Driving Theory Test is an independent educational study preparation
application. It is NOT affiliated with, endorsed by, sponsored by,
or connected to any government body, department of motor vehicles
(DMV), department of licensing (DOL), Driver and Vehicle Standards
Agency (DVSA), VicRoads, Transport for NSW, SAAQ, ICBC, Revenue NSW,
Service Alberta, or any other government agency or motor vehicle
authority in any country worldwide. Use of the terms "DMV", "driving
test", "theory test", or similar terms is purely descriptive of the
subject matter covered and does not imply any official relationship
or endorsement. For official licensing requirements, laws, and
examinations, always contact your local official motor vehicle
authority directly.
1. ACCEPTANCE OF TERMS
------------------------
By downloading, installing, accessing, or using the Driving Theory
Test application ("App"), you ("User", "you") agree to be bound by
these Terms and Conditions ("Terms"). If you do not agree to these
Terms, do not use the App.
These Terms constitute a legally binding agreement between you and
App Team ("we", "us", "our"), the developer of the App.
Users under the age of 13 (or 16 in the European Economic Area) must
obtain consent from a parent or legal guardian before using the App.
2. DESCRIPTION OF THE APP

Driving Theory Test is an educational mobile application designed to
help users prepare for government-administered written driving tests.
The App provides:
- Practice questions based on publicly available official driver
handbooks from various US states and jurisdictions
- Timed mock exam simulations
- Road signs visual quiz
- Automatic weak topic tracking and re-testing
- Study progress tracking
- Vehicle type categories: Car, Motorcycle, CDL, Boating, Moped
- Optional premium subscription to unlock additional content
and remove advertisements
The App is a study tool only. Completion of practice tests within the
App does not guarantee passing any official government examination.
3. EDUCATIONAL PURPOSE AND ACCURACY DISCLAIMER

3.1 Study Tool Only
The App is designed as a supplementary study aid. It is not a
substitute for reading your official state or jurisdiction driver
handbook, attending an accredited driving school, or any other
official preparation method.
3.2 No Guarantee of Passing
We make no representation, warranty, or guarantee that use of the App
will result in passing any official government driving examination.
Pass rates depend on many factors beyond the scope of this App
including individual effort, study time, and the specific examination
administered.
3.3 Content Accuracy
Questions and content in the App are based on publicly available
official driver handbooks as of the date indicated. Driving laws,
regulations, and examination formats may change. It is your
responsibility to verify current requirements with your official
motor vehicle authority before your examination.
3.4 Not Official Content
The practice questions in this App are not official government
examination questions and are not sourced from or licensed by any
government agency. Similarity to official exam questions, where it
occurs, is a result of both being based on the same publicly
available handbook content.
4. USER ACCOUNTS AND DATA

The App does not require you to create a user account. Study progress,
selected preferences, and quiz history are stored locally on your
device only. You are responsible for maintaining your device and any
data stored on it.
5. INTELLECTUAL PROPERTY
--------------------------
5.1 Our Content
All content within the App including but not limited to the app
design, graphics, user interface, question content, explanation text,
source code, and branding is owned by or licensed to App Team and is
protected by applicable copyright, trademark, and intellectual
property laws.
5.2 Restrictions
You may not:
- Copy, reproduce, distribute, or modify any part of the App
- Reverse engineer, decompile, or disassemble the App
- Create derivative works based on the App
- Use the App's content for commercial purposes without written
permission from App Team
- Remove any copyright, trademark, or proprietary notices
- Use any automated tool to scrape or extract content from the App
5.3 Third-Party Content
Some content in the App is derived from publicly available official
government driver handbooks. Such content remains the property of
the respective government authorities. Our use of such content for
educational purposes is intended to be consistent with applicable
fair use and educational use provisions.
6. IN-APP PURCHASES AND SUBSCRIPTIONS

6.1 Free Tier
The App provides 25 free practice questions. Additional content
requires a premium subscription.
6.2 Premium Subscription
Premium subscriptions are offered on a weekly, monthly, or yearly
basis. The yearly plan includes a 3-day free trial. Premium
unlocks all available practice questions and removes advertisements.
6.3 Billing and Renewal
All purchases are processed through Apple's App Store. By purchasing
a subscription, you authorize Apple to charge your payment method.
Subscriptions automatically renew unless cancelled at least 24 hours
before the end of the current billing period.
6.4 Cancellation
You may cancel your subscription at any time through:
- iOS Settings > [Your Name] > Subscriptions, or
- App Store > Account > Subscriptions
Cancellation takes effect at the end of the current paid period.
You will retain premium access until that date.
6.5 Refunds
All refund requests must be made directly to Apple. App Team does
not process refunds. To request a refund from Apple, visit:

6.6 Price Changes
We reserve the right to change subscription prices. You will be
notified in advance of any price change through the App Store.
Continued subscription after a price change constitutes acceptance.
6.7 Free Trial
If a free trial is offered, it will be clearly disclosed before
purchase. Only one free trial per Apple ID per subscription product.
If you do not cancel before the trial period ends, you will be
charged the full subscription price.
7. ADVERTISEMENTS
------------------
The free tier of the App displays advertisements served by Google
AdMob. By using the free tier, you consent to the display of
advertisements. Premium subscribers do not see advertisements while
using the App.
We do not control the content of advertisements displayed by AdMob.
We are not responsible for any products, services, or content
advertised through AdMob. Any interaction with advertisements is
at your own risk.
8. NOTIFICATIONS

