These Terms of service govern your access to and use of Pitchmark, including the mobile apps and web app. By creating an account, signing in, or using Pitchmark, you agree to these Terms. If you do not agree, do not use Pitchmark.
1. What Pitchmark is
Pitchmark is a stadium passport and matchday logging app. It lets users browse stadiums, save stadiums to a wishlist, record matchday visits, review history, follow other supporters, manage preferences, and contact the Pitchmark team. It does not provide ticketing, purchases, betting, travel booking, a user-controlled cloud backup or restore feature, file imports, push notifications, camera uploads, or in-app purchases. Pitchmark maintains operational disaster-recovery backups as described in the Privacy policy.
2. Eligibility
You must be at least 16 years old and must also have reached any higher minimum legal age required in your country to use online services. By using Pitchmark you confirm you are allowed to enter into these Terms and that the information you provide is accurate.
3. Accounts and authentication
You need an account to access protected features. Pitchmark uses third-party authentication, including Clerk, for account creation, sign-in, password reset, email verification, and supported social sign-in. You are responsible for keeping your credentials secure and for all activity under your account. You must not use another person's account, access systems or data without permission, provide false information, or bypass security or rate limits. If you believe your account is compromised, contact pitchmark.app@gmail.com.
4. Your matchday and stadium content
You can create and manage personal matchday records. You remain responsible for the content you submit and confirm it is accurate to the best of your knowledge and does not violate anyone's rights. When you delete a matchday from your history, it is removed from the live production database and cannot be recovered through the app. It may remain temporarily in routine disaster-recovery backups as described in the Privacy policy.
5. Custom stadiums and teams
When a stadium or team is missing, you can submit a custom entry. To protect data quality, your account may keep up to 100 unverified custom stadiums and 100 unverified custom teams pending review at a time. Unverified submissions remain private to your account until reviewed. Once approved, an entry becomes verified, joins the public catalog, and no longer counts toward your limit. Pitchmark may edit, normalize, merge, or reject any submission and is not obligated to publish any entry.
6. Community guidelines and objectionable content
Pitchmark has zero tolerance for objectionable content and abusive behavior. You must not post, submit, or transmit content that is unlawful, hateful, harassing, threatening, defamatory, obscene, sexually explicit, discriminatory, or otherwise objectionable, and you must not harass, abuse, impersonate, or harm other users. This applies to all user-generated content, including usernames, display names, custom stadium and team names, ratings, and messages to us.
By using Pitchmark you agree that there is no tolerance for objectionable content or abusive users. We may remove content and suspend or terminate accounts that violate these guidelines.
7. Reporting and blocking
Pitchmark provides tools to keep the community safe:
- Report: you can report another supporter, optionally in connection with a public visit you can view, when you believe the supporter or visit violates these Terms. Reports include a category and optional details and are used only for safety and moderation. Do not include passwords, payment-card details, government identifiers, health information, or other unnecessary sensitive personal information in report details.
- Block: you can block another supporter. Blocking removes follow relationships in both directions and hides both supporters from each other in supporter search, follower and following lists, public profiles, and public matchday and visit views. Your blocked-supporters list and existing report history may retain limited references needed to operate those features.
We review reports and act promptly on objectionable content and abusive users. Where appropriate, action may include removing content that violates these Terms and suspending or terminating the responsible account. Submitting knowingly false or abusive reports is itself a violation of these Terms.
8. Prohibited use
You must not use Pitchmark to:
- Break the law or violate someone else's rights
- Submit abusive, hateful, misleading, fraudulent, harmful, or otherwise objectionable content
- Harass, threaten, impersonate, or abuse other users
- Interfere with Pitchmark's operation, security, or infrastructure
- Scrape, copy, or extract catalog data at scale without permission
- Reverse engineer the app except where the law allows
- Bypass account protections, authentication controls, rate limits, or moderation tools
9. Service limits and abuse prevention
Pitchmark applies automated rate limits, payload constraints, and network protections. If your client triggers these thresholds or experiences network interference, requests may be temporarily rejected, and the app will show a retry notice.
10. Offline use and sync
Some features work offline using cached catalog data and pending records. Offline-created matchdays are saved locally and sync automatically when a stable connection returns. Pitchmark cannot guarantee that offline data always syncs. If syncing fails, the app shows a pending or failed status and a manual retry. You are responsible for confirming your records have synced before logging out or changing your installation.
11. Location features
Pitchmark may ask for location access to find nearby stadiums, show distances, or center the map. You can deny location at any time, though some features will be unavailable until access is granted.
12. App preferences and local storage
Pitchmark stores local settings such as theme, language, accent color, currency, and distance unit; offline catalog data; pending or failed matchdays and their sync state; pending mutation identifiers; and encrypted authentication and session material in operating-system secure storage. Synced matchday history, wishlist, and account records are stored on our backend. Deleting the app or clearing its storage may remove local settings and unsynced records, but synced history reloads when you sign back in.
13. Contact requests
You can submit contact requests to report missing venues, give feedback, or request help. You must not submit unlawful, abusive, confidential, or sensitive personal information through contact requests. We review, respond to, and retain these requests for support and moderation.
