Acceptance of Terms & Conditions
Binding Agreement: By submitting a booking request, rendering the 50% reservation deposit, or signing the official PV Birding liability waiver, the client explicitly acknowledges, understands, and agrees to be bound by all the Terms and Conditions outlined herein.
Group Bookings: If a single participant is booking on behalf of a family, group, or multiple individuals, the booking party assumes full legal responsibility for sharing these Terms and Conditions with all participating group members. The booking party's acceptance of these terms is legally deemed as acceptance on behalf of the entire traveling party.
Condition of Participation: Agreement to these terms, alongside the completion of the mandatory liability waiver and health disclosure, is a strict prerequisite for participation in any PV Birding excursion. PV Birding reserves the right to refuse service to any participant who declines to accept these operational and safety terms, resulting in the forfeiture of the booking deposit.
Guide Certifications & Operational Safety Limits
Federal Accreditation: Operations are led by Alfonso Langle, a certified Federal Guide under SECTUR NOM-09-TUR-2002 for Specialized Excursionism.
Local Certifications: Officially certified as a Marietas Islands National Park Tour Operator, and certified in First Aid and Ocean Rescue by Protección Civil Puerto Vallarta.
Guide-to-Client Ratio: In strict compliance with federal safety standards for specialized outdoor excursions, the absolute maximum client-to-guide ratio on all trails and routes is 1:8.
Booking & Payment Terms
A 50% deposit, payable securely online via Stripe, is required upon booking to secure calendar dates and private boat charters.
The remaining 50% balance must be paid in full at the start of the tour in cash (Mexican Pesos).
Cancellation Policy & Refunds
Cancellations made more than 14 days prior to departure receive a 100% deposit refund; cancellations within 7 days receive a 50% refund.
Excursions may be canceled or postponed due to unforeseen events or force majeure (e.g., hurricanes, tropical storms, strikes, or terrorist attacks). Booking and guide expenses are non-refundable under these circumstances.
If the lead guide determines the activity is unsafe due to environmental conditions, the trip may be canceled with at least 36 hours' notice, entitling the client to a full refund for unused services.
Mandatory Liability Waiver & Health Disclosures
All participants must complete and sign the official PV Birding liability waiver prior to departure.
Clients are legally required to disclose any pre-existing health conditions (including heart problems, epilepsy, asthma, hypertension, diabetes, or claustrophobia). Participants must confirm they are not pregnant and have not undergone surgery within the past six months.
Participants must not be under the influence of medications, drugs, or alcohol that could impair their judgment or ability to participate safely.
A parent or legal guardian must sign the waiver on behalf of participating minors (aged 3–18) and assumes full, sole responsibility for their supervision at all times.
Any legal disputes arising from participation are subject to the exclusive jurisdiction and competence of the courts located in Tepic, Nayarit, Mexico.
Included Outdoor Adventure Insurance
PV Birding provides personal accident insurance for each participant per trip, underwritten by Chubb Seguros México, S.A..
Coverage is valid 24 hours a day within the national territory of Mexico for both Mexican nationals and foreigners.
The policy covers the amateur practice of ecotourism and adventure activities, including mountaineering, snorkeling, kayaking, and horseback riding; professional or semi-professional practice is explicitly excluded.
Reimbursement for medical expenses resulting from a covered accident is subject to a $15,000.00 MXN deductible.
Direct payment (Pago Directo) to network hospitals is available for emergencies 24/7, provided the medical expense exceeds the contracted deductible and all policy requirements are met.
Claims stemming from pre-existing medical conditions, congenital diseases, injuries sustained under the influence of alcohol or unprescribed drugs, and maternity complications are strictly excluded from coverage.
Age Limitations & Senior Participant Protocol
The contracted Chubb accident policy strictly caps insurable eligibility at age 69 and automatically cancels upon reaching age 70.
Participants Aged 70+: Clients aged 70 and older are required to sign an explicit Waiver of Coverage Addendum acknowledging this limitation. These participants are strictly required to secure their own independent medical evacuation and travel accident insurance prior to joining the expedition.
