Somo AI ("we," "us," or "our") provides a mobile application that enables users to create, generate, and transform images and videos using artificial intelligence technologies. This User Agreement ("Agreement") governs your access to and use of the Somo AI application and related services (collectively, the "Service").
By accessing or using our Service, including as a visitor without registering an account, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree with any part of this Agreement, you must immediately cease using our Service.
We reserve the right to modify this Agreement at any time. We will provide notice of significant changes through the Service or via other communications. Your continued use of the Service after such changes constitutes your acceptance of the modified terms.
Somo AI provides an AI-powered platform where users can:
Upload images and videos to apply AI-generated effects and transformations
Generate new visual content using AI technologies
Access various features through in-app purchases and subscriptions
The Service is available to registered users and visitors ("Guest Users"). Guest Users can access most features but may have limited access to certain functionalities without registration.
To access certain features of the Service, you may need to register for an account. You agree to maintain the security of your password and accept all risks of unauthorized access. Notify us immediately if you discover or suspect any security breaches related to the Service
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to this Agreement on your behalf.
Somo AI offers various purchase options. Payment Terms:
All purchases are processed through the respective app store (Apple App Store or Google Play Store)
Payment will be charged to your app store account at confirmation of purchase
You authorize us to charge all applicable fees to your payment method
All fees are non-refundable except as required by law or as otherwise stated in our refund policy
Somo AI offers optional subscription plans that provide benefits such as:
Regular access to premium features and effects
Enhanced generation capabilities
Priority processing for AI generations
Payment: Subscription fees are billed in advance for the chosen period (monthly or annually)
Automatic Renewal: Unless turned off at least 24 hours before the end of the current period, your subscription will automatically renew for the same price and duration
Cancellation: You can manage or cancel your subscription at any time through your device's app store settings
Price Changes: We reserve the right to change subscription fees with prior notice to you. Continued use after price change constitutes your acceptance of the new pricing
You retain ownership of the content you upload to Somo AI. By using our Service, you:
Grant us a license to process your content solely for providing the Service
Represent that you have all necessary rights to any content you upload
Acknowledge that AI-generated content may be influenced by training data and algorithms beyond our control
You agree not to upload content that:
Infringes on any third party's intellectual property rights
Contains illegal, pornographic, defamatory, or otherwise objectionable material
Violates any applicable laws or regulations
You acknowledge that Somo AI uses artificial intelligence to generate and transform content. As required by emerging regulations and best practices:
We will make reasonable efforts to identify AI-generated content when technically feasible
You agree not to represent AI-generated content as human-created when required to disclose such information
We may add metadata or other indicators to identify content generated using our Service
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you agree to our collection and use of your information as described in the Privacy Policy.
We implement appropriate technical and organizational measures to protect your data. However, no system can be completely secure, and we cannot guarantee the absolute security of your information.
The Somo AI Service, including all content, visuals, designs, and algorithms, is protected by intellectual property laws. You may not:
Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or attempt to extract source code
Remove any copyright, trademark, or other proprietary notices
Use the Service to create competing products or services
We may suspend or terminate your access to the Service at any time if you violate this Agreement. You may also terminate your account at any time by contacting us or through the app settings.
Upon termination:
Your right to use the Service immediately ceases
Any unused purchases or subscription benefits will be forfeited without refund
Provisions of this Agreement that should reasonably survive termination will remain in effect
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
This Agreement shall be governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the American Arbitration Association's commercial arbitration rules.
