# Rosarito Direct Terms of Use
**Effective date: August 11, 2026**
These Terms of Use ("Terms") govern your access to Rosarito Direct. By creating an account or using the service, you agree to these Terms.
## Marketplace role
Rosarito Direct is a communications and advertising marketplace that helps property hosts and prospective renters find and contact one another. Rosarito Direct is not a landlord, property manager, real-estate broker, travel agent, insurer, payment processor, escrow service, or party to any rental or other agreement between users. We do not collect rent or deposits, confirm reservations, guarantee listings or users, provide booking protection, or issue booking refunds.
## Eligibility and accounts
You must be at least 18 and legally able to enter contracts. Provide accurate, current information; maintain the security of your account; and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account. We may require email or identity verification and may reject, suspend, or remove accounts that cannot be verified or that violate these Terms.
## Host responsibilities
Hosts represent that they are legally authorized to advertise and offer each listed property. Hosts must provide accurate descriptions, photos, locations, availability, prices, amenities, and material conditions; honor their direct commitments; disclose relevant rules and charges; and comply with property, licensing, registration, tax, safety, accessibility, anti-discrimination, consumer-protection, and other applicable laws. Listing approval means only that Rosarito Direct reviewed the submission for marketplace publication; it is not a guarantee of ownership, legality, quality, safety, availability, or accuracy.
## Renter responsibilities
Renters must independently evaluate properties, hosts, terms, prices, payment instructions, and suitability before agreeing or paying. Use a written agreement, verify the identity and authority of the payment recipient, and use a payment method with protections appropriate to the transaction. Renters are responsible for lawful conduct, accurate inquiry information, and compliance with agreed property rules.
## Direct agreements and payments
Any rental, payment, deposit, cancellation, damage, tax, refund, or other arrangement is made directly between users outside Rosarito Direct. Users are solely responsible for negotiating and performing those arrangements and resolving related disputes. Never treat an in-app message, identity badge, listing approval, or external link as a guarantee that payment is safe.
## Listings, reviews, and content
You retain ownership of content you submit. You grant Rosarito Direct a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and distribute that content as needed to operate, promote, secure, and improve the service. You represent that you have the rights needed to submit it.
Reviews must reflect genuine experiences and comply with the review process shown in the app. We may reject, remove, or limit content that is inaccurate, unlawful, infringing, deceptive, unsafe, irrelevant, or contrary to these Terms. External links, including Airbnb links, are provided by users for comparison; Rosarito Direct is not affiliated with or responsible for third-party services.
## Prohibited conduct
You may not engage in fraud, impersonation, unlawful listings, discrimination, harassment, threats, spam, manipulation of reviews, payment deception, unauthorized data collection, intellectual-property infringement, interference with the service, circumvention of security or access controls, or use of the service for illegal activity.
## Moderation and service changes
We may review listings, identity submissions, reports, messages when reported or lawfully required, and other activity needed to protect the marketplace. We may delay publication, request changes, remove content, restrict features, suspend or terminate accounts, preserve evidence, or cooperate with authorities when reasonably necessary. We may change, discontinue, or limit the service and do not guarantee uninterrupted availability.
## Fees and Apple purchases
Browsing may be free. If host memberships or other paid features are introduced, the price and terms will be shown before purchase. Purchases made through Apple are also governed by Apple’s applicable terms. Unless required by law, billing, cancellation, and refund handling for Apple purchases follows Apple’s processes.
## Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available." Rosarito Direct disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, availability, and that any user, property, listing, review, or transaction is legitimate or suitable. Some jurisdictions do not allow certain disclaimers, so they may not fully apply to you.
## Limitation of liability
To the maximum extent permitted by law, Rosarito Direct and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; personal injury or property loss caused by another user; or disputes, payments, deposits, cancellations, stays, or agreements between users. Where liability cannot be excluded, it will be limited to the greater of the amount you paid Rosarito Direct during the twelve months before the claim or US $100. These limits do not apply where prohibited by law.
## Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Rosarito Direct and its operators from claims, losses, liabilities, and reasonable expenses arising from your content, property, stay, transaction, violation of law, violation of these Terms, or infringement of another person’s rights.
## Disputes and applicable law
Before filing a claim against Rosarito Direct, contact us and provide a reasonable opportunity to resolve it informally. These Terms are governed by applicable law, without overriding consumer rights that cannot legally be waived. The users to a direct rental or payment agreement remain responsible for choosing and documenting the law and dispute process governing their own agreement.
## Changes and termination
We may update these Terms by posting revised Terms and an effective date. Continued use after the effective date constitutes acceptance where permitted by law. You may stop using the service and request account deletion. Provisions that by their nature should survive termination will survive.
