IMPORTANT: PLEASE READ THESE TERMS OF USE AND END-USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING SECURE SHIELD: PRIVACY GUARD. BY DOWNLOADING, INSTALLING, OR USING THE "SECURE SHIELD: PRIVACY GUARD" MOBILE APPLICATION (THE "APP"), YOU ARE INDICATING YOUR ACCEPTANCE OF, AND AGREEING TO BE BOUND BY, THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE APP.
This Agreement is a legal agreement between you (an individual or entity) and the Secure Shield Team ("we," "us," or "our") governing your use of the Secure Shield: Privacy Guard iOS application and any related services.
Subject to the terms and conditions of this Agreement, the Secure Shield Team grants you a limited, non-exclusive, non-transferable, non-sublicensable, personal, and revocable license to download, install, and use the App solely on compatible Apple-branded products that you own or control, and as permitted by the Apple App Store Terms of Service. This license is for your personal, non-commercial use only.
You agree not to, and you will not permit others to:
a. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App, except to the extent that such activity is expressly permitted by applicable law.
b. Modify, adapt, alter, translate, or create derivative works from the App.
c. Sell, rent, lease, lend, sublicense, distribute, or otherwise transfer the App to any third party.
d. Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App.
e. Use the App in any manner that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable.
f. Use the App to interfere with or disrupt any networks, servers, or other systems connected to the App or its services.
g. Use the App for any purpose not expressly permitted by this Agreement.
h. Bypass, disable, or otherwise interfere with any security-related features of the App.
If the App requires you to create an account, you are responsible for maintaining the confidentiality of your account credentials (e.g., username, password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
a. Subscription: Access to certain features of the App may require a paid subscription. Subscription terms, pricing, and available plans will be presented to you prior to purchase within the App or on its associated App Store listing.
b. Automatic Renewal: Subscriptions typically renew automatically unless canceled before the end of the current billing period. You will be charged through your Apple App Store account.
c. Cancellations and Refunds: All subscription purchases are subject to the Apple App Store's payment, cancellation, and refund policies. Please refer to the Apple App Store Terms of Service for details on managing subscriptions and requesting refunds. We do not directly handle subscription cancellations or refunds.
d. Price Changes: We reserve the right to change the pricing for the App's subscriptions. Any price changes will be communicated to you in advance, and you will have the opportunity to cancel your subscription before such changes take effect.
The Secure Shield Team may, from time to time, provide updates, upgrades, patches, bug fixes, and other modifications to the App ("Updates"). These Updates may be automatically installed or may require your manual installation. You agree to receive and install these Updates as they are made available. We reserve the right to modify or discontinue, temporarily or permanently, the App or any part of it with or without notice.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE SECURE SHIELD TEAM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE APP AT YOUR SOLE RISK.
While the App is designed to block ads, adult content, and risky websites, we cannot guarantee that it will block 100% of all such content or provide absolute protection against all online threats. The effectiveness of the App may vary depending on the content you access and system configurations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SECURE SHIELD TEAM OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (iii) ANY CONTENT OBTAINED FROM THE APP; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE APP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
All intellectual property rights in and to the App, including but not limited to copyrights, trademarks, trade names, and patents, are owned by the Secure Shield Team or its licensors. This Agreement grants you only a limited license to use the App, and no ownership rights are transferred to you. You agree not to challenge or assist others in challenging our intellectual property rights.
This Agreement is effective until terminated by you or the Secure Shield Team.
a. By You: You may terminate this Agreement by deleting the App from your device and canceling any active subscriptions.
b. By Us: We may terminate this Agreement, and your access to the App, at any time, with or without cause, and without notice or liability to you. This includes, but is not limited to, if you breach any term of this Agreement or if we cease to offer the App.
Upon termination, the license granted to you will immediately cease, and you must uninstall and destroy all copies of the App. Sections 2, 6, 7, 8, 10, 11, 12, and 13 will survive any termination of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to this Agreement or the App shall be resolved exclusively by the state or federal courts located in California, United States, and you consent to the exclusive jurisdiction and venue of such courts.
a. Entire Agreement: This Agreement constitutes the entire agreement between you and the Secure Shield Team regarding the App, superseding any prior agreements or understandings.
b. Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
c. No Waiver: Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.
d. Assignment: You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign our rights and obligations under this Agreement at our sole discretion.
