This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and UZUMCU TEKNOLOJI REKLAM PAZARLAMA SANAYI VE TICARET LIMITED SIRKETI ("UZUMCU TEKNOLOJI", "we", "us", or "our") concerning your use of the Screenly mobile application.
By downloading, installing, accessing, or using Screenly, you agree to be bound by this Agreement.
If you do not agree with this Agreement, you must not install or use Screenly.
1. License Grant
Subject to your compliance with this Agreement, UZUMCU TEKNOLOJI grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Screenly.
This license is provided solely for lawful use of Screenly and its available features.
This Agreement does not transfer ownership of Screenly or any intellectual property to you.
2. Application Functionality
Screenly is designed to provide device and application usage analytics.
Depending on the version of the application, features may include:
Device usage analysis
Screen-time analysis
Application usage statistics
Application usage duration
Application usage frequency
Usage reports
Usage summaries
Performance information
Analytical dashboards
Other related functionality
Features may be modified, added, or removed at any time.
3. Permissions
Screenly may require certain operating-system permissions to provide its functionality.
These permissions may include access to device or application usage information.
You are responsible for granting or denying permissions requested by Screenly.
If you deny or revoke a permission required for a particular feature, that feature may not function correctly.
4. Acceptable Use
You agree to use Screenly only for lawful purposes.
You may not:
Use Screenly for unlawful surveillance
Violate another person's privacy
Access information without authorization
Circumvent security features
Reverse engineer, decompile, or disassemble Screenly except where permitted by applicable law
Copy or reproduce Screenly without authorization
Sell, lease, sublicense, or distribute Screenly without authorization
Modify or create derivative works from Screenly
Introduce viruses, malware, or harmful code
Interfere with the operation or security of Screenly
Use Screenly in violation of applicable laws
5. User Responsibility
You are responsible for the device on which Screenly is installed and for ensuring that your use of the application complies with applicable laws.
If the device is shared with another person, you are responsible for ensuring that your use of usage information is lawful and appropriate.
You must not use Screenly to monitor another individual without appropriate authorization where such authorization is legally required.
6. Intellectual Property
Screenly, including its software, source code, user interface, graphics, designs, logos, trademarks, text, databases, features, and other materials, is owned by or licensed to UZUMCU TEKNOLOJI.
All rights not expressly granted under this Agreement are reserved.
7. Updates
UZUMCU TEKNOLOJI may release:
Bug fixes
Security updates
Performance improvements
Compatibility updates
New features
Other application updates
Certain updates may be necessary for Screenly to continue functioning correctly.
8. Third-Party Services
Screenly may use third-party services or technologies.
Third-party services may be subject to separate terms and privacy policies.
UZUMCU TEKNOLOJI is not responsible for third-party services outside its reasonable control.
9. Disclaimer
To the maximum extent permitted by applicable law, Screenly is provided on an "as is" and "as available" basis.
We do not guarantee that:
Screenly will always be available
Usage statistics will always be completely accurate
The application will always be error-free
All features will work on every device
Usage data will always be available
The application will operate without interruption
Usage statistics are provided for informational and analytical purposes.
10. Limitation of Liability
To the maximum extent permitted by applicable law, UZUMCU TEKNOLOJI, its affiliates, employees, contractors, partners, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Screenly.
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited.
11. Termination
UZUMCU TEKNOLOJI may suspend or terminate access to Screenly if you materially violate this Agreement or use the application unlawfully.
You may stop using Screenly at any time by uninstalling the application.
Upon termination, the license granted to you under this Agreement will end.
12. Apple App Store Terms
If you obtained Screenly through Apple's App Store, you acknowledge that this Agreement is between you and UZUMCU TEKNOLOJI and not Apple.
Apple is not responsible for providing maintenance or support services for Screenly.
Apple has no obligation to provide warranty services for Screenly except where required by applicable law.
Apple is a third-party beneficiary of this Agreement and may enforce applicable provisions of this Agreement.
13. Google Play Terms
If you obtained Screenly through Google Play, your use of Screenly may also be subject to applicable Google Play terms and policies.
Google is not responsible for providing maintenance or support services for Screenly unless required by applicable law.
14. Governing Law
This Agreement shall be governed by applicable law, subject to any mandatory consumer protection rights that cannot legally be excluded.
