GENERAL
These terms and conditions ("appterms", "Terms", "Agreement") are an agreement between Mobile Application Developer and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the mobile applications: PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling and any of its products or services (collectively, "Mobile Application" or "Services"). Please review them carefully before installation and/or acceptance
DEFINITIONS
The "Application" shall mean the software provided by PV Solar Forecast & My Solar Panel apps to offer services related to PV Solar Forecast, My Solar Panel, PV Solar Tilt & Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps, to be used on Apple iOS and Android OS devices and any upgrades from time to time and any other software or documentation which enables the use of the Application.
PROPRIETARY RIGHTS AND LICENSE
All trade marks, copyright, database rights and other intellectual property rights of any nature in the Application together with the underlying software code are owned either directly by PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling or by PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps's licensors.
PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps hereby grants you a worldwide, non-exclusive , royalty-free revocable license to use the Application for your business and personal use in accordance with these appterms.
CONDITIONS OF USE
You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Application; (ii) attempt to copy, reproduce, alter, modify ,reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (iii) create derivative works of the Application of any kind whatsoever.
The application is currently made available to you free of charge and a subscription model for your personal, non-commercial use. PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps reserves the right to amend or withdraw the Application, or change for the application or service provided to you in accordance with these appterms, at any time and for any reason.
You acknowledge that the terms of agreement with your respective mobile network provider ("Mobile Provider") will continue to apply when using the Application. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the Application or any such third party charges as may arise. You accept responsibility for any such charges that arise.
If you choose to purchase a subscription, payment will be charged to your Apple or Android account, and your account will be charged within 24-hours prior to the end of the current period. Auto-renewal may be turned off at any time by going to your store settings after purchase.
In addition to other terms as set forth in the Agreement, you are prohibited from using the Mobile Application or its Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related mobile application, other mobile applications, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related mobile application, other mobile applications, or the Internet. We reserve the right to terminate your use of the Service or any related mobile application for violating any of the prohibited uses.
AVAILABILITY
This Application is available to handheld mobile devices running Apple iOS and Android OS Operation Systems. PV Solar Forecast, My Solar Panel, PV Solar Tilt & Solar APP: PV Solar Calculator apps will use reasonable efforts to make the Application available at all times. However you acknowledge the Application is provided over the internet and mobile networks and so the quality and availability of the Application may be affected by factors outside PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator and AirPro: Heating and Cooling's reasonable control.
PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling will not be responsible for any support or maintenance for the Application.
TERMINATION
PV Solar Forecast, My Solar Panel, PV Solar Tilt & Solar APP: PV Solar Calculator, AirPro: Heating and Cooling may terminate use of the Application at any time by giving notice of termination to you.
Upon the termination, (i) the rights and licenses granted to you herein shall terminate; (ii) you must cease all use of the Software;
DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, and for the avoidance of doubt, save for section 2 of the Supply of Goods and Services, Act 1982, PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps hereby disclaim all implied warranties with regard to the Application. The Application and Software are provided "as is" and "as available" without warranty of any kind.
SUBSCRIPTION SERVICE
PV Solar Forecast, My Solar Panel, PV Solar Tilt, Solar APP: PV Solar Calculator, AirPro: Heating and Cooling apps on the App Store and Google Play Store will allow you to obtain the benefit of the Application on a subscription basis. Payment for such subscription (which may be monthly or annual) may be processed in the Application directly by the mobile platform owner (Apple, Google, Huawei). Free trial subscriptions may be canceled at any point up to 24 hours before the expiry of the free trial (Apple) or at any time before the end of the trial period (Google). See bellow (9. Trial Periods) for further information. You can cancel your subscription service at any time during the subscription period via the subscription settings in your iTunes or Android account. The cancelation will take effect after the last day in the relevant subscription period.
TRIAL PERIODS
Certain of the subscription services on the Apple App Store and Google Play Store may from time to time be offered for a fixed period of time on a free-trial basis. You are free to cancel a free-trial period subscription of any time via the subscription settings in your iTunes or Android account. Please note: your free-trial subscription will automatically renew as a paid subscription unless (a) auto-renew is turned off at least 24 hours before the end of the free-trial subscription period (Apple) or (b) you cancel before the end of the free-trial period (Google).
REFUNDS
All charges for purchases are nonrefundable, and there are no refunds or credits for partially use periods. We may make an exception if a refund for subscription offering is requested within fourteen days of the transactions date, or if the laws applicable in your jurisdiction provide for refunds.
For subscribers residing in the EU or European Economic Area, in accordance with local law, you are entitled to a full refund during the 14 days after the subscription begins. Please note that this 14-day period commences when the subscription starts.
Please note and acknowledge: If you are resident in the European Union and download the PV Solar Forecast, My Solar Panel, PV Solar Tilt & Solar APP: PV Solar Calculator, AirPro: Heating and Cooling from a mobile platform (Apple, Google, Huawei), you may not be able to cancel your order or obtain a refund. Please review the mobile platform owner's terms in this regard before purchase. This may apply to subscriptions and in-app purchases.
JURISDICTIONAL ISSUES
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of North Macedonia without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Macedonia. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Macedonia, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
ACCEPTANCE OF THESE APPTERMS
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Mobile Application or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Mobile Application and its Services.
