These Terms of Use (“Terms”) govern your use of the Pretake mobile application (“the App”), operated by Pretake App (“we”, “us”, or “our”).

By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

You may use the App solely for personal or professional audio recording purposes in accordance with these Terms.

You agree not to misuse the App in any way, including but not limited to:

•  Violating applicable laws or regulations

•  Recording individuals without their knowledge or consent where required by law

•  Reverse engineering or modifying the App

•  Attempting to interfere with the normal operation of the App

You are responsible for complying with audio recording laws in your jurisdiction.

2. Ownership & Intellectual Property

All rights, title, and interest in the App, including design, features, text, graphics, and code, are owned by Pretake App or its licensors.

You may not copy, distribute, sell, or sublicense any part of the App, except as permitted by these Terms or applicable law.

You retain full ownership of your audio recordings.

3. User Content

The App allows you to create, store, and export audio recordings (“User Content”).

You are responsible for:

•  Ensuring you have permission to record any audio you capture

•  Managing, exporting, and deleting your User Content

•  Complying with laws regarding audio recording and privacy

We do not access, store, or transmit any of your User Content.

4. Privacy

The App is designed to operate with minimal data collection.

Our Privacy Policy describes how we handle your information and forms part of these Terms.

5. No Warranty

The App is provided “as is” and without warranties of any kind, to the fullest extent permitted by law.

We do not guarantee that:

•  The App will be error-free or uninterrupted

•  Audio will be captured or saved in every situation

•  Your device will always support the App’s features

•  Recorded audio will meet specific quality requirements

You use the App at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

•  Loss of recordings or data

•  Any damage to your device or loss arising from your use of the App

•  Any claims related to unlawful or unauthorized audio recording

•  Any indirect, incidental, or consequential damages

Your sole remedy for dissatisfaction with the App is to discontinue use.

7. Updates & Modifications

We may modify, update, or discontinue the App (or any part of it) at any time without prior notice.

We may also update these Terms from time to time.

Continued use of the App after changes indicates your acceptance of the updated Terms.

8. Termination

We may suspend or terminate your access to the App if you violate these Terms.

Upon termination, your right to use the App ends immediately.

You retain your locally stored recordings unless removed by you or your device system.

9. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.
