Welcome to PixelHarvest.
These Terms of Use (“Terms”) govern your access to and use of the games, mobile applications, websites, software, content, and related services provided by PixelHarvest (“PixelHarvest,” “we,” “us,” or “our”), collectively referred to as the “Services.”
By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not download, access, or use our Services.
You may use our Services only if you are legally permitted to do so under the laws applicable to you.
Some PixelHarvest games may be designed for or accessible to children. Where required by applicable law, a parent or legal guardian must provide any necessary consent for a child to use a Service.
If you are a parent or legal guardian who allows a child to use our Services, you are responsible for supervising the child’s use of the Services and, where applicable, for purchases made through the child’s device or account.
Use of our Services is also subject to any applicable rules and terms imposed by the platform through which you download or access them, including the Apple App Store and Google Play.
PixelHarvest develops and publishes games and applications, including casual, hyper-casual, and other interactive digital experiences.
Features may vary between games, applications, devices, platforms, geographic locations, and versions of our Services.
We may add, change, suspend, update, or remove features or content at any time as part of maintaining, improving, or developing our Services.
We do not guarantee that every Service or feature will always be available or that a Service will remain compatible with every device or operating-system version.
Subject to your compliance with these Terms, PixelHarvest grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, access, and use our Services for personal and non-commercial entertainment purposes.
This license does not transfer ownership of any part of our Services to you.
Except where applicable law expressly permits otherwise, you may not:
Copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit our Services;
Modify, adapt, translate, or create derivative works based on our Services;
Reverse engineer, decompile, disassemble, or attempt to derive the source code of our Services;
Circumvent or interfere with security, access-control, anti-cheat, advertising, or technical protection mechanisms;
Use bots, scripts, automation tools, cheats, exploits, hacks, or unauthorized third-party software in connection with our Services;
Attempt to gain unauthorized access to our systems, servers, user accounts, or networks;
Use our Services for unlawful, fraudulent, abusive, or harmful purposes; or
Remove or modify copyright, trademark, attribution, or other proprietary notices.
Any rights not expressly granted under these Terms are reserved by PixelHarvest and its licensors.
When using our Services, you agree not to engage in conduct that:
Violates applicable laws or regulations;
Interferes with the normal operation of a Service;
Attempts to exploit bugs, vulnerabilities, or unintended game mechanics for improper advantage;
Harasses, threatens, abuses, or harms other users;
Introduces viruses, malicious code, or other harmful technologies;
Impersonates another person or misrepresents your identity;
Infringes the intellectual-property, privacy, or other rights of another person; or
Uses our Services for unauthorized commercial activities.
We may restrict or terminate access to a Service when we reasonably believe these Terms have been violated or where necessary to protect PixelHarvest, our users, or our Services.
Some of our Services may offer optional in-app purchases, including digital items, virtual currency, additional content, subscriptions, upgrades, or other digital features.
Purchases are generally processed through the platform from which you obtained the Service, such as the Apple App Store or Google Play, and are subject to that platform’s payment terms and refund policies.
PixelHarvest does not directly control payment processing performed by these third-party platforms.
Unless otherwise required by applicable law or the relevant platform’s policies, digital content and virtual items:
Have no real-world monetary value;
Cannot be exchanged for cash;
Cannot be transferred outside the relevant Service;
Are licensed rather than sold to you; and
May be modified, removed, or discontinued as the Service evolves.
If a Service is discontinued, access to associated virtual items or digital content may also end, subject to applicable law and platform requirements.
Some PixelHarvest Services are supported in whole or in part by advertising.
Advertisements may be provided by third-party advertising partners and may include banner ads, interstitial advertisements, rewarded advertisements, or other advertising formats.
Depending on the Service, your age, your consent choices, your geographic location, and applicable law, advertising may be contextual or personalized.
Information regarding how advertising-related data may be collected and used is described in our Privacy Policy.
You may also be able to control certain advertising preferences through your device settings, operating-system privacy settings, consent-management tools, or applicable advertising services.
Our Services may integrate or interact with third-party platforms, services, software development kits, analytics providers, advertising networks, payment providers, and other technologies.
These may include services such as:
Unity Ads;
Google AdMob;
Firebase Analytics; and
Apple App Store and Google Play services.
