Welcome to Smart Eat | Food (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our mobile application and associated services (collectively, the “App”). By downloading, accessing, or using Smart Eat | Food, you agree to these Terms.

If you do not agree with these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet these requirements.

2. Use of the App

Smart Eat | Food provides users with:

Food scanning via photo to identify products and provide nutritional analysis (e.g., Nutri-Score, UPF)
Manual product entry and saved product lists
Personalized food insights
Recipe generation based on user inputs

You agree to use the App only for personal, non-commercial purposes and in compliance with all applicable laws and regulations.

3. User Accounts

Some features may require account creation. You agree to:

Provide accurate and complete information
Keep your login credentials secure
Notify us immediately of unauthorized use

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. User Content

You may submit or upload information (e.g., food photos, ingredient lists) to the App. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze it to provide and improve our services.

You agree that your content will not:

Infringe on third-party rights
Contain false, misleading, or harmful information
Include any malicious code or viruses

5. Intellectual Property

All content, features, and functionality in the App—including text, graphics, algorithms, logos, and design—are the exclusive property of Smart Eat | Food or its licensors and are protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, reverse-engineer, or otherwise exploit any part of the App without our written consent.

6. Disclaimers

No Medical Advice: The App provides general nutritional information and recommendations. It is not a substitute for professional medical, dietary, or nutritional advice. Always consult a qualified healthcare provider for specific health concerns.
Data Accuracy: While we strive to provide accurate information, we do not guarantee the completeness or accuracy of data, including Nutri-Scores or UPF classifications.
Service Availability: We do not guarantee uninterrupted or error-free operation of the App.

7. Limitation of Liability

To the fullest extent permitted by law, Smart Eat | Food and its affiliates will not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities
Any personal injury or health outcome resulting from reliance on the App’s content

Our total liability for any claim arising out of the use of the App will not exceed the amount paid by you (if any) in the 12 months prior to the claim.

8. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in harmful behavior. You may also stop using the App at any time.

9. Modifications to Terms

We reserve the right to update or change these Terms at any time. We will notify you via in-app notice or email. Your continued use of the App after such updates constitutes your acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of Latvia. Any legal action or proceeding will take place in the courts of Latvia.
