It was confirmed by Zack (Senior Property Manager of SHW) at the residents meeting of Thursday 22nd 2024 held at Harlow Newhall Projects Office that only residents who send him the email Notices will receive the information.
(Note: to date SHW only agreed to send in response to the detailed conveyance plans and tenders after much persistence by residents on the matter. It is yet to be agreed by SHW to respond to the other Notices and Breach of Contract for Remedy Notices).

A Certificate signed by the Company or its Managing Agent as to the amount of the Annual Estate Rentcharge Provision or the amount of the Rentcharge Adjustment for any Rentcharge Year shall be conclusive of such amount and in giving such Certificate the Company or its Managing Agent shall not be performing any arbitral function and shall not be acting as an arbitrator and the provision of the Arbitration Acts 1986 shall not apply
Failure since SHW was appointed as managing agent, over a decade ago, to current date to provide as per their contractual obligations to residents the certificate signed by the Company or it’s Managing Agent as to each financial years actual expenditure and/or any adjustment for the year.

To supply to the Transferor prior to the first unit sale and again following completion of the final unit on the Property; a master conveyancing plan illustrating plots to be transferred, highways to be adopted plus landscape water features, open spaces, play areas and any elements of the public realm intended or required to be transferred to the Residents Association (“the Public Area)

Please note: to date Newhall Projects, Newhall Residents Association Ltd and SHW have refused to provide this information to residents in respect to the Newhall service charges and alleged expenditures and continue to play silly games in refusing to send all the detailed plans for each developer area across Newhall estate that they expect residents to blindly continue to pay service charges towards year on year and have zero visibility of what actual parts belong to which entity and which parts they can expect to see services as included or excluded from their service charges. This is outrageous of Newhall Projects, Newhall Residents Association Ltd, SHW and our Estate Manager to think this is acceptable practice and conduct to have undertaken for circa two decades now and continue to do so to the residents of Newhall.
A tender and formal contract of tender should not be entered into on the residents behalf without being in possession of this detailed conveyance plan documents for the complete Newhall developer areas, allegedly handed over for service charges and should be sharing it with both residents and contractors tendering alike. Newhall Projects, Newhall Residents Association Ltd, SHW and our Estate Manager are urged to buck up their ideas here as this is utterly unacceptable practice and conduct towards Newhall residents for circa two decades now.
