Please read these Terms of Use carefully before using SipShelf: Wine & Whiskey
By using the Service on any computer, mobile phone, tablet, or other device (collectively, the “Device”), you, as a user of the Service, confirm that you have read, understand, and agree to be bound by these Terms of Use and any other applicable law.
XSoft (“We,” “Us,” or “Our”) may change these Terms of Use at any time without notice, effective upon their posting in the App. Your continued use of the Service after such changes are posted constitutes your acceptance of the revised Terms of Use. If you do not agree to these Terms of Use, please do not use the Service.
You may use the Service only if you are of legal drinking age where you live, and in any case at least 18 years old. In the United States, you must be at least 21.
The Service contains content about alcoholic beverages. By using it, you confirm that you meet this age requirement. If you do not, you must stop using the Service and delete the App.
You are responsible for making sure that your use of the Service complies with the laws that apply to you.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Devices you own or control. This license is for your personal, non-commercial use only, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
You may not:
rent, lease, lend, sell, redistribute, or sublicense the App;
make the App available over a network where it could be used by multiple devices at the same time;
copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App or any part of it, except where applicable law does not allow this restriction;
remove, hide, or alter any copyright, trademark, or other proprietary notices.
Any updates or upgrades we provide are covered by these Terms unless they come with separate terms. Any attempt to do what this section prohibits violates our rights and may lead to legal action.
The Service belongs to us or our licensors. This includes the software, code, design, interface, graphics, icons, text, and the SipShelf name and logo. They are protected by copyright, trademark, and other laws. All rights not expressly granted in these Terms are reserved.
Wine and whiskey names, bottle labels, producer names, brand names, and logos shown in the Service belong to their respective owners. They appear only to identify products. Their appearance does not mean that any winery, distillery, producer, retailer, or brand owner sponsors, endorses, or is affiliated with SipShelf or XSoft.
If you believe any content in the Service infringes your rights, contact us at [support email] with enough detail for us to review your claim.
You own the content you add to the Service, such as bottles, collection records, purchase details, tasting notes, ratings, and photos ("Your Content"). We do not claim ownership of Your Content.
You allow us to store, process, and display Your Content only as needed to provide the Service to you. For example, this lets us show your collection, sync it across your Devices, and create exports you request. This permission ends when you delete Your Content from the Service.
You are responsible for Your Content. You confirm that you have the right to use it and that it does not violate the law or anyone else's rights.
Backups. You are responsible for keeping backups of Your Content. Deleting the App, changing Devices, signing out of your Apple Account, or turning off iCloud may cause data loss.
Exports. When the Service lets you export your collection, the file is generated from the data available in the App. Please review it for accuracy and completeness before relying on it or sharing it.
Our Privacy Policy explains how we collect, use, store, and protect your information. It is available at [Privacy Policy URL] and inside the App. Please read it carefully.
Some features may ask for access to information or functions on your Device, such as:
Camera, to scan or photograph bottle labels;
Photo Library, to add bottle photos to your collection;
iCloud, to back up and sync your collection across your Devices;
Notifications, to send reminders you choose to turn on.
We access these only with your permission. You can change permissions at any time in your Device settings. Some features may not work without the related permission.
SipShelf: Wine & Whiskey is free to download, with optional paid features available through Apple in-app purchase. Paid options may include:
an auto-renewable subscription, such as a monthly or yearly plan;
a one-time purchase that unlocks premium features ("Lifetime").
The price, billing period, and features included in each option are shown in the App before you buy. Prices may vary by country or region and may change over time.
Payment is charged to your Apple Account when you confirm the purchase.
Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
Your Apple Account will be charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription in your Apple Account settings on your Device.
If you cancel, you keep access to paid features until the end of the current billing period.
If a free trial is offered, it converts to a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
"Lifetime" means for as long as we continue to offer and support the App. It does not refer to your lifetime.
All payments are processed by Apple. We cannot issue refunds directly. You may request a refund from Apple under Apple's refund policies.
To restore purchases on a new or reset Device, sign in with the same Apple Account and tap "Restore Purchases" in the App.
All purchases are also subject to the Apple Media Services Terms and Conditions.
You agree to use the Service only for lawful purposes and in line with these Terms. You may not:
use the Service in any way that is unlawful, fraudulent, defamatory, threatening, abusive, or obscene;
use the Service to sell or supply alcohol unlawfully, or to provide alcohol to anyone under the legal drinking age;
infringe or violate the intellectual property, privacy, publicity, or other rights of anyone else;
attempt to gain unauthorized access to the Service, its systems, or its data;
interfere with or disrupt the operation or security of the Service;
introduce viruses, malware, or other harmful code;
use bots, scrapers, or other automated means to access or extract data from the Service;
copy, distribute, sell, or otherwise exploit the Service except as these Terms or applicable law allow;
transfer or assign your rights or obligations under these Terms to anyone else.
