This Privacy Policy describes how App Team ("we", "our", or "us") collects,
uses, stores, and shares your information when you use the Vitraa mobile
application ("App") on iOS and Android devices.
By downloading, installing, or using Vitraa, you agree to the practices
described in this Privacy Policy. If you do not agree, please do not use
the App.

1. INFORMATION WE COLLECT

1.1 INFORMATION YOU PROVIDE DIRECTLY
(a) Nickname
You may optionally provide a nickname during onboarding. This is
stored only on your device and is never transmitted to our servers.
(b) Health & Fitness Data
You may log habits, calorie intake, food entries, sleep logs,
and workout sessions. This data is:
- Stored locally on your device only
- Not transmitted to App Team servers
- Not shared with any third party for marketing or advertising
(c) Body Metrics (Optional)
Age, weight, height, and gender entered during BMR setup are stored
locally on your device and used only to calculate your personal
calorie goal. This data stays on your device.
1.2 INFORMATION COLLECTED AUTOMATICALLY
(a) Device Information
Basic device type, operating system version, and app version may be
collected by third-party SDKs (see Section 3). App Team does not
directly collect device identifiers.
(b) App Usage & Crash Data
Firebase Crashlytics and Firebase Analytics (Google) collect crash
logs, error reports, and general usage events (e.g., screens viewed,
features used) to help us improve the App. This data is anonymised
where possible.
(c) Advertising Identifiers
Google AdMob may collect your device's advertising identifier (GAID
on Android, IDFA on iOS after ATT consent) to serve relevant ads.
On iOS, we request App Tracking Transparency (ATT) permission before
any advertising identifier is accessed. You may decline.
(d) Purchase Data
If you subscribe to Vitraa Pro, your purchase is processed by Apple
App Store or Google Play Store. We receive only confirmation that a
valid subscription exists. We do not receive your payment card details.
1.3 INFORMATION WE DO NOT COLLECT
- We do not collect your name, surname, email address, or phone number
- We do not collect precise or background location data
- We do not collect contacts, messages, or call logs
- We do not require account creation or login
- We do not use your health data for advertising purposes
- We do not sell your personal data to any third party

2. HOW WE USE YOUR INFORMATION

We use the limited information we collect solely for these purposes:
(a) To operate and provide the App's features (habit tracking, calorie
logging, sleep tracking, workout timer)
(b) To calculate your personal calorie goal using BMR (Mifflin-St Jeor)
(c) To deliver on-device AI predictions (streak risk, optimal bedtime,
calorie anomaly detection, workout rest adjustment) — all processing
happens on your device only
(d) To display advertisements through Google AdMob (free tier users)
(e) To process in-app subscriptions via Apple App Store or Google Play
(f) To identify and fix bugs and crashes via Firebase Crashlytics
(g) To understand how the App is used and improve it via Firebase Analytics
(h) To send local push notifications for habit reminders, bedtime alerts,
and workout reminders — all triggered locally on your device
We do not use your health or fitness data for any advertising purpose.
We do not use your data to make automated decisions that affect your legal
rights.

3. THIRD-PARTY SERVICES AND SDKs
─────────────────────────────────────────────────────────────────────────────
Vitraa integrates the following third-party services. Each operates under
its own privacy policy, which we encourage you to review.
Google AdMob (Google LLC)
Used for advertising. It may collect advertising ID, IP address, device information, and ad interaction data. On iOS, App Tracking Transparency (ATT) consent is required. On Android, it uses the Google Advertising ID (GAID).
Firebase Analytics (Google LLC)
Used for app usage analytics. It collects anonymised usage events, device type, operating system version, and session data. It does not collect health data.
Firebase Crashlytics (Google LLC)
Used for crash reporting. It collects crash logs, stack traces, and device state at the time of a crash. It does not collect health data.
Firebase Remote Config (Google LLC)
Used to control app behaviour remotely. It does not collect any personal data.
Google Play Billing (Google LLC)
Used for Android subscription processing. All purchase details are handled by Google. The app only receives confirmation of subscription status.
Apple StoreKit 2 (Apple Inc.)
Used for iOS subscription processing. All purchase details are handled by Apple. The app only receives confirmation of subscription status.
Open Food Facts (OpenFoodFacts.org)
Used as a food database. When you search by name or barcode, your search terms are sent to their servers. No personal identity is transmitted.
USDA FoodData Central (U.S. Government)
Used as a fallback food database. Similar to Open Food Facts, only search terms are sent, and no personal identity is transmitted.
Google Play In-App Review (Google LLC)
Used to display the Play Store review prompt within the app. No data is collected by the app through this service.
All network communications use HTTPS encryption.

