Terms of Service

This agreement sets forth the terms and conditions for your use of the game (hereinafter referred to as "the Service") provided by rooster (hereinafter referred to as "Us" or "We"). 

Please read and agree to these terms before using the Service.

1. Definitions

The definitions of the terms used in these Terms and Conditions are as follows:

11. "Intellectual Property Rights": Rights or legally protected interests related to patents, utility models, breeder's rights, design rights, copyrights, trademark rights, and other intellectual property rights as provided by laws and regulations.

2. Agreement to These Terms and Conditions

1. Users may use the Service upon agreeing to these Terms and Conditions.

2. By installing, using, or otherwise accessing the Service, users are deemed to have agreed to these Terms and Conditions.

3. If a user is a minor, please use the Service after obtaining the consent of a parent or legal guardian.

4. If a minor user falsely claims to have obtained the consent of a legal guardian or misrepresents their age as being of legal age to use the Service, or engages in fraudulent acts to make others believe they are of legal age, such actions cannot invalidate any legal actions related to the Service.

5. If a user who was a minor at the time of agreeing to these Terms and Conditions later uses the Service after reaching the age of majority, it will be considered that the user has ratified all legal actions related to the Service.

3. Amendment of the Terms and Conditions

1. We reserve the right to revise the content of these Terms and Conditions at any time without obtaining the consent of users, and users are deemed to accept such revisions without objection.

2. When we revise these Terms and Conditions, we will notify users of the content through our designated method.

3. The revised Terms and Conditions shall take effect from the time we provide notification as described in the preceding paragraph.

4. Users will be deemed to have agreed to the revised Terms and Conditions without objection upon using the Service after the amendments have been made.

4. Account Management

1. Users are responsible for voluntarily registering and managing their information (referred to as "Registration Information," including email address, ID, password, etc.) when using the Service. Users shall not allow third parties to use their account or engage in activities such as lending, transferring, changing ownership, buying, or selling the account.

2. If the Service is used with the registered information, we may consider that it was used by the person who completed the registration. The person who completed the registration shall bear all responsibility and liability for the results and consequences arising from such usage.

3. In the event that damage is caused to us or a third party due to the unauthorized use of Registration Information, the user shall compensate us and the third party for such damages.

4. Users are responsible for managing their Registration Information at their own risk. We shall not be liable for any disadvantages or damages incurred by the user due to inaccurate or false Registration Information.

5. If it is discovered that the Registration Information has been stolen or used by a third party, the user must immediately notify us and follow our instructions.

5. Handling of Personal Information and User Information

Personal information and user information shall be handled appropriately in accordance with the separate "Privacy Policy" established by us.

6. Prohibited Activities

When using the Service, users are prohibited from engaging in the following activities, and if we determine that a user has violated any of these prohibited acts, we may take measures such as temporary suspension of the user's account, termination of membership, or other actions deemed necessary by us.

1. Infringing upon the intellectual property rights of us or third parties.

2. Damaging the reputation or credibility of us or third parties through defamation, discrimination, or slanderous acts.

3. Infringing upon or potentially infringing upon the property of us or third parties.

4. Causing economic harm to us or third parties.

5. Engaging in threatening behavior towards us or third parties.

6. Using computer viruses or engaging in acts that induce harmful programs.

7. Overburdening the infrastructure of the Service with excessive stress.

8. Attacking the servers, systems, or security of our website.

9. Attempting to access the Service through methods other than the interfaces provided by us.

10. Obtaining multiple user IDs by a single user.

11. Any other actions deemed inappropriate by us.

7. Disclaimer

1. We shall not be liable for any damages arising from changes, interruptions, or termination of the Service.

2. We are not involved in and shall not be responsible for the user's environment for utilizing the Service.

3. We do not guarantee that the Service meets the user's specific purposes, expectations of functionality, product value, accuracy, usefulness, compliance with applicable laws or internal regulations of industry associations by the user's use of the Service, or the absence of malfunctions.

4. We do not guarantee that the Service is compatible with all information devices, and the user acknowledges in advance that there may be malfunctions in the operation of the Service due to upgrades of the OS of the information device used to access the Service. We do not guarantee that such malfunctions will be resolved through modifications or other actions performed by us.

5. The user acknowledges in advance that the use of all or part of the Service may be restricted due to changes in the terms of service and operational policies of service stores such as AppStore and Google Play.

6. We shall not be liable for any direct or indirect damages incurred by the user as a result of using the Service.

7. We shall not be liable for any damages suffered by the user or any third party, including but not limited to missed opportunities, business interruptions, or any other damages (including indirect damages and loss of profits), even if we were notified in advance of the possibility of such damages.

8. The provisions of the preceding paragraphs shall not apply in cases where we have intentional or gross negligence or where the contract falls under the Consumer Contract Act.

9. Even in cases where the preceding paragraph applies, we shall not be liable for damages caused to the user by negligent acts (excluding gross negligence) regarding damages arising from special circumstances.

10. In the event that we incur liability for damages in connection with the use of the Service, our liability shall be limited to the amount of fees received from the user in the month in which the damages occurred.

11. We shall not be responsible for disputes or troubles between users. In the event of a dispute between users, it shall be resolved by the responsibility of the parties involved, and no claims shall be made against us.

12. In the event that a user causes damage to another user or a dispute arises with a third party in connection with the use of the Service, the user shall be solely responsible for resolving the damage or dispute at their own expense and responsibility, and shall not cause any inconvenience or damage to us.

13. If we receive a claim for damages or other demands from a third party due to the user's actions, the user shall resolve such claim at their own expense and responsibility (including attorney's fees). In the event that we make payment of damages to such third party, the user shall reimburse us for all costs (including attorney's fees and loss of profits) incurred by us, including the payment of damages.

14. In the event that a user causes damages to us in connection with the use of the Service, the user shall compensate us for such damages (including litigation costs and attorney's fees) at their own expense and responsibility.

8. Advertising Placement

The user understands and agrees that the Service may contain various advertisements and that we or our partners may display advertisements. The format and scope of advertisements on the Service may be changed by us at any time.

9. Prohibition of Rights Transfer

1. The user shall not transfer, in whole or in part, their position under these terms and conditions or any rights or obligations based on these terms and conditions to a third party without obtaining our prior written consent.

2. We may transfer all or part of the Service to a third party at our discretion. In such cases, all rights of the user relating to the Service, including their account, within the scope of the transferred rights, shall be transferred to the transferee.

10. Severability

If any provision or part of these terms and conditions is deemed invalid or unenforceable under the Consumer Contract Act or any other applicable laws, the remaining provisions of these terms and conditions and the remaining parts of the provision deemed invalid or unenforceable shall continue to have full force and effect.
