1. Acceptance of Terms, Freemium Model, & Virtual Goods
By accessing or using the PlayGo application ("the App"), you agree to be bound by these Terms. PlayGo operates on a freemium basis; core features are free, while optional premium features and digital goods are available for purchase. Any virtual currency, tokens, or digital goods purchased within the App are licensed to you, not owned, and have no real-world cash value. All purchases are final and non-refundable, except where strictly required by applicable law.
2. Eligibility and COPPA Compliance
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction). If you are a parent and believe your child under 13 has accessed the App, contact us at support@playgo.ai for immediate account termination.
3. Intellectual Property, AI Outputs, and Commercialization
A. Platform IP vs. User Output: The PlayGo platform, including its game engine, underlying code, UI, and proprietary AI models (collectively, "Platform IP"), is exclusively owned by PlayGo AI. You are granted a limited, revocable license to use the Platform IP solely within our ecosystem.
B. User Inputs: You retain all rights to any original text, images, or audio you upload ("Inputs"). You warrant that your Inputs do not infringe on third-party IP rights. By submitting Inputs, you grant PlayGo a temporary license to process them for the sole purpose of generating your requested content.
C. Ownership of AI Outputs & Joint Authorship: Generative AI outputs ("Outputs") are inherently unpredictable. To the extent permitted by applicable law, PlayGo assigns to you any rights, title, and interest it may hold in the Outputs generated solely from your Inputs ("Original Outputs"). For Outputs generated in live collaborative lobbies, all contributing users agree that the final Output is jointly owned by the session participants, subject to the Community Remix License. PlayGo makes no representation that AI-generated Outputs are eligible for copyright protection under U.S. or international law. You assume the sole burden of clearing Outputs for use and ensuring they do not infringe upon third-party rights.
D. Ecosystem Lock & Strict Prohibition on Off-Platform Commercialization: PlayGo operates as a closed social ecosystem. You may not commercialize, sell, distribute, or monetize fully playable games created on or exported from PlayGo on any external platforms, marketplaces, or storefronts (e.g., Steam, App Store, web portals). You acknowledge that playable games fundamentally rely on PlayGo’s Platform IP (the game engine client) to function. Any monetization of PlayGo games must occur exclusively within the PlayGo platform, subject to our internal revenue-sharing or virtual currency policies. You may export raw, individual Original Outputs (e.g., an isolated sprite or music track) off-platform strictly for personal, non-commercial use, provided you generated the Original Output yourself. You may not export, extract, or claim ownership of assets generated by other users that you accessed via the Remix ecosystem.
E. Third-Party Vendor Policies: PlayGo utilizes third-party AI APIs. By using our AI features, you agree to comply with the Acceptable Use Policies of our third-party vendors. Violations may result in immediate suspension and loss of API access.
4. User Content, Model Training, & The Remix Ecosystem
A. The Dual-Privacy AI Model:
(i) Private Content: Content explicitly designated as "Private" will remain localized to your account and will not be used by PlayGo to train, fine-tune, or improve our proprietary AI models. PlayGo also utilizes "zero-data-retention" enterprise agreements with third-party vendors to ensure your Private Content is not used to train their foundational models.
(ii) Public Content & License: By designating content as "Public" or collaborating in live lobbies, you grant PlayGo a perpetual, irrevocable, worldwide, royalty-free license to host, modify, and utilize your Inputs and Outputs to train and improve our AI algorithms.
B. The Community Remix License: Publishing a game publicly automatically grants all PlayGo users a worldwide, royalty-free license to play, modify, and build upon your User Content to create derivative works ("Remixes") strictly for non-commercial use within the PlayGo ecosystem. PlayGo's platform will automatically enforce visual attribution to the original creator.
C. Remix Lineage & Monetization: PlayGo automatically tracks the "lineage" of remixed games. You may not export or commercially exploit a Remix off-platform without express written consent from all upstream creators. If PlayGo introduces on-platform monetization (e.g., tipping or creator funds), PlayGo reserves the sole right to distribute virtual revenue among the original creator and remixers according to our algorithmic contribution metrics.
D. Cascade Takedowns: To protect the ecosystem, the Remix License is irrevocable. However, if an original "root" work is removed via a valid DMCA request or Trust & Safety violation, PlayGo will execute an automated "Cascade Takedown," immediately disabling all downstream Remixes containing the violating material.
5. Acceptable Use, Safety, & Restrictions
A. Prohibited Prompts & Output: You shall not attempt to generate, nor publish, content that: (i) Infringes third-party intellectual property (e.g., prompting "Create a Super Mario clone"); (ii) Contains explicit, non-consensual, or sexually abusive imagery; (iii) Promotes hate speech, violence, or harassment; (iv) Attempts to "jailbreak," prompt-inject, or bypass PlayGo’s AI safety filters.
B. Live Collaborative Lobbies (Consent to Monitor): By joining real-time collaborative sessions (e.g., live drawing/prompting lobbies), you acknowledge and consent that PlayGo may monitor, record, and retain session data (including chat logs and live inputs) to enforce Trust & Safety guidelines. Trolling, griefing, or live-generating inappropriate content will result in immediate lobby ejection and potential account termination.
C. DMCA Notice & Repeat Infringers: If you believe your copyrighted work is being infringed, submit a notice to copyright@playgo.ai including: (1) description of the work; (2) the infringing URL; and (3) your contact info. PlayGo enforces a strict "Repeat Infringer" policy; users accumulating three valid strikes will face permanent account termination.
6. AI Unpredictability and Disclaimers
Generative AI is a novel technology. AI may generate unpredictable, inaccurate, or functionally broken Outputs (e.g., game logic errors or corrupted engine states). The App is provided strictly "as-is." PlayGo disclaims all liability for game failures, lost data, or offensive content inadvertently generated by AI.
7. Indemnification
You agree to indemnify, defend, and hold PlayGo AI harmless from any claims, damages, liabilities, or legal fees resulting from your violation of these Terms, your Inputs, your attempted off-platform commercialization of playable games, or your infringement of third-party intellectual property rights. You bear the ultimate legal responsibility for clearing, publishing, and sharing any AI-generated Outputs.
8. App Store and Google Play Dependencies
If you download or access the App from the Apple App Store or Google Play Store, you acknowledge and agree that these Terms are concluded solely between you and PlayGo AI, and not with Apple Inc. or Google LLC. PlayGo AI, not Apple or Google, is solely responsible for the App and its content. Neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the App. Apple and Google are not responsible for addressing any claims relating to the App, including but not limited to product liability, legal compliance, or intellectual property infringement. You acknowledge and agree that Apple and Google (and their respective subsidiaries) are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, they will have the right to enforce these Terms against you as a third-party beneficiary thereof.
9. Changes to Terms & Contact