4. DATA STORAGE AND RETENTION
─────────────────────────────────────────────────────────────────────────────
4.1 LOCAL STORAGE
All health and fitness data you enter (habits, calories, sleep logs,
workout sessions, body metrics) is stored exclusively on your device
using encrypted local storage (SharedPreferences on Android, UserDefaults
on iOS). This data does not leave your device unless you explicitly share
it using your device's share function.
4.2 RETENTION PERIOD
- Your app data persists on your device until you delete it within the
App or uninstall the App.
- Crash and analytics data collected by Firebase is retained by Google
for up to 14 months per Google's standard retention policy.
- Advertising data is subject to Google's retention policies.
4.3 DATA DELETION
You may delete all your data at any time:
- Within the App: Settings → Delete All My Data
- By uninstalling the App from your device
To request deletion of any data held by third-party services, please
contact those services directly using the links in Section 3.
4.4 INTERNATIONAL DATA TRANSFER
Your locally stored data does not transfer internationally. However,
Firebase (Google) and AdMob (Google) may process analytics and advertising
data on servers located outside India, including in the United States,
under applicable data protection frameworks and standard contractual clauses.

5. ADVERTISING
─────────────────────────────────────────────────────────────────────────────
5.1 FREE TIER
Free users see ads served by Google AdMob. These may include:
- App Open Ads
- Interstitial Ads (full-screen)
- Native Ads (blended with content)
- Rewarded Ads (optional, user-initiated)
5.2 VITRAA PRO
Subscribers to Vitraa Pro do not see advertisements.
5.3 APP TRACKING TRANSPARENCY (iOS)
On iOS 14.5 and later, we request your permission via Apple's ATT
framework before accessing your IDFA for personalised advertising.
If you decline, you will still see ads, but they will not be
personalised based on your activity across other apps.
5.4 AD PERSONALISATION (ANDROID)
On Android, Google may use your GAID for personalised ads. You can
opt out through your device settings: Settings → Google → Ads →
"Opt out of Ads Personalisation".
5.5 HEALTH DATA AND ADS
As required by Apple App Store guidelines and our commitment to users:
your health and fitness data collected within Vitraa is never used
for advertising purposes and is never shared with advertisers.

6. CHILDREN'S PRIVACY
─────────────────────────────────────────────────────────────────────────────
Vitraa is not directed to children under the age of 13 (or under 16 in
the European Union / European Economic Area). We do not knowingly collect
personal data from children under these ages.
If we become aware that we have inadvertently collected data from a child
under the applicable age, we will take steps to delete that information
promptly. If you believe we have collected data from a child, please contact
us at support.appteam204@gmail.com.
Parents or guardians who believe their child has used the App should contact
us immediately.
[COPPA — United States]: We do not knowingly collect data from children
under 13. The App is not targeted at children.
[GDPR — European Union]: The App is not directed at users under 16 years
of age in the EU/EEA.

