KRS 6.606 Ethics violations and breach of confidentiality - Email messages reveal continued distribution of highly confidential information with community members, NCS Parents, and staff members. Messages further demonstrate continued misrepresentation of material facts and dishonesty.
KRS 63.090 (5) Neglect of Duty - Communication reveals retaliatory behavior, confusion, and reckless back and forth messaging related to construction bids costing the taxpayers over $1.5MM. When asked about 15 Yes votes on the costly construction plan and eventually the acceptance of bids, Berry publicly stated "my mother said to go along with the crowd."
KRS 522.020(c) Misconduct in Office - Berry engaged in ongoing communication regarding facility plan decision making with plaintiffs having legal claims against the district. these claims have cost the tax payers tens of thousands of dollars. A violation of the Kentucky School board oath of office
