PHOTOVIBE TERMS OF USE

By downloading or using the PhotoVibe mobile application ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.
1. THE SERVICE
PhotoVibe analyzes photos you upload using AI to generate personalized music playlist recommendations. The App integrates with Spotify for music playback, provides 30-second audio previews, and offers links to YouTube Music and Yandex Music.
We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
2. PHOTOS YOU UPLOAD
You are responsible for the photos you upload. By uploading a photo, you confirm that you have the right to use it. Photos are sent to Google's Gemini AI for analysis and are not stored by us. You may not upload photos that are illegal, offensive, or that violate any third party's rights.
3. SUBSCRIPTIONS AND PAYMENTS
New users receive 5 free vibe generations on first launch. No account or payment is required to use these.
After your free generations are used, an active subscription is required. Available plans:
Weekly Plan: $5.99 per week, unlimited generations.
Monthly Plan: $17.99 per month, unlimited generations.
All payments are processed through Apple's App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can cancel anytime through your Apple App Store account settings. We do not offer refunds for unused portions of a subscription period except where required by law.
4. THIRD-PARTY SERVICES
The App uses Spotify, Google Gemini AI, YouTube Music, Yandex Music, Firebase, and RevenueCat. Your use of these services is subject to their own terms and policies. We are not responsible for the availability or content of any third-party service.
5. INTELLECTUAL PROPERTY
The App and its content are owned by PhotoVibe. You may not copy, modify, or distribute any part of the App without our permission. Song recommendations are for personal use only. All music rights belong to their respective owners.
6. DISCLAIMER
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR THAT RECOMMENDATIONS WILL MEET YOUR EXPECTATIONS. AI-GENERATED PLAYLISTS ARE FOR ENTERTAINMENT AND DISCOVERY PURPOSES ONLY.
7. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, PHOTOVIBE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.
8. TERMINATION
We may suspend or terminate your access to the App at any time if you violate these Terms.
9. CHANGES
We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.
