Terms and Conditions for Pinned

1. Introduction

Welcome to Pinned (the "App"), developed by Buckeye Software LLC ("we", "our", "us"). By accessing or using Pinned, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.

These Terms apply to all users of the App, including visitors, registered users, and subscribers.

2. Description of Services

Pinned is a personal messaging application designed to help you stay connected with friends through meaningful notes that can be displayed on home screen widgets. The App provides:

Personal note messaging between friends

Home screen and lock screen widget integration

Friend management and connection features

Message history and conversation tracking

Customizable signatures and profile customization

These features are designed to help you maintain meaningful connections with friends through personal, visible messages.

3. User Responsibilities

By using the App, you agree to:

Provide accurate and up-to-date information when creating an account, setting up your profile, or adding friends.

Only send messages and content that you have the right to share and that do not infringe any third-party rights.

Use the App in compliance with all applicable laws and not for any unlawful or harmful purpose.

Respect other users' privacy and not share their messages or personal information without consent.

Use the App in a respectful manner and not send harassing, abusive, or inappropriate content to other users.

Understand that messages are visible to recipients and may be displayed on their home screen widgets.

4. Account Registration and Security

To access certain features, you may need to register an account. By doing so, you agree to:

Provide accurate and complete information, including a unique username

Maintain confidentiality of your login credentials

Notify us immediately of any unauthorized use of your account

You are responsible for all activity occurring under your account.

5. Subscriptions and Payments

Pinned offers premium features through subscription plans purchased via the App Store or other platforms:

Basic Plan: 5 messages per month at no cost

Pro Plan: Unlimited messages with custom signatures and access to all features, available through a paid subscription with a 3-day free trial

Additional terms:

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period

You can manage or cancel subscriptions via your device settings

Message limits reset monthly based on your subscription tier

Refunds are only provided as required by law or at our discretion

6. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your data, including messages, profile information, and friend connections.

While we use reasonable security measures, no method of data transmission over the internet is 100% secure. We are not responsible for unauthorized access to your account or data.

7. Restrictions

You may NOT:

Use the App to send illegal, infringing, or harmful content, including spam, harassment, or false information

Attempt to reverse-engineer, decompile, or access the source code of the App

Interfere with the App's operation or disrupt other users' experiences

Use automated systems or bots to interact with the App

Share your account credentials with others or create multiple accounts to circumvent subscription limits

Send unsolicited messages or use the App for commercial purposes without permission

8. Intellectual Property

All content, design, logos, software, and trademarks associated with Pinned are owned by Buckeye Software LLC or its licensors and protected by law.

You receive a limited, non-exclusive license to use the App for personal, non-commercial purposes under these Terms. You retain ownership of any content you create (messages, profile information), but grant us a license to use such content to provide the App's services.

9. Termination

We may suspend or terminate your access if you violate these Terms or engage in illegal activity. Upon termination, you must stop using the App immediately. We may delete your account data in accordance with our Privacy Policy.

10. Limitation of Liability

To the fullest extent allowed by law, Buckeye Software LLC is not liable for any damages arising from your use or inability to use Pinned, including indirect or consequential damages. We are not responsible for outcomes of relationships or communications between users, or decisions made based on messages received through the App.

11. Disclaimer of Warranties

Pinned is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, delivery of messages, or that the App will meet your expectations. The App is intended for personal communication purposes only.

12. Governing Law

These Terms are governed by the laws of New Jersey, United States. Disputes will be resolved in the courts located in New Jersey.

13. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated via the App or email. Continued use after changes indicates acceptance.
