I. INTRODUCTION
These Terms of Use and End User License Agreement (together referred to as the “Agreement”), along with any documents referenced herein, constitute a legally binding contract between you, as an individual (“you”, “your”, or “user”), and Zenith Forge Inc. (“we,” “us,” or “our”), regarding your access to and use of the mobile software application “PikAI: AI Video Effects” (the “App”). The App’s name may vary depending on your location and is subject to change without prior notice.
All documents related to the App are hereby expressly incorporated into this Agreement by reference.
Please read this Agreement carefully before downloading, installing, or using the App.
By proceeding to download, install, or use the App, you acknowledge that you have read, understood, and agreed to be bound by this Agreement, which becomes effective as of the moment you begin using the App in any form.
If you do not agree to the terms of this Agreement, or if you disagree with any part of it, you are not permitted to access, download, install, or use the App. If you have already done so, you must immediately remove the App from any mobile device you own or control.
II. MODIFICATIONS TO THIS AGREEMENT
We reserve the right, at our sole discretion, to amend, modify, or update this Agreement at any time and for any reason. Any changes made will be reflected in an updated version of this Agreement. It is your responsibility to review this Agreement periodically to remain aware of any modifications. Continued use of the App after an updated version of the Agreement has been published will constitute your acceptance of those changes.
III. ELIGIBILITY TO USE THE APP
To download, install, access, or use the App, you must be at least eighteen (18) years of age.
If you are considered a minor in your place of residence (generally under 18 years old), you must obtain permission from a parent or legal guardian and be directly supervised by them while using the App. If you are between the ages of thirteen (13) and seventeen (17), you may only access, download, install, or use the App after: (a) securing the consent of your parent or guardian, who must have read and agreed to the terms of this Agreement; and (b) confirming that you are legally capable of entering into a binding contract under applicable laws.
Parents and legal guardians are solely responsible for monitoring and supervising their minor children’s use of the App. It is their duty to ensure that minors do not use the App in any unauthorized, inappropriate, or unlawful manner, especially if they have not reached the legal age of majority in the applicable jurisdiction.
Individuals under the age of thirteen (13) are strictly prohibited from downloading, installing, accessing, or using the App.
By using the App, you confirm that you are either of legal age or majority in your jurisdiction (at least eighteen (18) years old), an emancipated minor, or that you have obtained valid parental or guardian consent. You further confirm that you are fully capable of entering into and complying with the terms, conditions, obligations, and representations contained in this Agreement.
IV. GENERAL TERMS
The App is designed to help users enhance and transform their photos using advanced Artificial Intelligence (AI) technologies. With a variety of creative tools, PikAI: AI Video Effects allows you to animate still images, apply dynamic visual effects, and bring your portraits to life with realistic motion. Whether you're adding subtle facial expressions, creating short video loops, or experimenting with artistic filters, the App offers an intuitive way to reimagine your photos in motion. The App is intended solely for your personal, non-commercial use. You agree to use the App exclusively for the purposes outlined above.
V. PRIVACY POLICY
Protecting your privacy is a priority for us. Our Privacy Policy explains how we collect, process, and store information, including personal data. Your access to and use of the App and its services is governed by this Privacy Policy. By continuing to use the App, you confirm your agreement with the Privacy Policy, including the legal grounds for data processing described within it. We reserve the right to update the Privacy Policy from time to time. If you disagree with any part of it, you must cease using the App and its services immediately.
VI. END USER LICENSE AGREEMENT
By using the App, you agree to respect all intellectual property rights (including rights in the source code, user interface and experience design, content, trademarks, and copyrights—collectively referred to as “Intellectual Property Rights”) owned by Zenith Forge Inc. and third parties.
While you use the App, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the App in accordance with this Agreement (the “License”).
The App is to be used only for your personal, non-commercial purposes. You must not infringe on any copyrights within the App.
All components of the App, including the source code, design, content (text, graphics, audio, video, etc.), names, logos, and trademarks (“Works” and “Means of Individualization”), are protected by copyright and intellectual property laws and are the exclusive property of Zenith Forge Inc., its partners, or its licensors.
These materials may not be copied, distributed, reproduced, broadcasted, or otherwise used in any form without explicit authorization from the rights holder.
