Evidence Supporting Filing a Complaint Against Hymer, NA

Summary for Attorney General

Erwin Hymer Group North America, Inc., 25 Reuter Drive Cambridge, Ontario N3E 1A9, has for years delivered Aktiv recreational vehicle (RVs) that can lead to electrocution and explosion injuries to US and Canadian citizens. We are pleading prosecutors to use this document to prosecute Hymer, NA for fraud by falsely certifying compliance to national safety codes and misleading owners with claims of safety. Corporate malfeasance in the apparent cover up should be investigated.

The Aktiv is one Hymer RV model. Starting January 2018 Hymer, NA was emailed detailed written technical evidence of the growing list of Aktiv's serious plumbing and electrical hazards. As of December 12, 2018, Hymer has not taken demonstrative corrective action against the electrical defects that can lead to electrocution of occupants, owners and/or technicians. Neither has Hymer mailed recall notices to owners of Aktivs built with a serious plumbing safety violation. On the contrary, starting May 2018 Hymer, NA started a campaign misleading owners and discrediting private attempts to notify the public of these hazards. Hymer, NA or its agents:

• publicly misled the public through dissembled safety claims
• certified Aktiv compliance to NFPA-1192 when non-compliance was known
• did not warn owners and buyers that most Aktivs were and still are still being shipped without NFPA-1192 compliance.
• threaten owners who publicly warn of the Aktivs hazards with financial ruin
• called and told customers who had the electrical hazard corrected their warranty was voided
• used the Internet to attack the reputation and personality of private individuals

The Recreational Vehicle Industry Association (RVIA) and Hymer GmbH have been aware of these claims and have not affected change on Hymer, NA's fielded product safety or stopped Hymer, NA's intimidation tactics.

Every Aktiv bears a label certifying compliance to National Fire Protection Association (NFPA) safety standard NFPA-1192. All Aktivs are non-compliant. Many of the same electrical hazards are also present in Simplicity SRT, Simplicity, Zion SRT, Zion, E-trek, RS Adventurous, CS Adventurous, SS Agile, 210 Popular, and 190 Popular models. Thousands of people are unnecessarily being put at risk of injury or death.

It is time for Attorneys General and other state, province and federal law enforcement authorities to take action that brings Hymer, NA to heel, and reforms this self-regulated industry to assure owners their RVs are safe.
