# Terms of Service for Planty

Welcome to Planty (the "App"), operated by Phuc Tran ("we," "our," or "us"). By accessing or using our App, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
If you do not agree to these Terms, you may not access or use the App.
## 1. Description of Service
Planty is an AI-assisted plant care and identification assistant. Features include plant species identification, disease diagnosis, care reminders (watering, fertilizing, repotting), environmental calculators, and an interactive AI botanist chat.
## 2. Eligibility & Accounts
- You must be at least 13 years old to use the App.
- You do not need to create an account to use the App's basic features, but certain features and purchase histories are tied to your Apple ID and Apple iCloud Account.
## 3. Subscriptions and Purchases
Certain features of the App are locked under a Premium Subscription (Pro Plan).
- **Billing:** Subscriptions are billed on a weekly or yearly basis through your iTunes Account.
- **Free Trial:** If a subscription starts with a free trial (e.g. 3-day weekly plan trial), your iTunes account will be charged at the end of the trial period unless you cancel at least 24 hours before the trial ends.
- **Auto-Renewal:** Subscriptions automatically renew unless auto-renew is turned off in your iTunes Account Settings at least 24 hours before the end of the current billing cycle.
- **Refunds:** All transactions are managed directly by Apple. We cannot issue refunds directly. You must request refunds through Apple Support.
## 4. User Content & Image Submission
By uploading or capturing photos using the App:
- You retain ownership of your photos.
- You grant us a worldwide, non-exclusive, royalty-free license to transmit, process, and analyze your photos solely to provide the plant identification and care services inside the App.
- You agree not to upload photos that violate copyright, contain graphic violence, or violate third-party privacy.
## 5. Disclaimer of Warranties
- **Informational Purposes Only:** The plant identifications, disease diagnoses, toxicity warnings, and care guides generated by the App’s AI are for educational and informational purposes only. They are not professional agricultural, horticultural, or toxicological advice.
- **No Liability for Plant Health:** We do not guarantee the survival, health, or recovery of your plants based on the suggestions provided by the App. Use all AI advice at your own risk.
## 6. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the App.
## 7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to its conflict of law provisions.
