IMPORTANT NOTICE

THIS END USER AGREEMENT CONTAINS A LEGALLY BINDING MANDATORY ARBITRATION AND WAIVER OF JURY TRIALS AND CLASS ACTIONS CLAUSE GOVERNING DISPUTES ARISING FROM YOUR USE OF REMOTO: UNIVERSAL REMOTE TV SERVICES. THIS AFFECTS YOUR LEGAL RIGHTS AS OUTLINED IN SECTION 14 BELOW. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICES.

This Remoto: Universal Remote TV End User Agreement (the “Agreement”), including any addenda, order forms, exhibits, schedules, appendices, and amendments thereto, constitutes a legally binding agreement between you (the “User” or “you”) and Remoto: Universal Remote TV and its affiliates (“we,” “our,” or “us”) governing your access to and use of the Remoto: Universal Remote TV app, website, software, and related services (collectively, the “Services”).

2. Acceptance of the Agreement

By activating, accessing, or using Remoto: Universal Remote TV, you represent that:

You are at least 13 years old or have reached the legal age of majority in your jurisdiction.
You have the authority to enter into legally binding agreements.
You accept and agree to comply with this Agreement.

If you do not agree to these terms, please do not use the Services.

3. Amendments

We may modify this Agreement at any time due to changes in law or updates to the Services. Any updates will be reflected in the “Last Updated” date. Continued use of the Services after such changes constitutes acceptance of the revised Agreement.

4. Subscription Terms

4.1 Free Trial

We may offer a free trial for a limited period, such as three days. To avoid charges, you must cancel at least 24 hours before the trial period ends. Otherwise, the selected subscription plan will automatically renew.

4.2 Paid Subscriptions

Subscriptions renew automatically unless canceled at least 24 hours before the renewal date. Auto renewal can be disabled through App Store settings. Access to the Services remains available until the end of the current billing period.

5. Payment and Billing

Basic features are available free of charge. Paid plans, pricing, and applicable fees are displayed in the App Store at the time of purchase. Taxes may apply where required. Electronic invoices may be issued upon request.

6. Refund Policy

Refunds are handled by the platform where the purchase was made, including the Apple App Store or Google Play Store. Refund eligibility is subject to the policies of the respective platform.

7. Electronic Agreement and Communication

By using the Services, you agree to:

Conduct transactions electronically
Receive notices and communications electronically
Treat electronic communications as legally valid and binding

8. Ownership

All intellectual property rights related to the Services are owned by us. You are granted no rights other than those expressly provided in this Agreement.

9. User Content

If you upload or share content through the Services, you grant us a worldwide, royalty-free license to use such content solely for operating and providing the Services. You are responsible for maintaining the security of your content.

10. Liability Disclaimer

We are not responsible for:

Loss of data
Damages caused by misuse of the Services
Service interruptions or technical issues

You use the Services at your own risk.

11. Privacy

Use of the Services is governed by our Privacy Policy, which is incorporated into this Agreement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages related to your use of the Services.

13. Governing Law

This Agreement shall be governed by the applicable laws of your jurisdiction, subject to the arbitration provisions below.

14. Mandatory Binding Arbitration

All disputes arising out of or relating to the Services shall be resolved through binding arbitration. By agreeing to this clause, you waive your rights to:

Jury trials
Participation in class action lawsuits

Except where prohibited by applicable law.