The App may request permission to send local push notifications
including daily study reminders and test countdown alerts. These
are optional. You may disable notifications at any time through
iOS Settings without affecting any other App functionality.
9. ACCEPTABLE USE
------------------
You agree to use the App only for lawful purposes and in accordance
with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the App or
its infrastructure
- Transmit any malware, viruses, or malicious code
- Use the App to infringe the intellectual property rights of others
- Attempt to interfere with the proper functioning of the App
- Use the App for any commercial purpose not expressly permitted
10. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT
ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED OR ERROR-FREE
- ANY DEFECTS WILL BE CORRECTED
- THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- THE CONTENT IS ACCURATE, COMPLETE, OR UP TO DATE
- THE APP WILL HELP YOU PASS ANY OFFICIAL EXAMINATION
YOUR USE OF THE APP IS AT YOUR SOLE RISK.
11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APP TEAM AND ITS
OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES
- LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
- ANY DAMAGES RESULTING FROM FAILURE TO PASS AN OFFICIAL EXAMINATION
- ANY ERRORS OR INACCURACIES IN APP CONTENT
- ANY UNAUTHORIZED ACCESS TO YOUR DEVICE OR DATA
- ANY THIRD-PARTY CONDUCT OR CONTENT
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT
YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR INR 100
(ONE HUNDRED INDIAN RUPEES) IF YOU HAVE NOT MADE ANY PAYMENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES
OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY
WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. INDEMNIFICATION
--------------------
You agree to indemnify, defend, and hold harmless App Team and its
officers, employees, agents, and licensors from and against any
claims, damages, losses, liabilities, costs, and expenses (including
legal fees) arising out of or related to:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
13. THIRD-PARTY SERVICES
--------------------------
The App integrates third-party services including Google AdMob,
Firebase Analytics, Firebase Crashlytics, Firebase Remote Config,
and Apple StoreKit. Your use of these services is subject to their
respective terms and privacy policies. App Team is not responsible
for the practices, content, or availability of any third-party
services.

14. TERMINATION
----------------
We reserve the right to suspend or terminate your access to the App
at any time, with or without notice, for any reason including
violation of these Terms.
Upon termination, your right to use the App ceases immediately.
Sections 5, 10, 11, 12, 15, and 16 of these Terms survive
termination.
15. GOVERNING LAW AND JURISDICTION
------------------------------------
These Terms are governed by and construed in accordance with the
laws of India, specifically the laws applicable in the state of
Gujarat, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms or
the App shall be subject to the exclusive jurisdiction of the
courts located in Surat, Gujarat, India.
Notwithstanding the above, App Team reserves the right to seek
injunctive or other equitable relief in any jurisdiction to protect
its intellectual property rights.
For users in the European Union, nothing in these Terms affects
your rights under applicable EU consumer protection law.
For users in the United States, nothing in these Terms affects
your rights under applicable US consumer protection law.
For users in Australia, nothing in these Terms affects your rights
under the Australian Consumer Law.
16. DISPUTE RESOLUTION
------------------------
Before filing any formal legal claim, you agree to first contact
App Team at support.appteam204@gmail.com and attempt to resolve
the dispute informally. We will make good faith efforts to resolve
disputes within 30 days of receiving notice.
If informal resolution fails, disputes shall be resolved through
binding arbitration in Surat, Gujarat, India, except that either
party may bring a claim in a court of competent jurisdiction for
injunctive relief to protect intellectual property rights.
17. CHANGES TO TERMS
----------------------
We reserve the right to modify these Terms at any time. Updated Terms
will be posted within the App and on our website. The "Last Updated"
date will be revised accordingly.
For material changes, we will provide notice through the App. Your
continued use of the App after changes are posted constitutes your
acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the App.
18. APPLE APP STORE ADDITIONAL TERMS
--------------------------------------
The following terms apply specifically to the iOS version of the App
distributed through the Apple App Store:
a) These Terms are between you and App Team, not with Apple Inc.
Apple is not responsible for the App or its content.
b) Apple has no obligation to provide maintenance or support for
the App.
c) In the event of any failure of the App to conform to applicable
warranties, you may notify Apple and Apple will refund the purchase
price (if any). To the maximum extent permitted by law, Apple
has no other warranty obligation.
d) Apple is not responsible for addressing any claims you or any
third party may have relating to the App.
e) If a third party claims the App infringes their intellectual
property rights, Apple will not be responsible for the
investigation, defence, settlement, or discharge of such claim.
f) You represent and warrant that you are not located in a country
subject to a US Government embargo or designated as a
"terrorist supporting" country, and that you are not on any
US Government prohibited or restricted parties list.
g) Apple and Apple's subsidiaries are third-party beneficiaries of
these Terms and may enforce these Terms against you.
19. SEVERABILITY
-----------------
If any provision of these Terms is found to be invalid or
unenforceable, that provision shall be modified to the minimum extent
necessary to make it enforceable, and the remaining provisions shall
continue in full force and effect.
20. ENTIRE AGREEMENT
---------------------
These Terms, together with the Privacy Policy, constitute the entire
agreement between you and App Team regarding your use of the App and
supersede all prior agreements and understandings.
