1. ACCEPTANCE
By creating an account, accessing, or using SkyGain (the “App”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy.
If you do not agree to these Terms or the Privacy Policy, do not use the App.
2. THE SERVICE
SkyGain is a fitness and workout-tracking application.
The App may allow you to:
- create and manage an account;
- log workouts, cardio activity, goals, progress, streaks, XP, levels, and related fitness activity;
- use social features such as friends, blocked-user relationships, and groups;
- receive service-related and activity-related notifications;
- generate optional shareable workout summary images based on your activity data and share them using your device’s available sharing options.
We may modify, improve, suspend, or discontinue any part of the App at any time, to the extent permitted by applicable law.
3. ACCOUNT REGISTRATION AND SECURITY
To use certain features, you must create an account.
When registering, you may be required to provide an email address, choose a nickname, and create a password.
You are responsible for:
- providing accurate account information;
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account.
You may log in using your email address or your nickname, together with your password.
Your email address may be used for account creation, authentication, password recovery, and other essential account- or security-related communications.
If you forget your password, you may request a password reset. We may send a verification code or similar security message to your email address to help verify your identity and restore access to your account.
You must not:
- share your account with another person;
- impersonate another person;
- use a nickname that is misleading, unlawful, offensive, or infringes the rights of others;
- attempt to gain unauthorized access to another account or to the App.
4. USER CONTENT
You may submit or create content in the App, including your nickname, motivation notes, group names, group descriptions, workout logs, and other content you provide through the App (“User Content”).
You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, and display your User Content solely as necessary to operate, maintain, secure, and improve the App and its features.
This includes, for example:
- displaying your nickname, avatar, character, level, XP, streak, and certain activity-related information in social features;
- processing workout and activity logs to calculate statistics, records, streaks, XP, and progress;
- operating group and friend features;
- generating optional shareable workout summary images based on your activity data when you choose to use that feature.
You are solely responsible for the User Content you submit and for ensuring that it does not violate any law or any third-party rights.
You must not submit content that:
- is unlawful, abusive, threatening, hateful, discriminatory, defamatory, obscene, or otherwise objectionable;
- infringes intellectual property, privacy, publicity, or other rights;
- contains malicious code, spam, scams, or deceptive content;
- is intended to harass or harm other users.
We may remove content, restrict features, or suspend accounts if we reasonably believe User Content or user behavior violates these Terms or creates risk for the App or other users.
5. SOCIAL FEATURES
The App may include social features such as friends, blocked-user relationships, groups, and related notifications.
By using social features, you understand that certain account and activity information may be visible to other users where relevant to those features, such as your nickname, avatar, character, level, XP, streak, and certain group-related activity statistics.
You are responsible for how you interact with other users through the App.
We do not guarantee that any social feature, friend connection, group, or user interaction will remain available, uninterrupted, or error-free.
6. NOTIFICATIONS AND COMMUNICATIONS
The App may send you service-related communications and notifications in connection with your account and use of the App.
These may include, for example:
- password reset or account security messages;
- friend request notifications;
- notifications when you are added to a group;
- daily goal reminders;
- streak reminders;
- other operational or feature-related notifications.
Push notifications may be delivered to your device if you enable them.
You can manage certain notifications in the App and/or through your device settings.
You acknowledge that notification delivery may depend on third-party services, device settings, network availability, operating system permissions, and other factors outside our control. We do not guarantee that notifications will always be delivered, timely, or error-free.
7. ACCEPTABLE USE
You agree not to:
- use the App for unlawful, fraudulent, or unauthorized purposes;
- harass, threaten, bully, abuse, or impersonate others;
- submit unlawful, hateful, offensive, or misleading content, nicknames, group names, or group descriptions;
- attempt to hack, probe, disrupt, overload, reverse engineer, or interfere with the App, its infrastructure, or other users’ accounts, except as permitted by applicable law;
- use automated means to scrape, harvest, or access the App in an unauthorized way;
- upload malicious code or attempt to bypass security measures;
- misuse password reset, friend, group, or notification features.
We may investigate suspected violations and take appropriate action, including removing content, restricting functionality, suspending accounts, blocking access, or reporting conduct where required or appropriate.
8. HEALTH DISCLAIMER
SkyGain provides fitness and wellness information for general educational and informational purposes only.
The App does not provide medical advice, diagnosis, or treatment.
You should consult a qualified physician or other healthcare professional before beginning or changing an exercise program, especially if you have an injury, medical condition, or other health concern.
You use the App and perform exercises at your own risk.
You are solely responsible for your physical activity, workout decisions, and health-related choices.
9. ACCOUNT DELETION AND TERMINATION
You may stop using the App at any time.
You may request deletion of your account through available in-app functionality or by contacting us as described in our Privacy Policy.
We may suspend, restrict, or terminate your access to the App if:
- you violate these Terms;
- we reasonably believe your use creates risk, harm, legal exposure, or security issues for us, the App, or other users;
- it is necessary to protect the security, integrity, or operation of the App;
- we are required to do so by law.
Termination or deletion of an account does not affect any rights or obligations that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, and dispute-related matters.
10. PRIVACY
Our collection and use of personal data are described in our Privacy Policy.
By using the App, you acknowledge that your personal data may be processed in accordance with the Privacy Policy.
11. INTELLECTUAL PROPERTY
The App, including its software, design, visual elements, branding, text, graphics, icons, features, and other content provided by us, is owned by us or our licensors and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or by applicable law, you may not copy, modify, distribute, sell, license, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of the App.
SkyGain and related names, logos, and branding may not be used without prior written permission, except as permitted by law.
12. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.
We do not warrant that the App will be uninterrupted, secure, accurate, complete, error-free, or always available, or that defects will always be corrected.
We do not guarantee that workout calculations, progress statistics, streaks, XP, rankings, notifications, or social features will always be accurate or available without interruption.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of, or inability to use, the App.
To the fullest extent permitted by applicable law, we are also not liable for injuries, losses, or damages arising from workouts, exercises, training activity, or reliance on information or features provided through the App.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. CHANGES TO THE APP OR THESE TERMS
We may update the App and these Terms from time to time.
If we make material changes to these Terms, we may provide notice in the App or by other reasonable means. The updated Terms will include a new effective date.
Your continued use of the App after the effective date of the updated Terms means you accept the updated Terms.
15. GOVERNING LAW
These Terms are governed by the laws of Poland, without regard to conflict of law principles, unless mandatory laws of your country of residence require otherwise.
