# Terms of Service for AutoCam

## 1. Acceptance of Terms
By downloading, installing, or using AutoCam ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and AutoCam ("we," "us," or "our").
## 2. License to Use
### 2.1 Grant of License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the App on your iOS device
- Use the App for personal, non-commercial purposes
- Create and store video recordings using the App
### 2.2 Restrictions
You may NOT:
- ❌ Reverse engineer, decompile, or disassemble the App
- ❌ Modify, adapt, or create derivative works of the App
- ❌ Rent, lease, loan, sell, or distribute the App
- ❌ Use the App for any illegal or unauthorized purpose
- ❌ Remove or alter any proprietary notices or labels
- ❌ Use the App in any way that violates local, state, national, or international laws
## 3. User Responsibilities
### 3.1 Legal Compliance
You are responsible for:
- Complying with all local laws and regulations regarding dashcam usage
- Understanding and following privacy laws related to recording video
- Obtaining necessary consents when recording people or private property
- Using the App only in jurisdictions where dashcams are legal
**Important**: Dashcam regulations vary by country, state, and locality. You are solely responsible for ensuring your use of the App complies with applicable laws.
### 3.2 Safe Usage
You agree to:
- **NEVER operate the App while driving** (set up before driving, review after parking)
- Mount your device securely and safely in your vehicle
- Ensure the App does not obstruct your view while driving
- Not rely solely on the App for accident documentation (it's a supplementary tool)
**DISCLAIMER**: AutoCam is NOT a replacement for safe driving practices, proper insurance, or legal documentation.
### 3.3 Storage Management
You are responsible for:
- Managing your device's storage space
- Regularly backing up important recordings
- Understanding that we are not responsible for lost or corrupted recordings
- Ensuring adequate storage for the App to function properly
## 4. Privacy and Recordings
### 4.1 Your Content
- All video recordings you create belong to you
- We do not claim any ownership of your recordings
- Your recordings are stored locally on your device
- We do not access, view, or upload your recordings to our servers
### 4.2 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
### 4.3 Recording Others
When recording in public or private spaces:
- You may be subject to wiretapping, eavesdropping, or privacy laws
- Some jurisdictions require consent to record audio
- Be aware of privacy expectations in the locations you're recording
- **You are solely responsible** for ensuring your recordings comply with applicable privacy laws
## 5. Subscription and Payments
### 5.1 AutoCam Premium
AutoCam offers an optional premium subscription with additional features:
- **4K Video Quality**: Record in ultra-high definition
- **Extended Loop Recording**: Longer recording segments (up to 10 minutes)
- **Increased Storage Limits**: Store more recordings on your device
### 5.2 Subscription Terms
- Subscriptions are billed through your Apple ID account
- Payment is charged at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
### 5.3 Free Trial
- We may offer a free trial period for new subscribers
- You will be charged when the free trial period ends unless you cancel before it expires
- Cancellation takes effect at the end of the current billing period
### 5.4 Refunds
- All purchases are processed through Apple's App Store
- Refund requests must be made through Apple (Settings > [Your Name] > Media & Purchases > View Account > Purchase History)
- We cannot directly process refunds
- Apple's standard refund policies apply
### 5.5 Price Changes
- Subscription prices may change with 30 days notice
- Price changes take effect at the start of your next billing cycle
- Continuing to use the subscription after a price change constitutes acceptance of the new price
## 6. App Availability and Updates
### 6.1 Service Availability
- We strive to maintain 24/7 app availability
- The App may be temporarily unavailable due to maintenance, updates, or technical issues
- We do not guarantee uninterrupted or error-free operation
- Features may be added, modified, or removed at our discretion
### 6.2 Updates and Modifications
- We may release updates to improve functionality, fix bugs, or add features
- Some updates may be required to continue using the App
- We reserve the right to modify or discontinue features without notice
- Continued use after updates constitutes acceptance of changes
### 6.3 Compatibility
- The App requires iOS 17.0 or later
- Some features require specific hardware (dual-camera support for front+back recording)
- We are not responsible for incompatibility with older devices or iOS versions
## 7. Intellectual Property
### 7.1 Our Rights
AutoCam and all related materials, including:
- App code, design, and user interface
- Logo, graphics, and visual assets
- Documentation and promotional materials
- Algorithms and proprietary technology
are owned by us and protected by copyright, trademark, and other intellectual property laws.
### 7.2 Trademarks
"AutoCam" and our logo are trademarks. You may not use our trademarks without prior written permission.
### 7.3 Feedback
If you provide suggestions, ideas, or feedback:
- We may use your feedback without obligation or compensation
- You grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate your feedback
## 8. Disclaimers and Limitations of Liability
### 8.1 No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, reliability, or completeness
- Warranties that the App will be error-free or uninterrupted
- Warranties that recordings will be preserved or uncorrupted
### 8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are NOT liable for any indirect, incidental, special, or consequential damages
- We are NOT liable for lost profits, lost data, or business interruption
- We are NOT liable for recordings that are lost, corrupted, or fail to record
- We are NOT liable for accidents, injuries, or damages arising from App use
- Our total liability shall not exceed the amount you paid for the App in the last 12 months (or $50 USD, whichever is greater)
### 8.3 No Guarantee of Recording
- The App attempts to record video, but we cannot guarantee successful recording in all situations
- Factors outside our control (storage space, device performance, crashes) may prevent recording
- Critical events may not be captured due to technical limitations
- **You use the App at your own risk**
### 8.4 Third-Party Services
- We are not responsible for third-party services (Firebase, Apple, iCloud)
- Third-party services are governed by their own terms and privacy policies
- Interruptions in third-party services may affect App functionality
## 9. Indemnification
You agree to indemnify, defend, and hold harmless AutoCam, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your recordings or use of recordings
- Any content you create or share through the App
## 10. Termination
### 10.1 Termination by You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling your subscription (if applicable)
### 10.2 Termination by Us
We may suspend or terminate your access if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- We discontinue the App or service
- Required by law or legal process
### 10.3 Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You must delete the App from all devices
- Subscriptions may be canceled, subject to Apple's refund policies
- Provisions that should survive termination (disclaimers, limitations of liability) remain in effect
## 11. Governing Law and Disputes
