Welcome to PhotoBrush Art (“App”), developed and operated by Rick Hicksted Jr. (“Developer,” “we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms of Service and End User License Agreement (“Terms”). If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on iPhone, iPad, or other Apple devices you own or control.
This license is for personal and non-commercial use only, unless we specifically authorize otherwise.
You do not own the App or its content; all rights remain with us.
You agree not to:
Copy, distribute, or modify the App outside what Apple permits.
Reverse engineer, decompile, or disassemble any part of the App.
Use the App to generate unlawful, harmful, defamatory, or misleading content.
Attempt to interfere with or disrupt our services, servers, or networks.
Use the App in a way that violates Apple’s App Store Terms of Service.
All rights, title, and interest in the App (including software, designs, algorithms, models, question data, and content) are owned by Rick Hicksted Jr.
Unauthorized use may violate copyright, trademark, and other laws.
If you submit feedback, you grant us a perpetual, worldwide, royalty-free license to use it to improve the App.
The App is provided “as is” and “as available.”
We make no guarantees that the App will be error-free, uninterrupted, or meet your needs.
Generated content (including paint-by-number templates and image transformations) may contain inaccuracies. We make no warranties as to correctness, reliability, or fitness for a particular purpose.
Use the App at your own risk.
To the fullest extent permitted by law:
We are not liable for any damages, including loss of profits, data, or device issues, resulting from your use of the App.
Your sole remedy if dissatisfied with the App is to stop using it.
Any in-app purchases or subscriptions are processed through Apple’s App Store.
Prices, renewal terms, and cancellation procedures are disclosed at the time of purchase.
Refunds are managed by Apple under its App Store policies, not by us.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts located in Orange County, California, unless your local law requires otherwise.
We may suspend or terminate your license if you violate these Terms. On termination, you must delete the App from your device(s).
We may update these Terms at any time. Updates will be posted in the App and/or on our website. Continued use of the App means you accept the revised Terms.