7. YOUR RIGHTS AND CHOICES

7.1 ALL USERS
You have the following rights regarding your data:
(a) Access: You can view all data you have entered in the App at any time.
(b) Correction: You can edit or correct any data you have logged.
(c) Deletion: You can delete all data via Settings → Delete All My Data.
(d) Notification Control: You can manage or disable notifications via
your device settings at any time.
(e) Ad Preferences: You can adjust ad personalisation via device settings
(see Section 5.3 and 5.4).
7.2 EUROPEAN UNION / EEA — GDPR RIGHTS
If you are located in the EU/EEA, you have these additional rights
under the General Data Protection Regulation (GDPR):
(a) Right to Access: Request confirmation of what personal data we process.
(b) Right to Rectification: Request correction of inaccurate data.
(c) Right to Erasure ("Right to be Forgotten"): Request deletion of
personal data we hold.
(d) Right to Restriction of Processing: Request we limit how we use
your data in certain circumstances.
(e) Right to Data Portability: Receive your personal data in a structured,
machine-readable format.
(f) Right to Object: Object to processing based on legitimate interests.
(g) Right to Withdraw Consent: Withdraw consent at any time where
processing is based on consent, without affecting prior processing.
(h) Right to Lodge a Complaint: You may file a complaint with your local
data protection authority (e.g., your national supervisory authority).

7.3 CALIFORNIA RESIDENTS — CCPA / CPRA RIGHTS
If you are a California resident, you have these rights under the
California Consumer Privacy Act (CCPA) as amended by the CPRA:
(a) Right to Know: What personal information we collect, use, share,
or sell, and for what purpose.
(b) Right to Delete: Request deletion of personal information we hold.
(c) Right to Opt-Out of Sale/Sharing: We do not sell personal data.
We do not share personal data for cross-context behavioural advertising
beyond what AdMob provides (which you can opt out of as described
in Section 5).
(d) Right to Non-Discrimination: We will not discriminate against you
for exercising your CCPA rights.
(e) Right to Correct: Request correction of inaccurate personal information.
(f) Right to Limit Use of Sensitive Personal Information: Health-related
data is stored locally on your device and not processed by us.

7.4 INDIA — DPDP ACT 2023 / DPDP RULES 2025
If you are an Indian resident, you have rights under India's Digital
Personal Data Protection Act, 2023 and the DPDP Rules, 2025
(effective November 13, 2025, full enforcement by May 13, 2027):
(a) Right to Access: Obtain a summary of personal data processed and
the purposes for processing.
(b) Right to Correction and Erasure: Request correction of inaccurate
or incomplete data, or erasure of data no longer required for its
stated purpose.
(c) Right to Grievance Redressal: File a complaint with us or with the
Data Protection Board of India.
(d) Right to Nominate: Nominate another person to exercise these rights
on your behalf in case of death or incapacity.
(e) Right to Withdraw Consent: Withdraw your consent at any time.
Processing based on such consent will cease thereafter.
We will respond to all data principal requests within 90 days, as
required by the DPDP Act.

8. DATA SECURITY
─────────────────────────────────────────────────────────────────────────────
We take the security of your data seriously. Measures in place include:
- All health and fitness data is stored locally on your device only
- All network communications use HTTPS (TLS 1.2 or higher)
- Third-party SDKs are vetted for their own security practices
- No passwords or payment credentials are stored by App Team
- App binary is protected with code obfuscation and ProGuard (Android)
However, no method of storage or transmission is 100% secure. In the event
of a data breach affecting your personal data, we will notify you as required
by applicable law — within 72 hours where GDPR applies, promptly under
DPDP Act requirements.

9. CAMERA AND DEVICE PERMISSIONS

Vitraa requests the following device permissions:
CAMERA
Used solely to scan food barcodes via the barcode scanner feature.
No images or video are captured or stored by the App.
Camera data is processed locally on your device.
POST_NOTIFICATIONS (Android 13+) / NOTIFICATION PERMISSION (iOS)
Used to send local reminders for habits, sleep, and workout sessions.
All notifications are scheduled locally on your device.
No notification data is transmitted to external servers.
HEALTH DATA (iOS HealthKit / Android Health Connect) — Optional
If you grant access, we may read step count and sleep data.
This data is displayed in the App only and is never transmitted externally.
You may revoke this permission at any time via device settings.
INTERNET
Required for: food database search, AdMob ads, Firebase analytics/crashlytics,
subscription validation, and Firebase Remote Config.

