This Fan Content Policy is meant to help answer some common questions about using Scarcity intellectual property (the “Game IP”) in fan content.
We hope you understand that these guidelines are meant to protect our properties so we can keep making wild and wonderful things for you all to enjoy.
Scarcity permits you to create content and/or mods based upon the Game IP (“Fan Content”) for your non-commercial use, provided that you strictly adhere to the Rules for Use below.
We reserve the right to revoke this permission at any time for any reason (or no reason).
Affix this notice conspicuously to all Fan Content that you create:
“This is unofficial Scarcity Fan Content created under the Scarcity Fan Content Policy.
It includes materials which are the property of Scarcity.
It has not been reviewed by, and is neither approved nor endorsed by, Scarcity.”
You may not state, suggest, imply, or do anything that could mislead people into thinking your Fan Content is official, endorsed, sponsored, or approved by Scarcity or any of its affiliates.
We encourage you to create and share Fan Content — but it must be free.
“Free” means:
You do not sell your Fan Content
You do not require payment, subscriptions, newsletter signups, surveys, memberships, registrations, or similar access requirements
You may not use Fan Content to promote paid services, websites, or products
“Free” also means that others, including Scarcity, may freely access, view, share, and use your Fan Content without approvals, licenses, credit, or payment.
You may use Fan Content on monetized platforms such as Twitch or YouTube as long as ads or sponsors do not promote anything competitive with or harmful to Scarcity.
You may not create NFTs (non-fungible tokens) or cryptocurrencies using the Game IP or related to the Game IP in any way.
You may not create clones or ports using the Game IP
You may not create cheats or hacks for Scarcity
Examples include (but are not limited to):
Do not modify or remove legal notices or policies from the Game IP
Do not use Scarcity trademarks or logos in a way that suggests official endorsement
Do not create Fan Content that defames, disparages, or negatively depicts Scarcity or any of its affiliates, managers, members, officers, employees, contractors, or agents
This is not an exhaustive list.
Examples include:
Distributing malicious software or content
Offensive, racist, sexist, pornographic, obscene, ableist, grotesque, defamatory, or damaging content
Violating privacy, publicity, intellectual property, or proprietary rights
Using third-party copyrights or trademarks without permission
Promoting drugs, alcohol, illegal activity, or harm to minors
This is not an exhaustive list.
You are solely responsible for complying with all local, state, regional, and national laws related to your Fan Content.
Scarcity will not be held liable for violations or legal fees and will not act as legal counsel.
If you have legal questions, seek professional legal advice.
We reserve the right to stop or restrict your use of the Game IP at any time, for any reason or no reason.
This Fan Content Policy does not grant ownership or licensing rights to the Game IP.
We may update this policy at any time.
We may be willing to grant licenses for commercial Fan Content (for example, selling items in our store).
