Tier:

  - Advanced jobsite management

  - Comprehensive review capabilities

  - Enhanced reporting features

  - Priority support

4. User Accounts and Security

 4.1 Account Creation

You may create an account using:

- Email and Phone Number

- Google Sign-In

- Sign in with Apple

4.2 Account Requirements

- Valid email address required

- Email verification/ Phone verification  required for full access

4.3 License Verification

- Professional license verification may be required for certain features

- Users must maintain valid licenses where required

- False license information may result in account termination

5. Location Services and Privacy

5.1 Location Data

- GPS location is used for jobsite tracking

- Location data is collected only when necessary

- Users can control location permissions through device settings

5.2 Data Collection and Storage

We collect and store:

- User profile information

- Jobsite data and coordinates

- Work hours and evaluations

- Digital signatures

- Performance metrics

- Device information

5.3 Data Usage

Collected data is used for:

- Providing core app functionality

- Improving user experience

- Generating reports and evaluations

- Maintaining service quality

- Compliance with legal requirements

 6. AI Services

6.1 AI Features

- Task interpretation and analysis

- Performance evaluation assistance

- Automated suggestions and insights

6.2 AI Data Usage

- User data may be processed by AI systems

- AI processing follows strict privacy guidelines

- Users can opt-out of optional AI features

 7. User Responsibilities

 7.1 Account Security

- Maintain confidentiality of account credentials

- Report unauthorized access immediately

- Regular password updates recommended

- Enable two-factor authentication when available

7.2 Content Guidelines

Users must not:

- Submit false work hours or evaluations

- Manipulate location data

- Share account access

- Upload inappropriate content

- Violate others' privacy

8. Digital Signatures

8.1 Signature Validity

- Digital signatures are legally binding

- Users must not forge signatures

- Signatures must be personally created

8.2 Signature Storage

- Signatures are securely stored

- Used only for authorized documents

- Regular signature verification required

 9. PDF Generation and Documents

9.1 Document Generation

- PDF reports are generated automatically

- Documents are stored securely

- Users can access historical documents

 9.2 Document Retention

- Documents retained according to legal requirements

- Users can request document deletion

- Backup copies maintained for security

 10. Termination

10.1 Account Termination

We may terminate accounts for:

- Terms violation

- False information

- Payment failure

- Misuse of services

- Legal requirements

10.2 Data After Termination

- Account data retained per legal requirements

- Users can request data deletion

- Some data may be retained for legal purposes

11. Intellectual Property

- All app content is protected by copyright

- Users retain rights to their submitted content

- AI-generated content ownership specified

11.2 License Terms

- Limited license to use the App

- No right to modify or redistribute

- License terminates with subscription

 12. Liability and Disclaimers

12.1 Service Availability

- Maintenance windows may affect access

- No liability for service interruptions

12.2 Data Accuracy

- User responsible for data accuracy

- No guarantee of AI interpretation accuracy

- Location data subject to GPS limitations

13. Changes and Updates

- Continued use implies acceptance