14. Catalog information
Stadium, team, competition, fixture, rating, capacity, location, and distance information may be incomplete, delayed, estimated, or unavailable. Pitchmark is for personal entertainment and record-keeping only and should not be relied on for travel, safety, ticketing, or event scheduling.
15. Third-party services
Pitchmark relies on third-party services for authentication, hosting, cloud storage, and maps. Your interaction with third-party components, such as Clerk or social sign-in providers, is subject to those providers' terms and privacy policies. Pitchmark is not responsible for third-party services it does not control.
16. Intellectual property
Pitchmark's design, branding, software, protectable original content, protectable selection and arrangement of catalog materials, and licensed materials are owned by the operator or its licensors and protected by applicable law. Pitchmark does not claim ownership of underlying factual information such as stadium names, locations, capacities, fixtures, or scores. These Terms grant you no ownership or intellectual property rights in Pitchmark's protected materials. You may use the platform only for personal, lawful, non-commercial purposes.
17. Your license to Pitchmark
When you submit content, including matchday records, custom entries, ratings, or feedback, you grant Pitchmark a worldwide, non-exclusive, royalty-free license to host, store, process, display, review, and modify that content as needed to operate, support, and improve the app. For custom stadiums, custom teams, and feedback, this license permits Pitchmark to adapt, publish, or incorporate approved submissions into the public catalog.
18. Feedback
If you send us ideas or feature requests, you agree Pitchmark may implement them without restriction, obligation, or compensation.
19. Availability and changes
Pitchmark may change, suspend, update, or discontinue any part of the app at any time. We may also update these Terms. If a change is material, we will take reasonable steps to notify you, such as updating the effective date or showing a prompt in the app. Continued use after changes take effect constitutes acceptance.
20. Account deletion, suspension, or termination
You may stop using Pitchmark and request account deletion at any time from Profile / Account Settings, or by contacting pitchmark.app@gmail.com. When you request deletion, Pitchmark creates a durable deletion request and asks Clerk to delete the authentication account before deleting the corresponding Pitchmark database account. Temporary provider or database failures keep the request pending for automatic retry and are not reported as completed. The app clears local account data when the deletion flow begins, so unsynced local records may be lost even if remote deletion remains temporarily pending. When account deletion completes:
- Your session, profile, and credentials are removed from Clerk's authentication service.
- Your private, unverified custom stadium and team submissions are removed.
- Your matchday history, wishlist, badges, contact history, block list, and submitted reports are removed.
- Approved catalog submissions are retained but unlinked from your identity.
Pitchmark may suspend or terminate your access immediately, without prior notice, if you violate these Terms, including the community guidelines in Section 6, create legal or security risks, or engage in fraudulent or abusive activity. Where appropriate, you may contact pitchmark.app@gmail.com to appeal an enforcement decision.
21. Disclaimers
Pitchmark is provided "as is" and "as available." To the maximum extent permitted by law, Pitchmark disclaims warranties that may lawfully be disclaimed, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. Pitchmark does not warrant that the app will always be online or error-free, that catalog data will be fully accurate or real-time, that offline changes will always sync, or that every submission or request will be approved. This Section does not exclude statutory guarantees, warranties, remedies, or other consumer rights that cannot lawfully be excluded.
22. Limitation of liability
To the fullest extent permitted by applicable law, the operator shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, service interruptions, or hardware damage arising from your use of the app. To the maximum extent permitted by law, the operator's total cumulative liability for claims relating to the app or these Terms will not exceed USD 100. This limitation does not exclude or limit liability for fraud, deliberate misconduct, gross negligence, death or personal injury, infringement of data-protection rights, or any warranty, remedy, consumer right, or other liability to the extent it cannot lawfully be excluded or limited.
23. Indemnity
To the fullest extent permitted by law, you are responsible for third-party claims caused by content you knowingly submit unlawfully, your deliberate misuse of Pitchmark, or your intentional violation of applicable law or third-party rights. You are not responsible under this Section to the extent a claim was caused by the operator, and this Section does not impose an indemnity or duty to defend where doing so would violate mandatory consumer law.
24. Governing law and disputes
These Terms are governed by the laws of Ukraine, excluding conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of habitual residence. You may bring a dispute in any court available to you under mandatory applicable law. Nothing in these Terms requires a consumer to use the courts of Ukraine when applicable law gives the consumer the right to use another court.
25. Platform-specific mobile terms
Data charges. You are responsible for any data, roaming, or carrier fees incurred using Pitchmark.
Mobile application licence. These Terms govern the Pitchmark service and your Pitchmark account. If you obtain the iOS application through the Apple App Store, your licence to install and use the iOS application is also governed by Apple's Standard Licensed Application End User License Agreement:

These Terms supplement that agreement. If there is a conflict concerning the licence to the iOS application, Apple's Standard EULA controls. Apple is not responsible for operating or supporting the Pitchmark service.
App marketplace terms. You must comply with the applicable terms of the marketplace from which you obtained the application, including the Apple Media Services Terms and Conditions or Google Play Terms of Service.
