TEXAS STATE PENAL CODES (DEFINITIONS)
The Texas State Penal Codes (Definitions) provide clear explanations of legal terms, classifications, and procedures used within the state’s criminal justice system. These definitions establish the foundation for interpreting laws, enforcing regulations, and ensuring consistency across legal proceedings.

State Driver’s License Information

The State of Texas implements a demerit point system for traffic offenses to determine when a driver’s license may be suspended or revoked. Suspension periods may be extended at the discretion of an officer or by a judge’s order.

Accruing 12 demerit points on a driving record will result in the following penalties:

First Offense: 90-day suspension
Second Offense: 120-day suspension
Third Offense: 360-day suspension
Fourth Offense: License revoked

Following a fourth suspension, the court may issue a permanent revocation of driving privileges, particularly in cases involving criminal traffic violations.

A revoked license may be eligible for reinstatement if the driver successfully completes a state-approved driver rehabilitation program and maintains a clean driving record for a set period.

State of Texas (Definition)

The State of Texas is a U.S. state in the South-Western region of the United States. Spanning 270,596 square miles (approximately 700,879 km²). It is a defined political and geographic entity with its own government, laws, and administrative divisions, responsible for providing public services, maintaining order, and managing natural and economic resources within its borders.

Law Enforcement Officer (Definition)

A Law Enforcement Officer is an individual authorized by the state to enforce laws, maintain public order, prevent and investigate crimes, and protect the safety and rights of citizens. This includes powers such as making arrests, issuing citations, and conducting investigations in accordance with state and local laws.

Citation (Definition)

A citation is a written notice issued by a law enforcement officer under the authority of state statute.

A citation may order an individual to appear in court to answer for a misdemeanor offense.

A citation may also direct an individual to appear and contest an alleged infraction before the court.

Citations may include monetary fines, which must be paid within 30 days as required by the State of Texas .

Citations issued under Sections 2 and 3 must be paid or formally contested before the 30-day deadline. Failure to do so will result in a Failure to Appear (FTA) charge being filed against the defendant.

Infraction (Definition)

An infraction, also known as a petty offense, refers to violations that do not meet the threshold for misdemeanor or felony classification. The State of Texas does not treat infractions as criminal offenses, and they are not entered onto an individual’s criminal record.

Infractions may still result in civil or administrative penalties, including monetary fines and the assessment of demerit points on a driver’s license.

Misdemeanor (Definition)

A misdemeanor is a criminal offense that is less serious than a felony and is recorded on an individual’s criminal history unless later expunged. Penalties are determined by the court and may include community service, fines, or jail time. For traffic-related misdemeanors, license points may also be assessed.

Felony (Definition)

(Classes determined by the District Attorney).

A felony is a serious criminal offense punishable under state law. Felony convictions remain on a person’s criminal record and may only be expunged by order of a state court. Penalties can include fines, community service, license point assessments, imprisonment, probation, parole, or, for the most severe crimes, the death penalty.
Class A Felony
Maximum imprisonment: 5 years.
Class B Felony
Maximum imprisonment: 10 years.
Class C Felony
Maximum imprisonment: 20 years.
Class D Felony
Imprisonment: 20 years or more.
Class E Felony
Maximum penalty: life imprisonment or death, depending on the offense.
