Participants at SageBowlz Disc Golf are welcome to provide a donation to assist with the upkeep and future expansion of SBDG, but in no wise misconstrue such payment as an admission fee. They acknowledge that Disc Golf involves activities that may entail unknown and unanticipated risks that could result in physical injury, illness, death or damages to yourself and/or to others. Risks may include, but are not limited to, slipping, tripping, gopher holes, water hazards, uneven ground, metal shrapnel, irrigation boxes, any of the old wooden structures/walkways/rail fences, trees, thorn bushes/brush, wild life, and contact with other people which may result in injury. There may also be a risk of damage and/or loss of personal property that includes but is not limited to clothing, footwear, accessories. There is also a risk of damage to the property, a building and/or adjacent property structures. You agree that if you have caused any damage on the property or adjacent properties, you are solely responsible and liable for all repairs and/or compensation. If a disc is thrown over a fence into someone else’s property, you must knock on their door for permission to acquire your disc or a note must be left for future retrieval (you will not trespass to acquire a disc).

As a Participant, I understand the following must be adhered to ensure a safe and enjoyable time for all Participants. I agree to follow all rules, regulations, and safety measures in place at SageBowlz Disc Golf.

I agree to use the designated Disc Golf area in a responsible manner as defined by the standard rules set out by DGA First in Disc Golf : https://discgolf.com/disc-golf-education-development/disc-golf-rules-for-recreational-play/

I acknowledge that should I fail to follow the rules, regulations and reasonable safety measures, it may result in the immediate removal of said Participant from the property and/or potentially band from future participation on a permanent basis.

The Participant agrees to the following statement; I authorize SageBowlz – DISC GOLF representatives to obtain, on my behalf, emergency treatment and to secure such medical treatment at my expense should I require medical treatment while on the property. - I agree to fully and forever waive, release and discharge from any and all claims, actions, cause of action, demands, judgements, damages (including compensatory, general, special, consequential, exemplary and punitive), liability or obligations of any nature or kind, whether known at the time I leave the property or which may arise or become known later, which accrue on account of, or in any way arise out of or in connection with: (i) my present on the property (II) the activities on the property with others (iii) the operations of SageBowlz – DISC GOLF (iv) my use of any and all of the property facilities, and (v) my use of any and all equipment on the property, whether owned by me, SageBowlz – DISC GOLF, or a third party.

I agree to indemnify and hold SageBowlz – DISC GOLF harmless from and against all losses, liabilities, claims, obligations, costs, damages, and/or expenses whatsoever, including, but not limited to, any and all attorneys’ fees, costs, damages, and/or judgement directly or indirectly arising out of, or relating to my acts or omissions while participating in any/all activities on the property. - I agree to accept and assume all of the risks which accompany the activities on the property that my participation in is purely voluntary in which I have elect to participate, notwithstanding the risks. - Fully understand that participating in any activities on the property may involve physical exertion, and accordingly represent that I (i) am in sufficient good health to participate in activities on the property (ii) I do not have any pre-existing physical or medical conditions, that may be impacted or worsened by my use of the property.(iii) Certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in activities on the property, or if not, I agree to bear the cost of such injury, damage, or loss to myself and others if proven responsible.

Further, I agree that should there be cause for any legal proceedings, they shall be filed solely in the province of Alberta in the Town of Drumheller, and I further agree that the substantive law of Alberta shall apply in that action without regard to conflict of law or rules of that province. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

BY BEING ON THE PROPERTY AT 348 MABBOT RD REFER AS SAGEBOWLZ DISC GOLD, I ACKNOWLEDGE THAT IF I AM HURT ON SAID PROPERTY OR CAUSE DAMAGES DURING MY PARTICIPATION IN THIS ACTIVITY, I MAY BE FOUND BY A COURT OF LAW TO HAVE WAIVED MY RIGHT TO PURSUE A LAWSUIT OR COST AGAINST SAGEBOWLZ – DISC GOLF, ON THE BASIS THIS WAIVER FOR WHICH I HAVE RELEASED THEM HEREIN. I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT.

I ACKNOWLEDGE AND AGREE THAT BY REMAINING ON THE PREMISES OF SBDG I HAVE READ AND UNDERSTOOD IT AND AGREE TO BE BOUND BY ITS TERMS.

By not agreeing to this Consent & Release Waiver I understand that Myself and anyone associated with my party are not allowed to remain on the property designated as SAGEBOWLZ - DISC GOLF and is responsible for any damage and liability incurred.
