South Kinloss Cemetery Bylaws


DEFINITIONS

1. “Cemetery “shall mean South Kinloss Cemetery and/or the board of officials governing or enforcing the rules and

regulations of the cemetery.

2. “Ministry “shall mean the Ontario government ministry appointed to be responsible for the cemeteries of Ontario.

3. “Owner” is that person in whose name the grave is registered.

GRAVES

A. Graves are sold at the price approved by the ministry at the time of purchase.

B. An amount set by the ministry is set aside for perpetual care and maintenance to be used for the upkeep of the

cemetery.

C. The person purchasing a grave will be issued a certificate giving rights for burial when all costs of the grave have been paid.

D. This certificate will contain the name of the purchaser, address, amount paid for the grave, amount held in trust for

the care and maintenance, range, lot and section number. The certificate must be signed by the treasurer as well as

a witness and contain the seal of the cemetery.

E. The owner of the grave acquires only the right and privilege of burial and to erect a monument on the grave subject

to the rules and regulations of the cemetery.

F. To ensure the correctness of the records, no grave can be transferred or re-sold except through the treasurer of the

cemetery. The person wishing to transfer a grave must produce the original deed or have signed proof that all parties

involved are in agreement.

G. In case of demise, by depositing with the cemetery a copy of the will, or where the grave was not listed in the will, the

cemetery will recognize that person listed as receiving the residue of the estate, or that person designated in a

signed agreement to execute the affairs, that person will be recognized as the owner.

H. If several people are involved in an estate, they must all sign off that they do not wish to use that grave and as to who

may have it.

I. The cemetery has the right to revise or update the rules and regulations subject to the approval of the registrar.

J. A fee may be charged for transferring a grave.

K. The Cemetery Board will allow the following burials per grave:

a casket and three urns only if the casket is buried first or four urns if no casket is buried.


INTERMENTS AND DISINTERMENTS

A. No grave may be used for any purpose other than for the burial of human bodies.

B. A cemetery official will be in attendance at each interment and the burial permit or cremation certificate must be delivered to him/her or the treasurer of the cemetery before burial can take place.

C. If the burial is for someone other than the owner of the grave, a written and signed consent by other members of the family must be obtained.

D. The person ordering the burial will be held responsible for the charges incurred.

E. The increasing use of larger caskets and vaults does not permit the cemetery to assume the responsibility for the number of grave openings that may be made in any lot.

F. No interments shall be allowed in the lot where charges are due and unpaid.

G. Disinterments must be under the regulations of the Ontario Department of Health. Written permission must be obtained from the local medical officer, and from the owner of the grave.

H. No disinterment can take place of a person who has died of a communicable disease unless ordered by authorities of the law or corner.

I. All graves must be dug by the caretaker or that person designated by him or the cemetery officials.

J. Instructions for burial should be in writing as the cemetery cannot be held responsible for any errors resulting in wrongful information given over the phone.

K. The discharging of fire arms for military services are permitted.

L. Music such as bagpipes, bugles or other instruments for the service are allowed.

M. The scattering of cremation remains is prohibited.

N. No interment can take place without the permission of the grave owner.

O. The cemetery reserves the right to open or close the cemetery, when in the spring or fall, weather conditions are not

favourable for burials.

P. The use of a vault is recommended when burying wood caskets.

CARE OF GRAVES

A. No planting, disturbing or altering of the cemetery grounds is allowed without the permission of the caretaker or the treasurer of the cemetery.

B. The cemetery does not allow glass, tin, wire or any material that could cause injuries to the caretaker or visitors.

C. The cemetery has the right to remove any dead, faded or dirty flowers.

D. The cemetery has the right to remove any shrub that interferes with the maintenance of the cemetery.

E. The perpetual care fund covers the cutting of the grass and keeping the grave reasonably level. It does not cover the cleaning of monuments or care of flowers and shrubs; these are the responsibility of the grave owner.

F. The cemetery is not responsible for any damage done to flowers, pots or shrubs while maintaining the grounds.


VISITORS

A. Visitors must at all times respect the atmosphere of the cemetery.

B. No dogs or other animals, snowmobiles, motorcycles, ATVs, firearms, or other parties that are disrespectful will be allowed in the cemetery.

C. Children must be accompanied by an adult who is responsible for their conduct.

D. Any persons disturbing the peace of the cemetery will be expelled from the grounds.

E. All vehicles must remain on the driveway.

F. The cemetery is open from May 1st until November 1st. The cemetery does not bury in the winter but does not restrict people from walking in if weather conditions permit.

MONUMENTS

A. All monuments must be made of granite, marble or bronze.

B. All monuments must be in accordance with the rules and regulations of the cemetery.

C. All monuments must be on a cement base to prevent them from sinking or tipping.

D. All flat markers must be placed on ground level.

E. No monument will be allowed in the cemetery that is not in keeping with the dignity of the cemetery.

F. If the monument is considered unsafe, the cemetery has the right to either repair it or lay it down.

G. All contractors working in the cemetery must respect the atmosphere of the cemetery, clean up the grounds when

they are finished and they must cease work when a funeral is in progress.

H. No monument is allowed to be put into a cemetery until all fees are paid on the graves.

I. Any monument or other objects placed on a grave without the permission of the cemetery may be removed.

J. On single graves where a monument is to be erected, the monument width must not exceed 30” with a 36” base.

K. The cemetery is not responsible for damage to monuments.

L. Monuments will be resealed and bases will be repaired at the discretion of the Cemetery Board.
