These Terms of Service (the "Terms") constitute a legally binding agreement between you and Photo Secure (referred to as "PS," "we," "our," or "us"). The agreement governs your use of our services and mobile application.
By accessing or using the services (1. Interpretation of Services) or installing the application, you acknowledge and agree that you have read, understood, and accept these Terms and will comply with all applicable laws and regulations. If you do not agree with these Terms, please stop using the application, and you may contact us using the contact information provided in these Terms.
We reserve the right to modify and update these Terms at our discretion. Any revised Terms will be effective immediately upon publication. For significant changes or updates, we will make reasonable efforts to notify you. Please regularly check the Terms and the updated date.
1. Interpretation of Services
The "Photo Secure" application developed and provided by PS is an intelligent cleaning app for iPhone or iPad that helps users categorize and organize storage space in their photo albums or contacts, optimizing the use of storage space (hereinafter referred to as the "Product" or "Photo Secure"). The app mainly consists of four modules: "Album," "Compression," "Privacy Space," and "Contacts." The storage space-saving capabilities and related solutions provided by each module are considered part of the services provided by "Photo Secure."
2. Product Use and Age Restrictions
By using the Product, you confirm that you are at least 18 years old, or if you are between the ages of 13 and 17, you must use the product under the supervision of a guardian. By accepting these Terms, we assume you are 18 or older and have the legal capacity to enter into this agreement.
If you do not comply with these Terms, you bear all risks and responsibilities for using the Product and are fully responsible for its use.
3. Intellectual Property and License
You acknowledge and agree that all intellectual property rights in the Product, including but not limited to all copyrights, trademarks, patents, icons, logos, characters, layouts, service marks, product names, software code, trade secrets, buttons, color schemes, and graphics, are owned exclusively by PS and are protected by local and international intellectual property laws and treaties, including all applicable copyright laws and regulations.
As long as you are eligible to use the Product, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use the Product on your wireless electronic devices that you own or control, solely for the purpose of accessing and using the Product in accordance with these Terms.
Your software license is limited to the usage rules outlined in the applicable app store terms of service and applies only to devices running the iOS operating system.
4. Subscriptions, Billing, and Refunds
The product's trial features (limited content or functional modules) are free of charge.
The trial subscription for the Product is also free of charge. However, please be aware that once the "trial subscription" is activated, the trial period lasts for 3 days. You must cancel the subscription at least 24 hours before the trial period ends to avoid automatic renewal into a regular subscription.
Regular subscriptions are the product's paid options, typically referring to subscriptions without trials, that activate all the Product's features and allow you to fully experience the Product without restrictions. Charges will apply for regular subscriptions.
Subscriptions automatically renew unless auto-renew is turned off 24 hours before the end of the current subscription period. You can cancel the subscription through the account settings in the App Store. Canceled subscriptions will not refund unused portions of the current subscription period, and other terms or conditions may apply to subscriptions when ordering or renewing.
Subscriptions purchased via the App Store do not immediately transfer funds to our developer account and are subject to App Store’s refund policies. We do not have the authority to issue refunds and recommend you contact App Store support for refund requests.

5. Updates
PS reserves the right to add or remove features or functionalities from the "Photo Secure" application. The app regularly communicates with our servers, and when a new version or features are available, it may prompt users to update the application on their devices. Updates may occur automatically or with prior notification.
6. Term and Termination
This agreement takes effect upon approval and remains valid as long as the user continues to use the "Photo Secure" application.
PS may terminate this agreement at any time if the user violates the Terms or any other agreements or rules applicable to the Apple App Store services, without any obligation for compensation or further notice.
Users agree that PS is not responsible for any termination or disablement of the "Photo Secure" application. After termination of this agreement, users must immediately stop using the application and uninstall, delete, or destroy all copies of the application. Termination does not affect any other legal rights or remedies of "Photo Secure."
7. Limitation of Liability
To the maximum extent permitted by law, you explicitly understand and agree that "Photo Secure" is not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, reputation, use, data, or other intangible losses or damages. These losses include:
a. The use or inability to use the "Photo Secure" application;
b. Unauthorized access or alteration of your transmissions or data;
c. Any third-party claims or actions;
d. Any other matters related to "Photo Secure."
In no event shall "Photo Secure" be liable for damages, losses, or legal actions (whether based on contract, tort, or otherwise) exceeding the amount you paid for accessing the "Photo Secure" app. This limitation applies even if the remedy fails to achieve its essential purpose.
In the event of a force majeure event (as defined below), "Photo Secure" shall not be held liable for failing to perform its obligations under this agreement or for delays or incomplete performance.
A "force majeure event" refers to events beyond the reasonable control of the affected party, including but not limited to natural disasters, civil unrest, and war.
8. Jurisdiction
This agreement and any legal relationships arising from it shall be governed by the laws of Hong Kong, and the courts of Hong Kong shall have jurisdiction over any actual or potential disputes arising from this agreement. To the fullest extent permitted by law, you consent to the jurisdiction and venue of such courts and waive any objections to such jurisdiction.
9. Miscellaneous
No modification or amendment of this agreement will be binding unless it is in writing and signed by PS, the producer of "Photo Secure." A party’s failure to exercise any rights or take action in case of breach should not be deemed a waiver of that party’s right to enforce the agreement in the future.
Translations of this agreement are provided based on local requirements, and in case of any discrepancies between the Traditional Chinese and non-Traditional Chinese versions, the Traditional Chinese version shall apply to the extent permitted by law.
If any provision of this agreement is found to be invalid or unenforceable by any court or administrative authority, the remaining provisions shall remain in full force and effect. The invalid provision will be interpreted and enforced to the maximum extent permitted by law to fulfill the purpose of the agreement.
10. Assignment
PS may assign any and all rights and obligations under these Terms, in whole or in part. You may not assign or sublicense your rights or obligations under these Terms to any third party.
