Qwin - Learn & Win Terms of Use

This Terms of Use (the "Terms") govern your use of the Qwin - Learn & Win app (the "App"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Age Restrictions

The App is intended for users who are 13 years of age or older. If you are under 13 years of age, you may not use the App without the permission of your parent or guardian.

3. License

Subject to these Terms, we grant you a non-exclusive, non-transferable, limited license to use the App. You may not:

• Modify, adapt, or translate the App;

• Reverse engineer, decompile, or disassemble the App;

• Rent, lease, lend, sell, or distribute the App; or

• Use the App for any commercial purpose other than to earn coins as described in these Terms.

4. User Content

You may be able to post, upload, or otherwise submit content to the App (such as text, images, or videos) (collectively, "User Content"). You are solely responsible for your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display your User Content in any media or format.

5. Coins

You can earn coins by answering quizzes correctly, watching ads, and participating in other activities within the App. You can also get free coins every day. Coins can be used to purchase in-app items, such as hints and extra lives. Coins can also be converted to real money and withdrawn to your PayPal account.

6. Real Money

The amount of real money that you can earn from the App is limited. We do not intend to make money from users, but rather to encourage them to learn and improve their knowledge. The amount of real money that you can earn will depend on a variety of factors, including the number of quizzes that you answer correctly, the time that you spend using the App, and the frequency with which you participate in other activities.

Your privacy is important to us. Please see our Privacy Policy for information about how we collect, use, and share your personal information.

8. Changes to Terms

We may update these Terms from time to time. The most current version of the Terms will always be posted on the App. If you continue to use the App after the Terms have been updated, you agree to be bound by the updated Terms.

9. Termination

We may terminate your access to the App at any time for any reason. If we terminate your access, you will no longer be able to use the App and you will forfeit any coins that you have earned.

10. Disclaimer of Warranties

The App is provided "as is" and "as available." We make no warranties, express or implied, about the App. We do not warrant that the App will be uninterrupted, error-free, or secure. We do not warrant that the App will meet your requirements or that the results of using the App will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any damages arising from or related to your use of the App, including, but not limited to, direct, indirect, incidental, consequential, special, or punitive damages.

12. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.

13. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.

15. Waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of such provision.

16. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms to any of our affiliates or subsidiaries, or to any successor in interest in the event of a merger, acquisition, or sale of assets.
