These Terms of Use apply to your use of the QUAIA application.
By downloading or using QUAIA, you agree to these Terms.
QUAIA is an application that allows users to play virtual instruments, record performances, create loops, and use other music-related features.
Some features are available for free, while additional features may require the purchase of QUAIA FULL.
QUAIA FULL is an optional one-time in-app purchase.
QUAIA FULL unlocks additional features, which may include additional instruments, MY CHOIR, expanded LOOP tracks, and additional saved LOOP projects.
The exact price displayed to you is determined by the App Store and may vary depending on your country or region.
QUAIA FULL is not a subscription.
Purchases and restoration of purchases are handled through Apple's App Store.
QUAIA may provide certain instruments and features free of charge.
The content, availability, design, or limitations of free and paid features may be modified in future versions when necessary to improve the application, maintain compatibility, or provide new functionality.
Features already purchased through QUAIA FULL will not intentionally be removed solely for the purpose of requiring the same user to purchase QUAIA FULL again.
QUAIA may allow you to create and store recordings, LOOP projects, MY CHOIR audio, settings, and other content on your device.
You are responsible for maintaining any backups that you consider necessary.
The developer cannot guarantee recovery of locally stored data if it is lost due to app deletion, device failure, operating system changes, storage failure, or other circumstances.
MY CHOIR allows you to use recordings of your own voice within QUAIA.
You should only record voices or other audio that you have the right and permission to use.
Do not use QUAIA to record another person in violation of applicable laws or without any consent required by law.
QUAIA, including its original software, interface, graphics, designs, sounds, branding, and other original content, is protected by applicable intellectual property laws.
These Terms do not transfer ownership of QUAIA or its intellectual property to the user.
You may use QUAIA for personal and lawful creative activities in accordance with these Terms.
Subject to the rights of third parties, you may use performances and musical works you create using QUAIA for personal or commercial purposes.
However, QUAIA does not grant you rights to copyrighted songs, melodies, recordings, characters, trademarks, or other third-party content.
You are responsible for ensuring that your use of third-party material complies with applicable laws and permissions.
You may not:
Use QUAIA for unlawful purposes.
Attempt to circumvent or disable QUAIA FULL purchase restrictions.
Reverse engineer, redistribute, copy, or commercially exploit QUAIA itself except where permitted by applicable law.
Use QUAIA in a manner that infringes the rights of others.
Intentionally interfere with the normal operation or security of the application.
QUAIA may be updated, modified, or discontinued in whole or in part.
The developer does not guarantee that every feature will remain available forever or operate on every future device or operating system version.
Reasonable efforts will be made to maintain compatibility and preserve purchased functionality where practicable.
QUAIA is provided on an "as is" and "as available" basis to the extent permitted by applicable law.
While reasonable efforts are made to provide a stable and enjoyable experience, the developer does not guarantee that the application will always be uninterrupted, error-free, or suitable for every particular purpose.
To the maximum extent permitted by applicable law, the developer is not responsible for indirect, incidental, or consequential losses arising from the use or inability to use QUAIA.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded under applicable consumer protection laws.
If you obtained QUAIA through Apple's App Store, your use of the App Store and purchases made through it are also subject to Apple's applicable terms and conditions.
Apple is responsible for processing App Store transactions in accordance with its own terms.
These Terms may be updated when QUAIA's functionality, business model, or legal requirements change.

本利用規約は、QUAIAアプリケーションの利用に適用されます。
QUAIAをダウンロードまたは利用することにより、本規約に同意したものとみなされます。
QUAIAは、バーチャル楽器の演奏、演奏の録音、LOOPの作成など、音楽に関連する機能を提供するアプリケーションです。
一部の機能は無料で利用でき、追加機能の利用には「QUAIA FULL」の購入が必要となる場合があります。
QUAIA FULLは、任意で購入できる買い切り型のアプリ内課金です。
QUAIA FULLを購入すると、追加の楽器、MY CHOIR、LOOPのトラック数拡張、保存可能なLOOPプロジェクト数の拡張などの機能が開放されます。
実際の販売価格はApp Storeに表示される価格が適用され、国または地域によって異なる場合があります。
QUAIA FULLはサブスクリプションではありません。
購入および購入の復元は、AppleのApp Storeを通じて処理されます。
QUAIAでは、一部の楽器および機能を無料で提供する場合があります。
アプリの改善、互換性の維持、新機能の提供などのため、将来のバージョンで無料・有料機能の内容、提供範囲、デザインまたは制限を変更する場合があります。
ただし、QUAIA FULLを購入済みのユーザーに対し、同じQUAIA FULLを再購入させることだけを目的として購入済み機能を意図的に削除することはありません。
QUAIAでは、演奏録音、LOOPプロジェクト、MY CHOIRの音声、各種設定などを端末内に保存する場合があります。
必要なデータについては、ユーザー自身の責任で適切なバックアップを行ってください。
アプリの削除、端末の故障、OSの変更、ストレージ障害その他の事情によって端末内データが失われた場合、その復旧を保証することはできません。
MY CHOIRでは、自分の声を録音してQUAIA内で使用できます。
録音する音声については、ユーザー自身が使用する権利または必要な許可を有するものを使用してください。
法令に違反する方法、または法令上必要な同意を得ずに他人の音声を録音する目的でQUAIAを使用しないでください。
QUAIAのソフトウェア、インターフェース、グラフィック、デザイン、音声、ブランドその他のオリジナルコンテンツは、適用される知的財産法によって保護されています。
本規約によって、QUAIAまたはその知的財産権の所有権がユーザーへ移転するものではありません。
ユーザーは、本規約に従い、個人的かつ適法な創作活動のためにQUAIAを利用できます。
第三者の権利を侵害しない範囲で、QUAIAを使用してユーザー自身が作成した演奏や音楽作品を、個人目的または商用目的で利用できます。
ただしQUAIAは、第三者が権利を有する楽曲、メロディ、音源、キャラクター、商標その他のコンテンツを利用する権利をユーザーへ付与するものではありません。
第三者のコンテンツを利用する場合は、必要な権利・許諾を確認する責任はユーザーにあります。
以下の行為を禁止します。
QUAIAを違法な目的で使用すること
QUAIA FULLの購入制限を不正に回避または無効化すること
法令で認められる場合を除き、QUAIA自体をリバースエンジニアリング、再配布、複製または商業的に利用すること
第三者の権利を侵害する方法でQUAIAを使用すること
アプリの正常な動作またはセキュリティを意図的に妨害すること
QUAIAは、全部または一部の機能について、更新、変更または提供終了を行う場合があります。
すべての機能が将来にわたり永続的に提供されること、または将来のすべての端末・OSで動作することを保証するものではありません。
可能な範囲で互換性および購入済み機能を維持するよう努めます。
適用される法令で認められる範囲において、QUAIAは現状有姿で提供されます。
安定したサービス提供に努めますが、常に中断なく動作すること、不具合が一切発生しないこと、またはすべての特定目的に適合することを保証するものではありません。
適用される法令で認められる最大限の範囲において、QUAIAの利用または利用不能によって生じた間接的、付随的または結果的損害について、開発者は責任を負いません。
ただし、消費者保護法その他の適用法令により排除できないユーザーの権利を制限するものではありません。
AppleのApp Storeを通じてQUAIAを入手した場合、App Storeの利用およびApp Storeを通じた購入には、Appleが定める規約も適用されます。
App Store上の決済処理は、Appleがその規約に従って行います。
QUAIAの機能、ビジネスモデルまたは法令上の必要に応じて、本利用規約を更新する場合があります。
