Terms of Use for Photo to Recipe Scanner

Please read these Terms of Use (“Terms”) carefully before using the Photo to Recipe Scanner mobile application (“App”) operated by Photo to Recipe LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms.

2. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App.

• Use the App for any unlawful purpose or in violation of applicable laws.

• Interfere with or disrupt the App’s operation or servers.

• Modify, adapt, or create derivative works from the App.

3. User Content & Privacy

• Images & Recipes: You retain ownership of any photos you upload. You grant us permission to transmit your images to third-party services (e.g., OpenAI) for recipe analysis. All images and generated recipes are stored locally on your device; we do not store them on our servers.

• Privacy Policy: Our Privacy Policy governs the collection and use of your personal data, including images. By using the App you also agree to the Privacy Policy.

4. Intellectual Property

The App and its entire contents (excluding user-provided images and data) are protected by copyright, trademark, and other intellectual property laws. You agree not to copy, distribute, or create unauthorized derivative works.

5. Third-Party Services

The App integrates with third-party APIs (e.g., OpenAI) for image recognition and recipe generation. Your use of those services is subject to their terms and policies.

6. Disclaimers

• No Warranties: The App is provided “as is” and “as available,” without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

• Accuracy: We do not guarantee that recipe suggestions or nutritional information are accurate or error-free. Always verify cooking instructions and ingredients before use.

7. Limitation of Liability

To the maximum extent permitted by law, in no event will Photo to Recipe LLC or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. Our total liability to you for all claims under these Terms will not exceed the amount you paid (if any) to download the App.

8. Indemnification

You agree to defend, indemnify, and hold harmless Photo to Recipe LLC, its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.

9. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

11. Changes to These Terms

We may modify these Terms at any time. If we make material changes we will notify you via the App or email. Continued use of the App after changes constitutes acceptance of the new Terms.
