The following terms and conditions apply to the use of Google Workspace for Education after registration in the relationship between the "User" and the Skill-Bridge Alliance.

The subject matter of the contract is the use of Google Workspace for Education after registration as an information, communication and learning platform ("Service"). These fee-based distance learning courses are governed exclusively by the General Terms and Conditions (GTC).

The use of Google Workspace for Education is subject to prior registration. When registering, the user must provide truthful information and comply with the privacy policy. After registration, the user will receive an email with a confirmation link. Once the user account has been activated by the Skill Bridge Alliance, the use/participation agreement becomes effective.

The user may not allow third parties to use his/her Google Workspace for Education account and, as the account owner, is responsible for protecting the account from misuse. For this reason, the user is required to keep his or her account information confidential and secure from access by third parties. The use of trademarked names or names of other individuals or entities as user names is not permitted.

The Skill-Bridge Alliance allows the user to read and publish contributions to the information, communication and learning platform of Google Workspace for Education with other users within the framework of these Terms of Use. For this purpose, the Skill-Bridge Alliance provides the user with a platform with various community functions within the scope of its technical and economic possibilities.

The purpose of the community functions is to enable a topic and subject-related exchange about the educational and cultural offerings of the Skill-Bridge-Alliance. The Skill Bridge Alliance uses the platform (Google Workspace for Education) within the scope of the tasks assigned to it. The platform is not intended for the general exchange of opinions, for self-promotion by users, or for entertainment purposes.

Alphabet Inc. may make changes to the digital product (Google Workspace for Education) at any time that are necessary to maintain compliance with the contract.

- Reasons would be, for example, changes necessary to adapt the digital product to a new technical environment or to a larger number of users, or if it is necessary for other important operational reasons.

- If the change significantly impairs the user's ability to access the community functions or their usability for the user, the Skill Bridge Alliance will inform the user of the change and the user's rights by e-mail within a reasonable period of time before the change comes into effect.

- Etc.

The user undertakes to provide true, current and complete information about himself/herself at all times when registering, as specified in the registration form, and not to mislead the Skill-Bridge-Alliance or other users about his/her identity at any time.

By publishing content via Google Workspace for Education, the user warrants that he/she is the owner of all necessary rights. The user agrees not to publish or send to other users any content on the information, communication, and learning platform that violates common decency or applicable law. In particular, the user undertakes not to publish or send to other users any contributions...

- the publication of which constitutes a criminal or administrative offence

violate copyright, trademark or competition laws

- which violate the privacy rights of others (e.g. the publication of private messages without the consent of the sender)

- contains offensive, untrue, racist, discriminatory, harmful to minors or pornographic content

- contain advertising, graphics or links with or without text in a signature or within a message.

- Users are also obliged to observe good manners ("netiquette") at all times and to treat each other with respect. They may not use the service to threaten, harass, or otherwise harm other users or third parties, or to deceive or harm their reputation or business.

It is also not permitted to publish contributions that are not related to the topics to which the respective area of a community is expressly dedicated or that otherwise aim to impair the topic-related and professional exchange (section 3). This includes in particular the mass publication of empty contributions or contributions with the same content ("spamming").

If a user observes a violation of these terms of use by other users, he/she is obliged to inform the administrators by sending an e-mail to "report@skillbridgealliance.com".

In the event of a violation or reasonable suspicion of a violation of the obligations set forth in Section 4 (with the exception of the obligation to report violations by other users), the Skill Bridge Alliance may, at its sole discretion, impose the following sanctions on the user

- Deletion or modification of content posted by the User if, in the sole discretion of the Skill Bridge Alliance, such content constitutes a violation of the Rules of Conduct set forth in Section 4,

- Issue a warning,

- Limit the use of the Service,

- temporary or permanent suspension of access,

- termination of the user agreement and deletion of all data and content of the user, also without notice and without prior contact.

- If a published contribution violates section 4, the Skill-Bridge-Alliance may block the contribution without prior notice. The Skill-Bridge-Alliance will inform the user so that he/she can react. If it turns out that the post does not violate section 4, the Skill-Bridge-Alliance will unblock the post.

