Sharky Makes’s Terms of Service for Commissioned and purchased Fursuits:
*When you commission me, you automatically acknowledge that you have both read and understood the following Terms of Service, and that you accept and agree to follow them. Exceptions will only be made if discussed prior to paying for the commissioned piece.
Payment:
I currently only accept payment through Paypal. I require the non-refundable material cost to be paid upfront, and the remainder of the cost to be paid off within the agreed timeframe. The fursuit will not be shipped until the entire cost has been paid completely.
Shipping:
I only ship to the United States, so please be aware of that. Shipping is not covered in the base price, so please be prepared to pay for shipping through USPS, UPS, FedEx (I will usually quote you for the cheapest shipping option availible. If you have a preffered company please let me know because this will effect the price which you are still obligated to pay). I am not responsible for any damage/loss caused by the shipping company or theft of the package., though I will do everything I can to make things right should this occur. If you're local and wish to pick up the fursuit in person instead of having it shipped, we can definitely work that out too!
Process:
Throughout the making process, I will work with you by utilizing work in progress photos and will regularly communicate what part I'm working on. I'll also make any possible corrections to the suit if desired by the customer. Once I have purchased materials for your commission, you lose the right to a refund of the material costs. Fursuits can take anywhere from 2-6 months to make, and can be even more or less depending on the complexity of the character as well as my life situation and how busy I am. The most time consuming part is usually waiting for materials to get to my house so please understand that I may not be able to do much more than the foam base and eyes over the first few weeks.
Revisions:
• once materials are ordered, Major changes to the design such as color choice or large marking changes is not allowed. Small design choices can be changed depending on the stage at which they are requested, however if it is something that wasn't initially included in the approved working reference then an additional charge will be added.
• If you wish for me to make a change you have already approved, an additional fee is added based on my hourly wage and any further material costs (unless it was a mistake/misinterpretation on my part).
Repairs:
I offer free repairs in most cases! However the amount of time that has passed determines who will be responsible for the shipping costs. If you don't want to deal with shipping the suit to me for repairs, please reach out anyways because I can give you some advice on how to make repairs ^_^
• If the fursuit arrives damaged due to the fault of the shipping company, please first take photos of the damaged box, suit, etc. immediately and send them to me so that I can file a claim with the shipping company. After this I will cover the cost to ship the suit both ways and make the repairs.
• If the fursuit arrives with any major flaws that were a fault of my own that I may have missed, I am happy to both make those repairs for free and cover the cost to ship it both ways.
• If the fursuit needs repairs within the first 3 months I am also happy to do the same thing as above!
• If repairs are requested after 3 months, then I ask that the buyer cover their own shipping costs, but I will do the repairs for free!
• For any repairs requested after a year, I ask that the buyer cover both ends of the shipping.
• If you request repairs for a second hand suit (I.e. you bought the suit from anyone other than myself), I ask that the buyer covers both ends of the shipping. Depending on the severity of the damage I may also charge a repair fee.
• If you have made any changes or alterations to the suit, have damaged it yourself due to any sort of recklessness or improper care, (this goes beyond just normal wear and tear from use), or have lost any parts and are asking them to be replaced, I ask that the buyer covers both ends of shipping and pay a fee.
General:
• I may record the making process and post it on my social media.
• Commissioned suits may be worn briefly only for test fitting and promotional photos/videos.
• Prices and turnaround time are subject to change based on demand, complexity of commission, and personal life circumstances.
• I have the right to reject any commission that I do not feel comfortable making for any reason.
• When you commission me, you understand that you are commissioning a handmande item made by a human. This means that tiny imperfections that still fall within my own quality standards are — although not always present, naturally permitted (ex. small shaving imperfections, small glue spots, slight asymmetry, etc.)
With the pictures of the fursuit, I can:
• Promote myself with it on social media
• Display it everywhere (website, social media, etc.)
• Post it wherever I'd like
The buyer can:
• make any changes to the design and do whatever you want with it (you have complete liberty of the design, but just please don't claim to have designed the original design if it's a premade I created)
• Use the fursuit to promote yourself. You are not forced to give me credit when you post it but I appreciate it if you do!
• Use the fursuit in monetized content if the fursuit is not the main subject for the earnings.
Please don't:
• Claim the artwork as something you made
• Buy/commission a suit from me with the intention of selling it for a profit
Customer Happiness:
• I will do everything I can to make my customers happy!
• If you have a problem with anything, please tell me right away so we can find a solution together.
• I am willing to change some of my terms for you if you ask before I start on your commission.
Refunds:
If the client is not able to finish the payments, then I will refund all payments made except the material cost fee. In order to make sure the time invested into the suit doesn't go to waste, I'll change the design so that it's different from the commissioner’s design and then sell it as a premade on TheDealersDen. Returns are not allowed since the fursuit is made just for you.
•If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
• If you request a Paypal chargeback at any point when we have not agreed on a refund, you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you.
*If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned by me, and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.
