# Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Photo to Pixel Image (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

## 1. The App
Photo to Pixel Image lets users select photos from their device and generate pixel-style images using AI-powered image processing. The App may also let users save generated images, view previous creations in an in-app gallery, compare original and generated images, and share results.
The App is intended for personal, creative, and lawful use only.
## 2. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority in your country or region, you may use the App only with permission from a parent or legal guardian.
The App is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
## 3. User Photos and Generated Images
You are responsible for the photos you choose to process through the App. You must have the necessary rights and permissions to use any photo, image, likeness, or content that you upload, select, or process.
You retain any rights you have in your original photos. Subject to these Terms, you may use the generated images for personal or commercial purposes, provided your use complies with applicable laws, third-party rights, and the terms of any AI or platform provider involved in generating the result.
We do not claim ownership of your original photos or generated images. However, by using the App, you authorize us and our service providers to process the photos you select for the purpose of generating the requested pixel-style image and providing the App's features.
## 4. Prohibited Uses
You agree not to use the App to create, upload, process, share, or distribute content that:
- Violates any law or regulation.
- Infringes intellectual property, privacy, publicity, or other rights.
- Contains sexual content involving minors or exploits or harms minors in any way.
- Promotes violence, self-harm, harassment, hate, discrimination, or illegal activity.
- Impersonates another person or misrepresents identity, authorship, or affiliation.
- Attempts to bypass technical limits, security measures, subscription controls, or usage restrictions.
- Interferes with the operation, security, or availability of the App or related services.
We may restrict access to the App if we believe these Terms have been violated.
## 5. AI-Generated Results
The App uses automated systems and third-party AI services to generate images. AI-generated outputs may be inaccurate, unexpected, incomplete, or different from what you intended. We do not guarantee that any generated image will meet your expectations, be unique, or be suitable for any specific purpose.
You are responsible for reviewing generated images before using, publishing, or sharing them. You should not rely on the App for professional, legal, medical, safety, identity verification, or other high-risk decisions.
## 6. Purchases and Subscriptions
The App may offer paid features, subscriptions, or in-app purchases through Apple's in-app purchase system.
If you purchase a subscription, payment will be charged to your Apple ID account. Subscriptions may automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings.
Prices, trial availability, features, and subscription terms may vary by country or region and may change as permitted by Apple and applicable law.
Refund requests for App Store purchases are handled by Apple according to Apple's policies. We do not control Apple's billing, renewal, cancellation, or refund decisions.
## 7. Device Permissions
The App may request access to photos or photo-related features so you can select images, save generated results, or use the App's core features. You can manage permissions through your device settings.
If you deny or revoke permissions, some features may not work.
## 8. Third-Party Services
The App may rely on third-party services for image generation, purchase management, infrastructure, or other app functionality. These services may process data as described in our Privacy Policy.
We are not responsible for third-party services, websites, platforms, or policies that we do not control.
## 9. App Store Terms
If you downloaded the App from the Apple App Store, Apple's terms and policies may also apply to your use of the App, including Apple's Media Services Terms and App Store rules. These Terms are between you and us, not Apple. Apple is not responsible for providing maintenance or support for the App.
## 10. Intellectual Property
The App, including its design, software, branding, interfaces, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.
These Terms do not grant you ownership of the App or any related intellectual property. You may not copy, modify, reverse engineer, distribute, sell, lease, or create derivative works from the App except as allowed by law.
## 11. Updates and Availability
We may update, modify, suspend, or discontinue the App or any feature at any time. We may also impose limits on usage, storage, or generation availability.
We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
## 12. Disclaimer of Warranties
The App is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.
## 13. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the App.
To the fullest extent permitted by law, our total liability for any claim related to the App or these Terms will not exceed the amount you paid for the App or subscription during the three months before the claim arose, or 50 USD, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
## 14. Indemnity
You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses arising from or related to your use of the App, your content, your generated images, your violation of these Terms, or your violation of any law or third-party right.
## 15. Termination
You may stop using the App at any time. We may suspend or terminate access to the App if we believe you violated these Terms, created risk or legal exposure, or used the App in a harmful or unlawful way.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions.
## 16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the App, App Store metadata, or another reasonable method. The updated Terms will be effective when posted unless a later date is stated.
Your continued use of the App after changes become effective means you accept the updated Terms.
## 17. Governing Law
These Terms are governed by the laws of Spain, unless applicable consumer protection laws in your country or region require otherwise.