All rights, titles, and interests in the App and its components remain the sole property of Zenith Forge Inc. or its respective licensors, and nothing in this Agreement transfers any of those rights to you.
We reserve the right to pursue legal remedies for any unauthorized use of our trademarks or content. All rights not expressly granted are reserved. Other names or trademarks mentioned may belong to their respective owners.
VII. PROHIBITED BEHAVIOR
You agree not to use the App in any way that:
violates any laws or regulations;
defames others;
is obscene, offensive, or harmful;
infringes upon third-party intellectual property rights;
promotes illegal activities.
You are also prohibited from uploading or generating content via the App that includes:
hate speech or discriminatory language;
harassment or threats;
violence or glorification of suffering;
self-harm or promotion of eating disorders;
sexually explicit material (outside of educational context);
political campaigning;
misleading or fraudulent content;
malware, viruses, or other harmful software;
any other content that violates laws or ethical standards.
DO NOT ENTER ANY COPYRIGHTED OR TRADEMARKED MATERIALS INTO THE APP.
You may not:
make the App available to third parties;
reverse engineer, translate, or modify the App;
rent, sell, or sublicense the App;
use the App to provide services to others;
misuse any trademarks or content in the App;
use the App for malicious purposes.
Violation of these terms may result in legal action. We are not liable for how you use the App but reserve the right to take action against violations.
VIII. AVAILABILITY, SECURITY, AND ACCURACY
To use the App, you need a compatible device with Internet access.
The App is compatible with Apple iOS 15.0 or newer.
We make no guarantees about compatibility with all devices or systems. The App may be unavailable or function with interruptions.
Internet connectivity is required; performance may depend on network quality.
We reserve the right to update, suspend, or discontinue the App at any time.
You are responsible for ensuring that any information you provide is accurate and up to date.
App versions may be updated with new features periodically.
You may stop using the App at any time by uninstalling it.
IX. CHARGES
The App is free to download and includes basic features.
Premium features require in-app purchases or subscriptions, which may start with a free trial. Subscriptions automatically renew unless cancelled at least 24 hours before the trial ends.
Details of plans and pricing are listed on the App Store page. Prices may vary by region and are subject to change without notice.
Free trials automatically convert to paid subscriptions. Unused trial periods are forfeited upon purchase. Subscription plans may be modified or discontinued at any time.
Subscriptions auto-renew within 24 hours of expiration. You can disable auto-renew in your Apple ID settings. Deleting the App does not cancel your subscription.
You may incur charges from your carrier for using the App, including data or messaging fees. You are responsible for such charges and must have the bill payer’s consent if you are not the account owner.
X. THIRD-PARTY WEBSITES AND RESOURCES
The App may include links to third-party websites or services. We are not responsible for the content or accuracy of any third-party sites.
You are solely responsible for your interactions with any third-party services.
Questions or concerns regarding third-party products or services should be directed to the provider of those services.
XI. DISCLAIMER OF WARRANTIES
YOU USE THE APP AND ITS SERVICES AT YOUR OWN RISK. THEY ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE OR THAT THE APP WILL BE FREE OF HARMFUL COMPONENTS.
XII. LIMITATION OF LIABILITY & INDEMNITY
WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.
We are not liable for damages related to third-party services or legal actions against your use of the App.
You assume full responsibility for your use and any content generated. You agree to indemnify Zenith Forge Inc., its affiliates, and partners from any claims arising from your use of the App or violation of this Agreement.
XIII. LEGAL COMPLIANCE
You represent and warrant that:
you are not located in a country subject to a U.S. embargo or listed as a “terrorist-supporting” nation;
you are not on any U.S. Government prohibited or restricted party list.
XIV. THIRD-PARTY BENEFICIARY
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it as such.
XV. GOVERNING LAW AND DISPUTES
If you access the App from outside the U.S., you are responsible for complying with local laws.
CLASS ACTION WAIVER: YOU WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT AGAINST US.
In the event of a dispute, both parties agree to attempt to resolve the issue through informal communication for 60 days prior to taking legal action.
XVI. TERMINATION
We may terminate this Agreement at any time. Upon termination, all rights granted to you will cease, and you must stop using the App immediately.
XVII. SEVERABILITY
If any provision is found to be unlawful or unenforceable, it will be modified or removed, but the rest of the Agreement will remain in effect.
You may not assign or transfer this Agreement to any other party.
