Welcome to Plantitude (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our mobile application (“App”). By downloading, accessing, or using Plantitude, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Plantitude is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the App for personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by Apple’s Usage Rules.
You may not copy, modify, reverse-engineer, redistribute, or create derivative works of the App except as expressly permitted by applicable law. If you sell or transfer your device, you must remove the App before doing so.
You may use the App to identify plants, diagnose plant issues, and generate reports.
You agree not to misuse the App, including but not limited to:
Using the App for unlawful purposes.
Attempting to access data or systems without authorization.
Interfering with or disrupting the App’s services.
Plantitude allows anonymous use. You are not required to provide personal information to use the App.
If registration features are introduced in the future, you agree to provide accurate information.
We only store plant data (images and details of plants you scan, identify, or diagnose).
No personal information (such as name, email, or contacts) is collected unless you provide it voluntarily.
Plant data may be used to improve app functionality and provide accurate identification and diagnosis.

Plantitude may offer free or paid features, including auto-renewable subscriptions.
Payment will be charged to your Apple ID account at the time of confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
Management: You can manage and cancel your subscriptions at any time by going to your Account Settings on the App Store after purchase.
Refunds: Refunds are handled by Apple and subject to Apple’s refund policies.
All fees are non-refundable except where required by law.
All content, features, and design in Plantitude (including logos, graphics, text, and software) are owned by us or our licensors and protected by intellectual property laws.
You may not copy, reproduce, or distribute any part of the App without our prior written permission.
Plantitude is provided on an “as is” and “as available” basis.
We do not guarantee that the App will always be error-free, uninterrupted, or provide 100% accurate results.
Plantitude is an educational and informational tool and should not be relied on as a substitute for professional advice (e.g., from botanists or agricultural experts).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the extent not prohibited by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business interruption, arising out of your use of the App.
Our total liability to you for all damages shall not exceed fifty U.S. dollars ($50).
Some jurisdictions do not allow certain limitations, so these may not apply to you.
The App may enable access to third-party services and websites (“External Services”). You agree to use such External Services at your own risk. We are not responsible for the content, accuracy, or availability of External Services, and disclaim all liability arising from their use.
You may not use or export the App except as authorized by United States law and the laws of your jurisdiction.
By using the App, you represent and warrant that you are not located in a country subject to a U.S. government embargo, and are not listed on any U.S. government restricted parties list. You agree not to use the App for purposes prohibited by U.S. law.
We may suspend or terminate your access to the App if you violate these Terms. You may also terminate your license by deleting the App. Upon termination, your rights under these Terms will end.
These Terms are governed by the laws of your country of residence, unless otherwise required by local law.
If you reside in the United States, these Terms are governed by the laws of the State of California, and you agree to the exclusive jurisdiction of the courts in Santa Clara County, California.
If you reside in the European Union, Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
We may update these Terms from time to time. Updates will be effective immediately upon posting in the App or on our website. Continued use of the App means you accept the updated Terms.