Third-party services operate under their own terms, policies, and privacy practices.
PixelHarvest is not responsible for the content, availability, security, or practices of third-party services that we do not control.
Your use of third-party services may be subject to additional terms imposed by those third parties.
Your privacy is important to us.
Our collection, use, sharing, and protection of information relating to our Services is described in the PixelHarvest Privacy Policy.
By using our Services, you acknowledge that you have reviewed our Privacy Policy.
Where required by applicable law, we will request appropriate consent before collecting or processing information that requires such consent.
Some PixelHarvest Services may be intended for, or accessible to, children.
For Services directed to children, we take steps intended to comply with applicable children's privacy and digital-safety requirements.
Where required, we may:
Limit the collection of personal information;
Restrict personalized advertising;
Use age-appropriate advertising;
Require parental or guardian consent;
Disable or limit certain social, tracking, purchasing, or data-collection features; or
Implement additional privacy and safety protections.
Parents and legal guardians are encouraged to supervise children's use of digital services and review device and app-store parental controls.
Questions concerning a child’s information should be directed to us using the contact details provided below.

Certain updates may be necessary for continued use of a Service.
We may modify game mechanics, difficulty, virtual items, reward systems, advertising systems, pricing, content, or other aspects of a Service where reasonably necessary for development, security, balancing, legal compliance, or commercial operation.
We may also suspend or discontinue a Service, either temporarily or permanently.
Our Services may require compatible hardware, software, an internet connection, or access to third-party platform services.
You are responsible for any internet, mobile-data, hardware, or other charges incurred while accessing our Services.
We do not guarantee that our Services will be uninterrupted, error-free, secure, or available at all times.
Maintenance, technical problems, network outages, platform changes, force majeure events, or circumstances outside our reasonable control may affect availability.
If you voluntarily provide us with suggestions, ideas, comments, bug reports, or other feedback concerning our Services (“Feedback”), you allow PixelHarvest to use that Feedback to improve, develop, promote, or operate our Services without an obligation to compensate you.
You retain ownership of any rights you may have in your Feedback, but grant PixelHarvest a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, and incorporate that Feedback into our products and services to the extent permitted by law.

We may suspend, restrict, or terminate your access to all or part of a Service where reasonably necessary, including where:
You materially violate these Terms;
Your activity presents a security or fraud risk;
Your use interferes with other users or our Services;
We are required to do so by law or by a platform provider; or
A Service is discontinued.
You may stop using our Services at any time by uninstalling the relevant application and discontinuing access.
Provisions of these Terms that by their nature should survive termination will continue to apply, including provisions regarding intellectual property, disclaimers, limitations of liability, and dispute provisions.
To the maximum extent permitted by applicable law, our Services are provided on an “as is” and “as available” basis.
PixelHarvest does not guarantee that:
The Services will always be available or uninterrupted;
The Services will be free from bugs, errors, or harmful components;
All defects will be corrected;
Game progress or data will never be lost; or
The Services will meet every user’s individual expectations.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded or limited.
To the maximum extent permitted by applicable law, PixelHarvest and its owners, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Services.
This may include loss of data, loss of game progress, loss of profits, loss of opportunity, or other intangible losses.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.
Your statutory consumer rights remain unaffected.
To the extent permitted by applicable law, you agree to indemnify and hold PixelHarvest harmless from claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.
This provision does not apply where such an obligation is prohibited by applicable consumer-protection law.
These Terms will be governed by the laws of NM 87505 United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your country of residence provide otherwise.
Any disputes relating to these Terms or the Services will be handled by the competent courts of NM 87505 United States, unless applicable law gives you the right to bring a claim in another jurisdiction.
Nothing in this section limits any mandatory rights you may have under applicable consumer law.
We may update these Terms periodically to reflect changes to our Services, business practices, technologies, or legal requirements.
When we make changes, we will publish the updated Terms and update the “Last Updated” date at the top of this page.
Where required by applicable law, we may provide additional notice or request your consent before material changes become effective.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If you do not agree with updated Terms, you should discontinue use of our Services.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
These Terms, together with our Privacy Policy and any additional terms presented within a particular Service, form the agreement between you and PixelHarvest regarding your use of that Service.
Platform-specific terms imposed by Apple, Google, or another distribution platform may also apply.
