RACING DASH 2D - END USER LICENSE AGREEMENT (EULA)

This End-User License Agreement ("Agreement") is a legally binding contract between you ("User") and the Developer of Racing Dash 2D ("Software"). By downloading, installing, or using the Software, you agree to be bound by this Agreement.
If you do not agree, you must stop using the Software and delete all copies from your devices.
1. Acknowledgment
This Agreement is between you and the Developer, not Apple. Apple is not responsible for the Software and has no obligations regarding it, including:
- Maintenance or support.
- Warranty claims.
- Product liability claims.
- Compliance with legal or regulatory requirements.
- Intellectual property disputes.
Apple’s App Store Terms of Service apply to your use of the Software on Apple-branded devices.
2. Ownership & License Grant
The Software, including but not limited to its game code, assets, art, vehicles, tracks, UI ( Excludes Kenneys UI elements as they are part of a seperate license. ), and branding, is the exclusive property of the Developer and is protected by copyright, trademark, and intellectual property laws.
- This Agreement does not transfer ownership of the Software, nor does it grant any ownership rights to the User.
- The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial purposes.
- You may create one backup copy of the Software for personal archival purposes only, provided that:
- The backup is solely for personal use and is not shared, uploaded, or modified.
- You do not circumvent any security or licensing mechanisms of the Software.
- The backup must be deleted if you no longer own a licensed copy of the Software.
3. License Restrictions & Prohibited Uses
You may not:
- Reverse engineer, decompile, modify, or create derivative works of the Software.
- Cheat, exploit, or manipulate game mechanics to gain an unfair advantage.
- Sell, rent, sublicense, or distribute the Software without the Developer’s written consent.
- Use the Software for commercial purposes, including promotional events, without permission.
- Access the Software in a way that violates any applicable laws or third-party agreements.
4. Maintenance and Support
- The Developer is responsible for providing maintenance and support services.
- Apple has no obligation to provide support or maintenance.
- If you experience issues, you may contact the Developer via email or submit a support request through Google Forms.
- Any data you submit through Google Forms is voluntarily provided and only used for responding to support requests.
- Support request data is not stored within the game and is not shared with third parties.

5. Warranty Disclaimer
The Software is provided "as is" without warranties.
- If the Software fails to function properly, Apple’s sole responsibility is to refund the purchase price.
- To the maximum extent permitted by law, Apple has no other warranty obligations.
- The Developer disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
6. Product Claims
The Developer, not Apple, is responsible for handling any claims, including:
- Product liability.
- Legal or regulatory compliance.
- Consumer protection laws and privacy issues.

7. Dispute Resolution
If you have any issues with the Software, please contact the Developer at damien.feedback@icloud.com to seek a resolution. Any legal disputes shall be handled in accordance with the laws of the United States and the state of Michigan.
8. Third-Party Content and Licensing
The game Racing Dash 2D includes third-party content under their respective licenses:
Engine: The game is developed using Godot Engine, and is free and open source software released under the permissive MIT license (also named Expat license).
Music: The game uses audio from the Racing Music Pack by TwistwonkaE, licensed under the Creative Commons Attribution 4.0 (CC BY 4.0) license.
Certain UI elements in Racing Dash 2D make use of buttons from the Kenney Asset Pack, created by Kenney.nl.
These assets are provided under the CC0 License, but we’d like to thank Kenney for making them available to the community.
All contributors have been properly credited within the game.
This Agreement does not transfer ownership of any third-party assets, only the right to use them within the Software.
9. Ownership of In-Game Assets (Tracks, Vehicles, Art, and Audio)
- The racetracks from Levels 1 - 5 were created by [Kimmy Meyer "a Contributor"], used with permission, and credited accordingly.
- The vehicles featured in the game were created by the original development team. While the Developer does not claim sole authorship, these assets are properly credited in the game.
- Original racetracks from levels 6 and 7 are currently in game and these assets belong to their respective creators, who have been credited.
All contributors have been credited within the game.
10. Termination of License & End of Support
Your license automatically terminates if:
- You violate any term of this Agreement.
- The Developer revokes the Software.
If the Developer discontinues support or stops distributing the Software, the following applies:
- You may continue to use the Software if it remains installed on your device.
- The Developer will not provide further updates, maintenance, or support.
- The Software may become unusable due to platform updates, compatibility changes, or other external factors.
- No refunds or compensation will be provided for discontinued support.
Upon termination, you must delete all copies of the Software, except for any legally permitted personal backups (as described in Section 2).
11. Limitation of Liability
To the maximum extent permitted by law, the Developer is not liable for:
- Indirect, incidental, or consequential damages.
- Loss of data, corruption, or errors.
- Performance issues or crashes.
- In no event shall the Developer's liability exceed the purchase price paid.
12. Changes to This Agreement
The Developer may modify this Agreement at any time.
Continued use after changes are posted constitutes acceptance of the new terms.
13. Third-Party Beneficiary (Apple Users Only)
- You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement.
- Upon your acceptance of this Agreement, Apple has the right to enforce this Agreement against you.
14. Preservation & Archival Rights
The Developer recognizes the importance of digital preservation. If the Software is no longer supported or distributed, users and recognized preservation organizations may archive the Software, provided that:
- Archival copies are for non-commercial, preservation purposes only.
- The Software is not modified or redistributed for commercial gain.
- All original copyright notices and credits remain intact.
- The Developer maintains the right to request removal of unauthorized distributions outside of preservation efforts.