SipShelf is a personal tool for organizing your wine and whiskey collection. It does not sell alcohol and does not provide professional advice.
Product information. Details such as producer, vintage, region, age statement, ABV, tasting notes, and ratings may come from you, label scans, or third-party sources. We do not guarantee that this information is accurate, complete, or current. Always check the bottle label or the producer for ingredient, allergen, and alcohol content information.
Value and price estimates. Any prices, market values, or collection totals shown in the Service are estimates for your personal reference only. They are not appraisals and are not financial, investment, insurance, or tax advice. Do not rely on them to buy, sell, insure, or value bottles. Consult a qualified appraiser or professional instead.
Drinking windows and storage tips. Any suggestions about when to drink or how to store a bottle are general guidance. A bottle's actual condition depends on its storage, provenance, and other factors.
Third-party links. The Service may link to third-party websites or retailers for convenience. We do not control them and are not responsible for their content, products, or practices. Any purchase you make from them is between you and that third party.
Responsible drinking. The Service does not encourage excessive or irresponsible drinking. Please drink responsibly and follow the laws where you are. Never drink and drive. If you are pregnant, taking medication, or have concerns about your health, talk with a healthcare professional about alcohol use.
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
the Service will be available, uninterrupted, secure, or error-free;
errors will be corrected;
label scans, product details, ratings, or value estimates will be accurate, complete, or current;
Your Content will never be lost or damaged.
You use the Service at your own risk. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. Nothing in these Terms limits consumer rights that cannot be limited under applicable law.
To the maximum extent permitted by law, XSoft and its officers, employees, agents, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes loss of profits, data, collection records, or goodwill, arising from or related to:
your use of, or inability to use, the Service;
your reliance on any information, estimate, or suggestion in the Service;
unauthorized access to or loss of Your Content;
any third-party content, website, or product.
To the maximum extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of (a) the amount you paid for the Service in the 12 months before the claim arose, or (b) USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence.
You agree to defend, indemnify, and hold harmless XSoft and its officers, directors, employees, agents, licensors, suppliers, affiliates, successors, and assigns from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from:
your breach of these Terms;
your misuse of the Service;
your violation of any law or regulation;
your violation of the rights of any third party.
We may take over the exclusive defense and control of any matter subject to indemnity by you. In that case, you agree to cooperate fully with our defense.
These Terms remain in effect until terminated by you or us. You may terminate them at any time by stopping all use of the Service and deleting the App.
Deleting the App does not cancel an active subscription. To stop future charges, cancel your subscription in your Apple Account settings.
We may suspend or end your access to all or part of the Service if you violate these Terms, or where required by law. When these Terms end, your license ends, and you must stop using the Service and delete the App.
Sections 3, 4, 5, and 8 through 16, and any other terms that by their nature should survive, will survive termination.
We may update, change, or discontinue features of the Service at any time.
We may update these Terms from time to time. We will post the updated Terms in the App or on our website and change the effective date above. For material changes, we will give reasonable notice, such as an in-app message. If you continue to use the Service after the changes take effect, you accept the updated Terms.
These terms apply because you downloaded the App from the Apple App Store:
Parties. These Terms are between you and XSoft only, not Apple Inc. ("Apple"). XSoft, not Apple, is solely responsible for the App and its content.
Maintenance and support. XSoft is solely responsible for any maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Product claims. XSoft, not Apple, is responsible for any claims relating to the App or your use of it. This includes product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
Intellectual property claims. If a third party claims that the App or your use of it infringes their intellectual property rights, XSoft, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.

Third-party terms. You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.

These Terms are governed by the laws of [country / state], without regard to conflict-of-law rules. Any dispute will be resolved in the courts of [city, country], unless the consumer laws where you live give you the right to bring a claim in your local courts.
Before starting any formal claim, please contact us at [support email]. We will try in good faith to resolve the issue informally within 30 days.
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service. They replace any earlier agreements on the same subject.
Severability. If a court finds any part of these Terms unenforceable, that part will be changed or removed only as much as needed, and the rest will remain in full effect.
No waiver. If we do not enforce any part of these Terms, that does not waive our right to enforce it later.
Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger, acquisition, or sale of assets.
Language. If these Terms are translated, the English version controls if there is any conflict.
