Terms of Service for BREACH

These Terms of Service (“Terms”) govern your access to and use of BREACH (the “Game”), operated by Refresh Games (“we,” “us,” or “our”). By downloading, accessing, or playing the Game on Meta Quest, you agree to these Terms.
If you do not agree, do not use the Game.
You must be at least 13 years old to use the Game. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and play the Game for personal, non-commercial use, as long as you comply with these Terms and applicable laws.
The Game may use third-party services for multiplayer and backend features, including Photon and PlayFab. Use of online features may require a stable internet connection and may be subject to service interruptions, maintenance, or updates.
You are responsible for maintaining the security of your platform account and for all activity that occurs through it.
You agree not to:
Harass, threaten, abuse, or harm other players
Use hate speech or discriminatory content
Cheat, exploit bugs, or use unauthorized mods or third-party software
Attempt to disrupt servers or networking systems
Reverse engineer, decompile, or attempt to extract source code not permitted by law
Use the Game for commercial purposes without our permission
We may suspend or restrict access to the Game if you violate these rules.
If the Game allows you to upload, share, or transmit content (such as names, text, or other player-facing content), you:
Retain ownership of your content
Grant us a worldwide, non-exclusive, royalty-free license to use, host, reproduce, and display it solely for operating, improving, and promoting the Game
Represent that you have the right to share that content
We may remove content that violates these Terms or applicable policies.
The Game may offer limited virtual items, cosmetics, or currency. All purchases are handled through the relevant platform store and subject to that platform’s payment terms.
Unless required by law, virtual items have no real-world value, are not redeemable for cash, and are not transferable outside the Game.
We may modify, rebalance, or remove virtual items or progression systems to maintain gameplay integrity.
We may update, patch, or change the Game at any time. This can include adjusting gameplay, features, items, or online requirements. We do not guarantee that any specific feature will remain available indefinitely.
We strive to keep the Game available, but we do not guarantee uninterrupted access. Online features may be impacted by:
Maintenance
Bugs or technical issues
Third-party service outages (including Photon, PlayFab, or platform services)
You may stop using the Game anytime.
We may suspend or terminate your access if:
You violate these Terms
We believe your use risks harm to other players, the Game, or our services
Required by law or platform policy
Sections that should reasonably survive termination will remain in effect.
The Game is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, Refresh Games will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Game.
Our total liability for any claim related to the Game will not exceed the amount you paid (if any) to access the Game in the 12 months prior to the event giving rise to the claim.
(Some jurisdictions do not allow certain limitations, so these may not apply to you.)
Your use of the Game is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
These Terms are governed by the laws of the United States and the state or jurisdiction where Refresh Games is based, without regard to conflict of law principles, unless your local consumer protection laws require otherwise.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and may provide additional notice where appropriate. Continued use of the Game after changes means you accept the updated Terms.
