By downloading, installing, or using the Guardian mobile application (“the App”), developed by The Blind Aid Project (“we”, “us”, or “our”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the App.
These Terms form a legally binding agreement between you and The Blind Aid Project regarding your use of Guardian.
Guardian is a mobile safety and monitoring application designed to function as a companion to the Blind Aid hardware device. The App enables caregivers and guardians to monitor individuals by receiving location updates and safety alerts transmitted from the device via SMS.
The App provides features such as real-time location display, geofence boundary monitoring, alert notifications, and SMS-based communication with the hardware device. Its functionality depends on proper interaction between the mobile application, the hardware device, and mobile network services.
Guardian relies on SMS communication as a core part of its operation. By using the App, you acknowledge that SMS functionality is essential for communication between the App and the Blind Aid device. Without SMS capability, key features such as location tracking and alert notifications will not function.
You are responsible for any charges imposed by your mobile network provider, including SMS and data fees incurred through the use of the App or the associated hardware device. The Blind Aid Project does not control and is not responsible for such charges.
The performance of the App depends on the availability and reliability of mobile network services. We do not guarantee uninterrupted or error-free operation and are not responsible for delays, failures, or inaccuracies caused by poor signal strength, network outages, or insufficient SMS credit on the mobile device or hardware unit.
Guardian is intended to serve as a supportive monitoring tool for caregivers and guardians. It is not designed to replace professional medical care, emergency response systems, or direct human supervision.
While the App provides safety alerts and location tracking, it should not be relied upon as the sole means of ensuring the safety or well-being of any individual. In emergency situations, users must contact appropriate local emergency services immediately.
Guardian is specifically developed to operate with the Blind Aid hardware device. We do not guarantee compatibility with third-party devices or systems.
Proper functionality requires that the hardware device is powered on, has adequate GPS signal access, and is equipped with a valid SIM card that has active SMS capability. Any malfunction or misconfiguration of the hardware may affect the performance of the App.
By using Guardian, you agree to use the App responsibly and in compliance with all applicable laws and regulations. You are responsible for ensuring that any individual being monitored has provided appropriate consent where required by law.
You agree to provide accurate and up-to-date information, including phone numbers associated with the hardware device and guardian accounts. You are also responsible for maintaining the security of your mobile device and preventing unauthorized access to the App.
The App must not be used for unlawful tracking, surveillance without consent, or any activity that violates privacy or legal rights.
To the maximum extent permitted by applicable law, The Blind Aid Project shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App.
This includes, but is not limited to, inaccuracies in location data, failure to receive alerts, delays in communication, network-related issues, hardware malfunctions, or any injury, loss, or damage resulting from reliance on the App.
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
Your use of Guardian is also governed by our Privacy Policy, which explains how we collect, use, and protect your data, including SMS-derived information and location data. By using the App, you agree to the terms outlined in the Privacy Policy.
We reserve the right to modify, update, suspend, or discontinue the App or any of its features at any time without prior notice.
We may also revise these Terms and Conditions periodically. Continued use of the App after any updates constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in misuse of the service.