Only in the case of intentional, systematic or similarly serious violations will the Skill Bridge Alliance block the user's access without prior warning. Otherwise, access will only be permanently blocked if the user violates a rule of conduct again after receiving a warning.

Furthermore, the suspension is only temporary and the Skill Bridge Alliance will give the user the opportunity to respond within a reasonable period of time. The Skill Bridge Alliance will only decide whether to permanently block access based on the response or after the period has expired.

The user shall indemnify the Skill-Bridge-Alliance against all claims asserted by third parties based on a culpable breach by the user of the obligations set forth in Section 4 (with the exception of the obligation to report violations by other users). The user undertakes to support the Skill-Bridge-Alliance in good faith in the defense of such claims by providing information and documents. The user is also obliged to bear the costs of the necessary legal defense of the Skill-Bridge-Alliance. Further rights and claims for damages of the Skill-Bridge-Alliance shall remain unaffected.

The copyright of the submitted contributions, as far as they are copyrightable, remains with the respective user. However, by posting a submission to the Google Workspace for Education information, communication and learning platform, the user grants the Skill Bridge Alliance the non-exclusive, worldwide, perpetual right to use the submission for the following purposes

- Permanent public availability on the Google Workspace for Education information, communication and learning platform (including in translation),

- Reproduction and distribution in print (including in translation),

- Moving within the Google Workspace for Education information, communication and learning platform and linking to other content,

- Editing, in particular shortening, translating, moving within the information, communication and learning platform Google Workspace for Education and/or combining with other content, also outside the information, communication and learning platform Google Workspace for Education,

- Modification or partial deletion, if required pursuant to Section 5.

- The user shall not be entitled to demand the deletion or correction of his or her contributions. The provisions of the General Data Protection Regulation (Regulation EU 2016/679), the Copyright Act and any legal obligation of the user to delete shall remain unaffected.

If a digital product is defective, there are warranty claims. Claims due to defects in the service in accordance with § 1 become statute-barred within two years from the time of provision, at the earliest, however, one year after the end of the contract term.

Claims for damages by the user against the Skill-Bridge-Alliance, its organs, employees and vicarious agents are excluded, unless otherwise specified below. Claims for damages arising from a guarantee or assurance given by Skill-Bridge-Alliance, from injury to life, limb or health, on the basis of the Product Liability Act and claims for damages arising from the breach of essential contractual obligations are excluded. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. Also excluded from the exclusion of liability is the liability for damages resulting from an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.

This contract is concluded for an indefinite period of time and can be terminated by either party in writing (e.g. by e-mail) without giving reasons with a notice period of 3 months, but at the earliest 7 days before the end of the current month.

After termination of this contract, the Skill-Bridge-Alliance is entitled, but not obliged, to delete the content created by the user and shared with other users. The user may, however, request the deletion of the user account and the non-public data stored therein at any time.

In the event of good cause, in particular in the event of a serious or repeated breach of the obligations set out in Section 4, the Skill-Bridge-Alliance is entitled to block the User's access immediately and to terminate the contract with the above-mentioned period of notice. In this case, the User concerned may only re-register with the prior written consent of the Skill-Bridge-Alliance.

The Skill-Bridge-Alliance reserves the right to amend these Terms of Use without giving reasons. The Skill-Bridge-Alliance will notify the user of the changes in a timely manner upon the user's next visit to the site following the change and request the user's consent to the amended Terms of Use. If the user does not disagree within a reasonable period of time of at least 14 days, the terms of use are deemed to be accepted. When notifying the user of the change to the Terms of Use, the Skill Bridge Alliance will expressly point out that the change is deemed to have been accepted if the user does not object within the specified period. If the user objects, the Skill-Bridge-Alliance may terminate the contract in accordance with section 8.

The contractual relationship between the Skill-Bridge-Alliance and the User shall be governed by the laws of the Federal Republic of Germany. In the case of consumers, this choice of law shall only apply to the extent that the protection provided by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn.