10. IN-APP PURCHASES AND SUBSCRIPTIONS
─────────────────────────────────────────────────────────────────────────────
Vitraa offers optional paid subscriptions (Vitraa Pro):
- Monthly plan: $4.99 USD / month (or equivalent local currency)
- Yearly plan: $49.99 USD / year (or equivalent local currency)
All payments are processed exclusively by:
- Apple App Store (iOS) — governed by Apple's Terms of Service
- Google Play Store (Android) — governed by Google's Terms of Service
App Team does not receive, process, or store any payment card details.
Subscriptions automatically renew unless cancelled at least 24 hours before
the end of the current period.
To manage or cancel subscriptions:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play → Profile → Payments & subscriptions
Promotional trials (24-hour and 7-day free Pro access) are offered within
the App. These trials do not require a credit card. After the trial ends,
the App reverts to free tier. No automatic charge occurs.

HealthKit:
Vitraa may request read access to HealthKit (steps, sleep) if you grant
permission. This data is:
- Never sold, shared, or used for marketing
- Used only to enhance your in-app experience
- Never disclosed to third parties for advertising
App Tracking Transparency:
On iOS 14.5+, Vitraa requests ATT permission before tracking your activity
across apps for advertising. You may decline without affecting core features.

PLEASE READ THESE TERMS AND CONDITIONS ("Terms") CAREFULLY BEFORE USING THE
VITRAA APPLICATION. BY DOWNLOADING, INSTALLING, OR USING VITRAA, YOU CONFIRM
THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.
These Terms constitute a legally binding agreement between you ("User", "you")
and App Team ("we", "our", "us"), the developer of Vitraa.

1. ABOUT THE APP
─────────────────────────────────────────────────────────────────────────────
1.1 Vitraa is a personal health and lifestyle tracking application that
provides four core modules:
- Habit Tracker (streak tracking, reminders, AI risk prediction)
- Calorie Counter (food logging, barcode scanning, macro tracking)
- Sleep Tracker (sleep score, AI bedtime prediction, sleep debt)
- Workout Timer (HIIT, Tabata, AMRAP, EMOM intervals with audio cues)
1.2 The App is available on:
- iOS devices (iPhone) via the Apple App Store
- Android devices via the Google Play Store
1.3 The App is available in two tiers:
- Free Tier: Full core features with advertisement support
- Vitraa Pro: Ad-free experience with additional features via paid
subscription or promotional free trial

2. ELIGIBILITY AND AGE REQUIREMENTS
─────────────────────────────────────────────────────────────────────────────
2.1 You must be at least 13 years of age (or 16 years of age if you are
located in the European Union / EEA) to use Vitraa.
2.2 If you are between 13 and 18 years of age (a minor in most jurisdictions),
you must have the consent of a parent or legal guardian to use the App.
2.3 By using the App, you represent and warrant that you meet the applicable
age requirement and, if you are a minor, that your parent or guardian
has consented to your use.
2.4 We do not knowingly permit use by children under 13. If we discover that
a child under 13 has used the App, we will take steps to remove their
data. Please contact us at support.appteam204@gmail.com if you believe
a child under 13 is using the App.
2.5 Certain in-app purchase features are only available to users who are at
least 18 years old or have reached the legal age for entering contracts
in their jurisdiction.

3. ACCOUNT AND ACCESS
─────────────────────────────────────────────────────────────────────────────
3.1 Vitraa does not require account creation. The App operates without
a username, password, or cloud account. All data is stored locally
on your device.
3.2 You are responsible for maintaining the security and access to your
device. We are not responsible for any loss arising from unauthorised
access to your device.
3.3 Because no account exists, data is tied to your device. Uninstalling the
App or deleting app data will permanently delete all your Vitraa data.
We cannot recover this data for you.

