## 1. AGREEMENT TO TERMS
By downloading, installing, or using the App — including from the Google Play Store or any other platform — you agree to be bound by these Terms and our Privacy Policy (together, the "Agreements"). Your use of the App is also governed by the applicable terms of the app store from which you download it.
If you do not agree with, or cannot comply with, the Agreements, you must not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
## 2. ABOUT THE SERVICE
Profile 3D is a photo editing application that allows users to transform their photos into stylized cartoon, art, and portrait results using artificial intelligence. The App is provided for personal, aesthetic, and entertainment purposes only.
The results generated by the App are for personal and/or editorial use only. You may not use them for commercial purposes, resale, or redistribution in any way.
## 3. CHANGES TO THESE TERMS
We may modify or replace these Terms at any time, at our sole discretion. Changes become effective upon posting. It is your responsibility to review these Terms periodically. Your continued use of the Service after any change constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you must stop using the Service.
## 4. USE OF THE APP
To use the App, you must download and install it on a compatible device and have an internet connection. You are solely responsible for meeting these requirements and for any related charges, including data and telecommunications fees and required software updates.
## 5. PURCHASES
The Service may offer in-app products or services for purchase ("Purchase"). All payments are processed by the app store (e.g., Google Play) from which you download the App, subject to that store's own terms and payment processing. We do not collect or store your payment card details.
You represent and warrant that (i) you have the legal right to use the payment method you select, and (ii) the information you provide to the app store is true, correct, and complete.
We may use third-party services to facilitate payments. We reserve the right to refuse or cancel an order at any time, including where fraud or an unauthorized or illegal transaction is suspected, or where there is an error in the description or price of a product or service.
## 6. SUBSCRIPTIONS
Some parts of the Service are billed on a subscription basis ("Subscription"). Subscriptions are billed in advance on a recurring basis ("Billing Cycle"), which may be weekly, monthly, or annual, depending on the plan you select.
At the end of each Billing Cycle, your Subscription automatically renews under the same conditions unless you cancel it before the renewal date. You may cancel your Subscription through your Google Play account settings (or the settings of the app store from which you downloaded the App). We do not process subscription cancellations directly.
## 7. FEE CHANGES
We may modify Subscription fees at any time, at our sole discretion. Any fee change will take effect at the end of the then-current Billing Cycle. We will provide reasonable prior notice of any fee change to give you an opportunity to cancel your Subscription before the change takes effect. Your continued use of the Service after the change constitutes your agreement to the modified fee.
## 8. REFUNDS
Subscription fees are generally non-refundable, except as required by applicable law or the refund policy of the app store from which you made the purchase. Refund requests should be submitted through the relevant app store.
## 9. INTELLECTUAL PROPERTY
The Service and its original content, features, and functionality are and will remain the exclusive property of Dark Galaxy Co., Limited and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.
You may not reproduce, distribute, modify, transmit, copy, or otherwise use any content from the Service for commercial purposes without our express prior written permission.
## 10. THIRD-PARTY CONTENT
The Service may include third-party content, including a library of pre-set styles or content ("Pre-sets"). We use such content in accordance with its applicable terms of use and applicable law. We do not claim any rights to third-party content, and you may not use such content except as permitted by applicable law and these Terms.
## 11. USER CONTENT
You may upload photos ("Uploaded Content") and generate results ("Generated Content") through the Service (together, "User Content"). You retain all rights in your User Content, subject to the license you grant below.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, and display your User Content, solely for the purpose of operating, providing, and improving the Service. This license continues for as long as your User Content is stored on the Service.
You warrant that your User Content does not infringe any third-party rights, including intellectual property rights or rights of privacy or publicity, and that you have the right to grant the license above. You are solely responsible for your User Content and for any consequences of posting or sharing it.
You may delete your Uploaded Content from the Service at any time; however, deleting content does not revoke the license granted above for any prior use.
If you share Generated Content publicly, it may be accessible to others and is considered non-confidential and non-proprietary. Do not submit content that you consider confidential or that you do not have the right to share.
## 12. PROHIBITED CONDUCT AND CONTENT
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in violation of any applicable law or regulation;
- Infringe the intellectual property, privacy, or other rights of any third party;
- Upload or share content that is unlawful, defamatory, obscene, abusive, harassing, threatening, racially or ethnically offensive, pornographic, or otherwise objectionable;
- Harm or exploit minors in any way;
- Interfere with, disrupt, or overburden the Service, or attempt to gain unauthorized access to any part of the Service;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Use any robot, spider, scraper, or other automated means to access or copy the Service;
- Introduce viruses, worms, or other malicious or harmful code;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- Engage in any conduct that restricts or inhibits others from using the Service.
We reserve the right, but are not obligated, to remove any User Content that we believe, in our sole discretion, violates these Terms.

- A description of the copyrighted work you claim has been infringed;
- The location (URL) of the allegedly infringing material on the Service;
- Your name, address, telephone number, and email address;

- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We may use third-party services, such as Firebase (a service provided by Google), to monitor and analyze use of the Service. For more information on the data these services collect, please refer to the Google Privacy Policy at https://policies.google.com/privacy.
## 15. NO USE BY MINORS
The Service is intended for users who are at least thirteen (13) years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 13, you are not permitted to access or use the Service.

You agree that we may use any Feedback without obligation of confidentiality or compensation to you, and that we acquire all rights in any Feedback you provide, to the extent permitted by law.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
## 18. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
