Terms of Service for Pixgen

1. Acceptance of Terms
By downloading, accessing, or using the Pixgen mobile application ("the App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you are prohibited from using the App.

2. Eligibility and Age Restrictions

• You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you are 18 years of age or older.

• For Younger Users in Specific Regions: If you are a minor in your jurisdiction (for example, under 18 in most places, under 16 in the European Union, or under 13 in the United States), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

• We reserve the right to request proof of age at any time and to suspend or terminate accounts if we suspect a user does not meet these age requirements.

3. User Account and Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

• You must provide accurate and complete information during registration and keep it updated.

• You agree to notify us immediately of any unauthorized use of your account.

4. AI-Generated Content and Usage Rights

• Your Prompts: You retain all rights to the text prompts you input to generate images.

• Generated Images: The AI-generated images created through the App are provided for your personal, non-commercial use only. You may download, share, or set them as wallpaper for personal enjoyment.

• Prohibited Use: You may not sell, sublicense, redistribute, or use the generated images for any commercial purpose without obtaining explicit written permission from us. You may not use the App to generate illegal, harmful, infringing, hateful, or sexually explicit content.

• Our Rights: We retain all rights, title, and interest in the App, its underlying technology, and the AI model. We may use anonymized and aggregated data from prompts and usage to improve our services.

5. Credits, Purchases, and Refunds

• The App uses a credit-based system for generating AI images.

• Credits can be purchased via in-app purchases through official app stores (Google Play Store).

• All purchases are final. Credits are non-refundable, non-transferable, and do not carry monetary value. Unused credits do not expire unless otherwise stated.

• We reserve the right to change credit pricing, packages, and the credit cost per generation at any time.

6. Account Termination (By You)

• You may delete your account at any time through the "Settings" section within the App ("Instant Delete").

• Upon account deletion:

  • Your access to the Service will be permanently revoked.

  • Your profile data, favorite images, and generation history will be deleted in accordance with our Privacy Policy.

  • Please note: Transaction records related to purchases may be retained for a period required by law (e.g., for tax and accounting purposes) even after account deletion, as detailed in our Privacy Policy.

7. Service Modification and Termination (By Us)

• We reserve the right to modify, suspend, or discontinue the App or any part of it, at any time, with or without notice.

• We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

8. Disclaimers and Limitation of Liability

• The App and AI-generated images are provided on an "as is" and "as available" basis. We do not guarantee the accuracy, quality, or suitability of any generated content.

• To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Governing Law and Disputes

• These Terms shall be governed by and construed in accordance with the laws of [ Dhaka, Bangladesh ], without regard to its conflict of law provisions.

10. Changes to These Terms

• We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