4. LICENCE TO USE
─────────────────────────────────────────────────────────────────────────────
4.1 Subject to your compliance with these Terms, App Team grants you a
limited, non-exclusive, non-transferable, revocable licence to download,
install, and use the App on your personal device solely for your personal,
non-commercial purposes.
4.2 This licence does not allow you to:
(a) Copy, modify, distribute, sell, or lease any part of the App
(b) Reverse engineer, decompile, or disassemble the App, except as
permitted by applicable law
(c) Use the App for any commercial purpose without our prior written consent
(d) Use the App to develop a competing product or service
(e) Remove or alter any proprietary notices or labels on the App
(f) Use automated scripts, bots, or scraping tools with the App
(g) Interfere with or disrupt the App or servers connected to the App
(h) Circumvent, disable, or otherwise interfere with security features
4.3 All rights not expressly granted are reserved by App Team.

5. IN-APP PURCHASES AND SUBSCRIPTIONS
─────────────────────────────────────────────────────────────────────────────
5.1 SUBSCRIPTION PLANS
Vitraa offers the following auto-renewing subscription options:
- Monthly Plan: $4.99 USD per month (or local currency equivalent)
- Yearly Plan: $49.99 USD per year (or local currency equivalent)
Prices may vary by country and are set by the applicable App Store.
5.2 FREE TRIALS
We may offer promotional free trials (e.g., 24-hour or 7-day Pro access).
These trials:
- Do not require a credit card or payment
- Are activated within the App through a promotional offer
- Are not the same as App Store or Play Store trial subscriptions
- Automatically expire after the stated period
- Do not auto-charge or convert to a paid subscription
5.3 SUBSCRIPTION BILLING
- Subscriptions are billed through Apple App Store (iOS) or Google Play
Store (Android). App Team does not process payment directly.
- Payment is charged to your App Store / Play Store account at confirmation.
- Subscriptions automatically renew unless cancelled at least 24 hours
before the end of the current billing period.
- Renewal charges the same amount as the current subscription price.
5.4 CANCELLATION
To cancel your subscription:
- iOS: Settings → [Your Name] → Subscriptions → Vitraa → Cancel
- Android: Google Play → Profile → Payments → Subscriptions → Vitraa → Cancel
Cancellation takes effect at the end of the current billing period.
No partial refunds are issued for unused portions of a billing period,
except where required by applicable consumer law.
5.5 REFUNDS
Refund requests are subject to the policies of the respective App Store:

App Team does not control or process refunds. For refund requests,

5.6 PRICE CHANGES
We reserve the right to change subscription prices with reasonable
notice. Price changes will take effect at the next renewal period.
5.7 FAILED PAYMENTS
If a subscription payment fails, access to Vitraa Pro features may
be suspended. We will notify you via the relevant App Store process.

Vitraa Pro includes:

- Sleep debt tracker
- Full exercise library access
- AI-powered weekly reports
- Custom workout timer presets
Features may be updated from time to time.

6. ADVERTISEMENTS
─────────────────────────────────────────────────────────────────────────────
6.1 The free tier of Vitraa is supported by advertisements served by
Google AdMob. Advertisements may appear as:
- App Open Ads (displayed when launching the App)
- Interstitial Ads (full-screen, between screens)
- Native Ads (embedded within the App interface)
- Rewarded Ads (optional, user-initiated in exchange for a benefit)
6.2 Vitraa Pro subscribers do not receive advertisements.
6.3 App Team does not endorse any advertised products or services. We are
not responsible for the content, accuracy, or practices of advertisers.
6.4 Rewarded ads are optional and voluntarily initiated by you. The reward
(temporary feature access) is granted by the App upon verified ad
completion as confirmed by Google AdMob.
6.5 On iOS, we request ATT permission before serving personalised ads.
You may decline without losing access to the App's core features.

