Sleepy is an app developed by Inspiration Apps Ltd.

By downloading or using the Application, or using the Services, you agree to all of the terms and conditions contained herein, and you agree to comply with and be bound by any applicable third party licenses and conditions when using the Application. These terms and conditions that govern the resolution of claims you may have; disclaimer of special warranties; automatic refund of subscription; and special limitations of our responsibility. If you do not agree to all terms and conditions herein, stop using the Services and the Application, and immediately remove the Application from your device.

1. Service

- You agree not to send pornography, violent, bloody, offensive, copyright infringing, illegal or other inappropriate content. What constitutes the above content will be determined solely at the discretion of the Sleep developers.

- By using this application, you accept this agreement and privacy policy.

- You may not use information obtained from our app or users in an illegal or malicious manner.

- You may not restrict or attempt to restrict the rights of other users to use our service. You may not encourage or assist other users using this application in a way that is contrary to the terms of this agreement.

- If Sleep determines that the user intentionally or unintentionally uses this application in violation of the Terms of Service, Sleep has the right to stop serving this user and, if necessary, take legal actions to protect the rights of Sleep and its users;

- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application and/or Services or use them for any commercial purpose;

- Copy (except as expressly permitted by this license and Apple's Terms of Use), decompile, reverse engineer, disassemble, attempt to derive source code from, modify, or create derivative works of the Licensed Applications and/or Services, any updates, or any portion thereof (except and only to the extent that any such restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing the Licensed Applications and/or Services). Any attempt to do so is a violation of the rights of the Application Provider and its licensors, if any.

2. Eligibility

The Application and the Services are intended for users over the age of 18. You may access and use the Licensed Applications, the Services and the Site only if you are 18 years of age or older.

3. Limited Warranty

Sleep does not represent or warrant that the app will operate without interruption or will be error free. Especially in the following cases:

1. modification or alteration of the app made without the prior written approval of Sleep,

2. accident, neglect, misuse or abuse, or

3. exposure to conditions outside the range of the environmental, power and operating specifications provided by Sleep.

4. Privacy and Security

We care about the privacy of our Users. You understand that by using the Services you consent to the collection, use and disclosure of your personally identifiable information and aggregate data as set forth in our Privacy Policy, and to have your personally identifiable information collected, used, transferred to and processed in the United States. 

We care about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.

5. Our Liability

To the fullest extent permissible by law, We exclude all representations, warranties, and guarantees (whether express or implied) that may apply to Our App or any Content (including User Content) included in Our App.

We exercise all reasonable skill and care to ensure that Our App is free from viruses and other malware. We accept no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material that may adversely affect your hardware, software, data or other material that occurs as a result of your use of Our App (including the downloading of any Content (including User Content) from it) or any other website or service that We may provide a link to.

We neither assume nor accept responsibility or liability arising out of any disruption or non-availability of Our App resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, natural events, acts of war, or legal restrictions and censorship.

The Services are for informational purposes only, are not for advice and should not be treated as such, and the information without the Services is provided without any representations or warranties, express or implied, and without limiting the generality of the foregoing, we do not warrant or represent that the Content will be constantly available, or available at all, true, accurate, complete, current or non-misleading.

This Terms of Service is subject to change at any time. Notices of any changes will be considered given and effective on the date posted on our app. The changes made will become effective the date they are posted. No further notice by Sleep is required upon your continued use of our app or software.
