These Terms of Use govern your use of the ShapeStep app. ShapeStep is created by Egils Broks.

1. Acceptance and Apple terms

By downloading, accessing, or using ShapeStep, you agree to these Terms. If you do not agree, do not use the

app.

Apps distributed through the App Store are licensed, not sold. These Terms supplement Apple's applicable terms

and the Apple Standard Licensed Application End User License Agreement: Apple Standard EULA. If mandatory

Apple terms or applicable law conflict with these Terms, those mandatory terms or laws control.

These Terms are between you and Egils Broks, not Apple. Egils Broks, not Apple, is responsible for

ShapeStep and its content, support, and maintenance, except as otherwise required by Apple's terms or

applicable law.

2. About ShapeStep

ShapeStep is a personal movement and fitness visualization app. It can display steps and walking and running

distance from Apple Health, show progress toward a selected daily step goal, create a motivational contour and

local trend history, and provide optional goal congratulations.

The app can also operate in preview mode using clearly labeled sample values. Preview values are not your real

movement data.

ShapeStep is not a medical device, medical service, body-composition tool, diagnostic service, treatment

program, emergency service, professional coaching service, or guarantee of any health or fitness result.

3. Health and fitness disclaimer

The contour is a motivational visualization generated from app rules and available step data. It is not a scan,

measurement, or prediction of your body, body shape, weight, body fat, health, disease risk, physical appearance,

or future results.

Step counts, distance, percentages, trends, contour levels, and projections are provided for general personal

information and motivation. They may be incomplete, delayed, estimated, or inaccurate because of device

behavior, sensor limitations, permissions, Apple Health data, time-zone changes, manual entries, app logic, or

other factors.

A daily step goal, including the default 7,000-step goal, is a practical motivational target and is not a medical

threshold. Progress below a goal can still be valuable, and reaching a goal does not guarantee health, weight

loss, fitness, or a particular body change.

ShapeStep does not provide medical advice, diagnosis, treatment, injury prevention advice, or emergency

assistance. Consult a qualified healthcare professional before starting or changing physical activity if you have a

medical condition, are pregnant, are recovering from injury, take medication that affects exercise, or have

concerns about what activity is appropriate for you. Stop activity and seek appropriate professional or emergency

help if you experience concerning symptoms.

4. Eligibility

You must be legally permitted to use the app under the laws that apply to you. If you are below the age at which

you can agree to these Terms, a parent or legal guardian must review and agree to them on your behalf and

supervise use where appropriate.

5. Apple Health

Apple Health access is optional. If you choose to connect it, ShapeStep requests read access to step count and

walking and running distance. The app does not write Health data.

You control Health permissions through iOS and Apple Health. HealthKit does not reveal whether read access

was denied, so a completed permission request does not guarantee that ShapeStep can read all requested data.

You remain responsible for reviewing Apple Health and device settings and for deciding whether the displayed

information is suitable for your personal use.

Do not use ShapeStep or Apple Health values as the sole basis for medical, safety, employment, insurance, legal,

or other significant decisions.

6. Goals, profiles, contour history, and estimates

You may select a daily step goal within the range offered by the app and choose a body profile. The profile

controls the visual style of the contour; it does not identify your sex, gender, health, or actual body shape. The

body-profile choice may remain locked until you reset contour progress.

ShapeStep calculates contour changes from available steps, goal settings, elapsed time, and locally stored

history. Historical values and trend summaries can change when data is updated, settings change, a day

completes, or history is reset.

Estimated preview distance is based on a fixed sample conversion and is not a measured distance. Apple Health

distance, when available, is displayed separately from preview estimates.

You are responsible for choosing a reasonable goal, interpreting the visualization appropriately, and verifying

information through suitable sources when accuracy matters.

7. Notifications

If enabled, ShapeStep may present one on-device congratulations notification after detecting that you reached

your daily goal. Notifications can be delayed, duplicated, blocked, or unavailable because of device state,

background execution, permissions, Focus settings, Apple Health access, system settings, or operating-system

behavior.

Notifications are motivational only. You remain responsible for monitoring your activity and should not rely on a

notification as proof that a target was reached or that an action is required.

8. Your responsibilities

You are responsible for:

● Using ShapeStep in a way that is appropriate for your health and circumstances.

● Choosing realistic goals and avoiding unsafe or excessive activity.

● Keeping your device and Apple Account secure.