7. HEALTH DISCLAIMER — IMPORTANT

7.1 Vitraa is a general wellness and lifestyle tracking tool. It is NOT
a medical device, medical application, or healthcare service.
7.2 The information provided by Vitraa (including calorie goals, sleep
scores, AI predictions, BMR calculations, workout suggestions) is for
general informational and motivational purposes only. It is NOT:
- Medical advice
- A substitute for professional medical advice, diagnosis, or treatment
- Designed to diagnose, treat, cure, or prevent any disease or condition
7.3 ALWAYS seek the advice of your physician, registered dietitian, or
other qualified health professional before:
- Beginning any diet, calorie restriction, or nutrition programme
- Starting a new exercise or workout regimen
- Making decisions based on sleep or biometric data in the App
- Using the App if you have any existing health condition
7.4 Never disregard professional medical advice or delay seeking it because
of something you have read or seen in Vitraa.
7.5 Calorie calculations use the Mifflin-St Jeor BMR formula with a standard
activity multiplier. These are estimates only. Individual metabolic needs
vary significantly. Consult a registered dietitian for personalised advice.
7.6 AI-based predictions in the App (streak risk, bedtime suggestion, calorie
anomaly, workout rest adjustment) are generated entirely on-device using
simple statistical models based on your logged data. They are NOT
clinically validated and should not be relied upon for medical decisions.
7.7 App Team is not liable for any health outcomes, injuries, or adverse
effects resulting from your use of the App. Users with eating disorders,
cardiovascular conditions, sleep disorders, or other medical conditions
should use this App only with the guidance of a qualified healthcare
professional.
7.8 If you are experiencing a medical emergency, call your local emergency
services immediately. Do not use this App in place of emergency care.
7.9 REGULATORY NOTE: This App is not regulated as a medical device under:
- US FDA (21 CFR Part 880)
- EU Medical Device Regulation (MDR 2017/745)
- Central Drugs Standard Control Organisation (CDSCO), India

8. USER CONDUCT

(b) To transmit any unsolicited or unauthorised advertising material
(c) To attempt to gain unauthorised access to any part of the App
(d) In any way that could damage, disable, or impair the App
(e) To collect or harvest any personal information from other users
(f) To interfere with other users' enjoyment of the App
8.3 Violations may result in immediate termination of your access to the App.

9. INTELLECTUAL PROPERTY

9.1 The App and all its content, features, and functionality — including but
not limited to the software code, design, logos, text, graphics, and
the "Code DNA" visual design system — are owned by App Team and are
protected by applicable intellectual property laws.
9.2 "Vitraa" is the name of our App. All rights are reserved.
9.3 You may not use our name, logo, or branding without our prior written
consent.
9.4 The App uses third-party open-source libraries and APIs (including
Open Food Facts, USDA FoodData Central, Google SDKs, and others).
These are subject to their own licences. We comply with the requirements
of all open-source licences used.
9.5 User-entered data (habits, food logs, sleep logs, workout data) is YOUR
data. You retain ownership of the data you input. By entering data into
the App, you grant App Team no licence to that data beyond what is
necessary to display it back to you on your device.

10. DISCLAIMER OF WARRANTIES

10.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF
ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
10.2 We do not warrant that:
(a) The App will be uninterrupted, timely, secure, or error-free
(b) Any defects in the App will be corrected
(c) The App or its servers are free of viruses or other harmful components
(d) Results obtained from use of the App will be accurate or reliable
10.3 JURISDICTION-SPECIFIC CONSUMER RIGHTS:
Some jurisdictions do not allow the exclusion of implied warranties.
Where prohibited by applicable consumer law (e.g., Australian Consumer
Law, UK Consumer Rights Act 2015, EU Consumer Rights Directive, Indian
Consumer Protection Act 2019), the above exclusions apply only to the
maximum extent permitted by law.

11. LIMITATION OF LIABILITY

- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
- DAMAGES ARISING FROM HEALTH DECISIONS MADE BASED ON THE APP
- DAMAGES ARISING FROM LOSS OF APP DATA DUE TO DEVICE FAILURE OR
UNINSTALLATION
11.2 In no event shall App Team's total liability to you exceed the amount
you have paid to App Team in the 12 months preceding the claim (or
USD $10 / INR 840 if you have made no payments).
11.3 The limitations above apply whether the claim is based on warranty,
contract, tort (including negligence), or any other legal theory.
11.4 JURISDICTION-SPECIFIC NOTE:
Some jurisdictions (including the EU, UK, Australia, and India) do not
allow limitation of liability for personal injury, death, fraud, or
statutory consumer rights. In those jurisdictions, the above limitations
apply only to the fullest extent permitted by law.
11.5 App Team is not responsible for any failure to perform obligations under
these Terms where such failure results from circumstances beyond our
reasonable control (force majeure), including but not limited to natural
disasters, pandemic, government action, or third-party service failures.

12. INDEMNIFICATION

12.1 You agree to defend, indemnify, and hold harmless App Team and its
directors, employees, contractors, and agents from and against any

reasonable legal fees) arising from:
(a) Your use or misuse of the App
(b) Your violation of these Terms
(c) Your violation of any applicable law or third-party rights
(d) Any content or data you submit to the App

13. THIRD-PARTY SERVICES AND LINKS

13.1 The App integrates third-party services (Google AdMob, Firebase, Open
Food Facts, USDA, Apple StoreKit, Google Play Billing). Your use of
those services is governed by their respective terms and privacy policies.
App Team is not responsible for third-party service availability,
accuracy, or practices.
13.2 Apple App Store / Google Play Store terms apply to your download and
installation of the App. Your relationship with Apple Inc. or Google LLC
is governed by their respective terms of service.
13.3 Apple Inc. is not a party to these Terms and is not responsible for the
App or its content. Any claims relating to the App must be directed to
App Team, not Apple.
13.4 Google LLC is not a party to these Terms and bears no responsibility
for the App's content or your use of it.

14. AVAILABILITY AND UPDATES

14.1 We aim to keep the App operational and available, but we do not guarantee
continuous or uninterrupted availability.
14.2 We reserve the right to modify, suspend, or discontinue the App (or any
feature) at any time, with or without notice. We will endeavour to provide
reasonable advance notice for significant changes.
14.3 We may release updates to the App from time to time. We recommend keeping
the App updated to benefit from bug fixes, security patches, and new features.
Some older versions of the App may cease to function after a significant
update.
14.4 We reserve the right to require minimum OS versions for the App to function.
The App currently supports iOS 15+ and Android 8.0 (API 26)+.

15. TERMINATION
─────────────────────────────────────────────────────────────────────────────
15.1 These Terms are effective from the date you first use the App and continue
until terminated.
15.2 You may terminate these Terms at any time by uninstalling the App from
your device. This will delete all locally stored App data.
15.3 We may terminate or suspend your access immediately and without notice if:
(a) You violate any provision of these Terms
(b) We are required to do so by law
(c) We decide to discontinue the App
15.4 Upon termination, all licences granted to you under these Terms cease.
All provisions of these Terms that by their nature should survive
termination shall survive, including Sections 7, 9, 10, 11, 12, and 16.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 PRIMARY GOVERNING LAW
These Terms shall be governed by and construed in accordance with the
laws of India, without regard to conflict of law principles.
The courts of Surat, Gujarat, India shall have primary jurisdiction
over any dispute arising from or relating to these Terms or the App.
16.2 INFORMAL RESOLUTION
Before initiating any formal legal proceedings, we encourage you to
contact us at support.appteam204@gmail.com. We will make good-faith
efforts to resolve disputes within 30 days.
16.3 ARBITRATION (INDIA)
For users in India, if informal resolution fails, disputes shall be
referred to arbitration under the Arbitration and Conciliation Act, 1996
(India), as amended. The seat of arbitration shall be Surat, Gujarat.
The arbitration shall be conducted in English.
16.4 JURISDICTION-SPECIFIC PROVISIONS
European Union / EEA Users:
Nothing in these Terms affects your rights as a consumer under EU law.
Specifically:
- EU consumers retain the benefit of mandatory provisions of the law
of their country of residence
- EU consumers may bring proceedings in the courts of their country
of residence
- The European Commission's Online Dispute Resolution platform is
available at: https://ec.europa.eu/consumers/odr
United Kingdom Users:
For UK consumers, you may bring proceedings in the courts of England,
Wales, Scotland, or Northern Ireland (as applicable). UK mandatory
consumer law provisions apply.
United States Users:
For California residents, nothing in these Terms waives your rights
under California consumer protection laws. For disputes under $10,000
USD, either party may elect binding arbitration (AAA Consumer Rules).
Australian Users:
Australian Consumer Law guarantees cannot be excluded. Nothing in
these Terms limits your rights under the Competition and Consumer
Act 2010 (Cth).
16.5 CLASS ACTION WAIVER
To the maximum extent permitted by applicable law, you agree to resolve
disputes with App Team on an individual basis only. You waive the right
to participate in class action lawsuits or class-wide arbitration.
This waiver does not apply where prohibited by law (e.g., certain EU
consumer protection laws).
16.6 TIME LIMITATION
Any claim arising from these Terms must be brought within one (1) year
from the date the cause of action arose, to the extent permitted by law.