● Maintaining any backups you consider necessary.

● Managing Apple Health and notification permissions.

● Following applicable laws and respecting other people's rights.

● Seeking qualified advice when a question requires professional judgment.

9. Acceptable use

You agree not to:

● Use the app in violation of applicable law or another person's rights.

● Use ShapeStep to promote unsafe, harmful, deceptive, or discriminatory conduct.

● Misrepresent the contour or app output as a medical assessment, verified body measurement, or guaranteed

result.

● Attempt to interfere with the app, bypass security measures, introduce harmful code, or gain unauthorized access.

● Reverse engineer, copy, modify, redistribute, sublicense, or create derivative works from the app except where

applicable law expressly permits it.

● Use Apple Health information obtained through ShapeStep for advertising, data brokerage, or unlawful profiling.

10. Intellectual property and license

ShapeStep, including its software, design, name, graphics, contour artwork, text, and app content, is owned by

Egils Broks or the applicable licensors and is protected by intellectual property laws.

Subject to these Terms and Apple's applicable usage rules, you receive a limited, personal, non-exclusive,

non-transferable, non-sublicensable, revocable license to use ShapeStep on Apple-branded products that you

own or control. Family Sharing or volume purchasing may permit access by associated accounts where supported

by Apple.

Apple system fonts, SF Symbols, iOS, HealthKit, and other Apple materials remain owned by Apple or the

applicable licensors and are used under their respective terms.

11. Apple and third-party services

ShapeStep relies on Apple platform services, including iOS, SwiftUI, HealthKit, UserNotifications, App Store

distribution and review prompts, system fonts, and SF Symbols. Availability and operation of those services are

controlled by Apple and are subject to Apple's terms and privacy policies.

You must comply with applicable third-party terms when using the app. Apple is not responsible for support or

maintenance of ShapeStep except as required by Apple's terms or law. Apple and its subsidiaries are intended

third-party beneficiaries of provisions applicable to Apple, and may enforce those provisions where permitted.

12. Privacy

Your use of ShapeStep is also governed by the Privacy Policy for ShapeStep, which explains what information the

app handles, where it is stored, and the choices available to you.

13. App availability and changes

We may update, change, suspend, or discontinue ShapeStep or individual features. We do not guarantee that

every feature will remain available, work with every device or operating-system version, or operate without

interruption.

Updates may be required to continue using the app. We are not responsible for failures caused by unsupported

devices, outdated software, insufficient storage, denied permissions, Apple service outages, or circumstances

outside our reasonable control.

14. Disclaimer of warranties

To the maximum extent permitted by law, ShapeStep is provided "as is" and "as available," with all faults and

without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the app will be

uninterrupted, error-free, completely accurate, secure against every threat, or suitable for every purpose.

We do not warrant that using ShapeStep, reaching a step goal, or viewing a particular contour will produce any

health, fitness, weight, appearance, or other result.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Egils Broks will not be liable for indirect, incidental,

special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, goodwill, or

reputation arising from use of or inability to use ShapeStep.

To the maximum extent permitted by law, total liability for any claim relating to ShapeStep will not exceed the

amount you paid for the app, if any, during the twelve months before the claim arose.

These limitations do not apply where liability cannot lawfully be limited, including liability for intentional

misconduct, gross negligence where applicable, death or personal injury caused by negligence where it cannot be

excluded, or mandatory consumer protection rights.

16. Termination

You may stop using and delete ShapeStep at any time. Your license and rights under these Terms end

automatically if you materially breach them. We may suspend or discontinue the app where permitted by law.

Provisions that by their nature should continue after termination, including intellectual property, disclaimers,

liability limitations, governing law, and dispute provisions, remain in effect.

17. Changes to these Terms

We may revise these Terms when the app, our practices, or legal requirements change. Updated Terms will show

a new Last updated date. Continued use after revised Terms become available means you accept them, except

where applicable law requires another form of notice or consent.

18. Governing law and disputes

These Terms are governed by the laws of Latvia, without regard to conflict-of-law rules, unless mandatory

consumer protection laws in your country require otherwise. If you live in the European Union, the European

Economic Area, Switzerland, or the United Kingdom, mandatory protections and the courts available in your usual

place of residence remain unaffected.

Before starting formal proceedings, you are encouraged to contact us so we can try to resolve the concern.

Nothing in this section limits a right to contact a regulator, consumer authority, or court where applicable law

permits it.