- You may withdraw consent at any time
- You may seek correction or erasure of your personal data

18.4 EUROPEAN UNION — Consumer Rights Directive
EU consumers who are individuals (not businesses) have the right to
withdraw from a subscription within 14 days of purchase unless they
have explicitly consented to immediate performance (which is typically
required to access digital content immediately).
18.5 AUSTRALIA — Australian Consumer Law
The App comes with guarantees that cannot be excluded under the
Australian Consumer Law. You are entitled to a replacement or refund
for a major failure and compensation for any other reasonably foreseeable

18.6 UNITED KINGDOM — Consumer Rights Act 2015
UK consumers are entitled to digital content that is of satisfactory
quality, fit for purpose, and as described. Your statutory rights
are not affected by these Terms.

19. CHANGES TO THESE TERMS

19.1 We reserve the right to modify these Terms at any time. Material changes

19.2 Your continued use of the App after the effective date of revised Terms
constitutes your acceptance of the changes.
19.3 If you do not agree to the revised Terms, you must stop using the App
and uninstall it from your device.
19.4 Where required by law (e.g., EU), material changes will be communicated
with at least 30 days' notice.

20. MISCELLANEOUS

20.1 ENTIRE AGREEMENT

20.2 SEVERABILITY
If any provision of these Terms is found to be unenforceable, that
provision will be modified to the minimum extent necessary to make it
enforceable, and the remaining provisions will continue in full force.
20.3 WAIVER
Our failure to enforce any right or provision of these Terms does not
constitute a waiver of that right or provision.
20.4 ASSIGNMENT
You may not assign these Terms or any rights or obligations without our
prior written consent. We may assign these Terms freely.
20.5 NO PARTNERSHIP
Nothing in these Terms creates a partnership, joint venture, agency,
franchise, or employment relationship between you and App Team.
20.6 LANGUAGE
These Terms are written in English. In the event of any inconsistency
between any translated version and the English version, the English
version shall prevail.
20.7 APPLE ADDITIONAL TERMS (iOS Users)
The following terms apply to your use of the App obtained from the
Apple App Store:
(a) These Terms are between you and App Team, not between you and Apple.
(b) Apple has no obligation to provide maintenance or support for the App.
(c) In the event of any product liability claim, Apple bears no
responsibility. App Team is responsible.
(d) Apple is a third-party beneficiary of these Terms with the right
to enforce them against you as a third-party beneficiary.
(e) You represent that you are not located in a country subject to a
US government embargo or designated as a terrorist-supporting country,
and that you are not on any US government prohibited or restricted list.
20.8 GOOGLE PLAY ADDITIONAL TERMS (Android Users)
The following terms apply to your use of the App obtained from Google Play:
(a) These Terms are between you and App Team. Google is not a party.
(b) Google has no obligation to provide warranty, maintenance, or support.
(c) Google is not responsible for claims relating to the App.
(d) You must comply with applicable third-party terms when using the App.
